(M&C Required) COUNTY OF TARRANT S WHEREAS, the City of Fort 'worth (City) and Wade & Associates, Inc. , (Engineer) made and entered into City Secretary Contract No. 26426, (the Contract) which was authorized by the City Council by M&C C-18336 on the 7th day of November, 2000 and subsequently revised by two previous amendments; and WHEREAS, the Contract involves engineering services for the following project: Village Creek Drainage Area Wastewater Collection System Evaluation. WHEREAS, Wade & Associates, Inc. assigned its rights and obligations under Contract No. 26426 to CH2M Hill, Inc. WHEREAS, it has become necessary to execute Amendment No. 3 to said Contract to change Engineer to CH2M Hill, Inc. , to include an increased scope of work and revised maximum fee. NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Engineer shall mean CH2M Hill, Inc. 2. Article I, of the Contract is amended to include the additional engineering services specified in M&C C-23676, adopted by the City Council on the 21st day of July, 2009, and further amplified in a proposal letter dated December 3, 2008, copies of which are both attached hereto and incorporated herein. Authorize the transfer of$204,799.00 from the Water and Sewer Operating Fund to the Sewer Capital Projects Fund; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Sewer Capital Projects Fund in the amount of$204,799.00; and 3. Authorize the City Manager to execute Amendment No. 3 to City Secretary Contract No. 26426 to change the engineering firm from Wade &Associates, Inc., to CH2M HILL, Inc., per a Novation Agreement (City Secretary Contract No. 37615) and to increase the amount of the agreement by $180,909.00 for additional engineering services, thereby increasing the total agreement amount to $1,110,696.00. DISCUSSION: On November 7, 2000, (M&C C-18336) the City Council authorized an engineering agreement in the amount of$457,464.00 with Wade &Associates, Inc., for the Village Creek Drainage Area Wastewater Collection System Evaluation Study. Amendment No. 1 (M&C C-C18824, November 6, 2001) in the amount of$268,583.00 provided for closed circuit TV inspection to identify defects and restore pipe capacity for several sanitary sewer manholes that overflowed within the project area during heavy rainfall even in February and March 2001. In addition, the amendment provided for design of deteriorated sewer mains to improve the quality of service to customers and eliminate the manhole overflows. Amendment No. 2 (M&C C-19652, July 8, 2003) in the amount of$203,740.00, provided the necessary design to eliminate sanitary sewer overflows and backup problems in the vicinity of Truman Court, the 1800 block of Lloyd Avenue and the 1900 block of Edgewood Terrace. In addition, the amendment provided for oversight of sewer cleaning and closed circuit television inspection project with multiple contractors to remove debris accumulation to restore capacity and identify structural deterioration of large diameter sewers within the Village Creek drainage basin. Under a Novation Agreement (City Secretary Contract No. 37615) Wade & Associates, Inc., assigned its rights and obligations under City Secretary Contract No. 26426 to CH2M HILL, Inc. Therefore, the name of the Engineer will be changed via Amendment No. 3 to CH2M HILL, Inc. The preparation of traffic control plans. The preparation of storm water pollution prevention plans. The preparation of additional permits and easements. Revisions to the contract documents and specifications to reflect current City standards. Additional coordination meetings on the project. CH2M HILL, Inc., proposes to provide these additional services for a lump sum fee of$180,909.00. City staff considers the amount to be fair and reasonable for the scope of services proposed. In addition to the contract amount, $23,890.00 is required for project management, real property acquisition and utility coordination. CH2M HILL, Inc., is in compliance with the City's M/WBE Ordinance by committing to 9 percent M/WBE participation on this Amendment No. 3. The City's goal on this amendment is 9 percent. This project is located in COUNCIL DISTRICT 5. Design Footage Increase: During the execution of this contract,several detailed contract amendments were issued and approved which added design services to the original project shtdy. luring the achial preliminary and final design phast-s of the h1- 188,M-170A area and M-503 improvement project locations, it was determined the prior amendments to this contract did not fully address the overall increase in design footage, particularly regarding pipeline abandonments. The revised pipe footage for M-188 is 6,145 LF which is 322 LF greater than previously compensated in prior amendments. Additionally,this design project location included the abandonment of approximately 4,845 LF of existing sewer mains. Therefore we are seeking additional design fees for 322LF x$14.79/LF of new design footage and 4,845LF x$7.00/LF of abandonment pipe fuutdge.The total fee request for these items is$38,677.00 in additional design fees. Z. Permits and Easements: The Engineer originally submitted 4 easement instruments for this project which exceeded the budgeted amount by one easement instrument at $440.00,including a 10% markup. Since that time,we have re-submitted those instruments at the diracliun of the City in the City's new format resulting ill do additional easement preparation fee of$1,760.00(4 x$440). We also have prepared four temporary construction easement instruments in the amount of 5880.00(4 x$220/EA.), including a 10% mark-up. Additionally, we modified une of(lie easements for 5440.00 and ttvisLd appruxirnawly 160 LF of existing sewer design to accommodate a local drainage improvements project off of Truman Strect:n the amount of$2,360.00(160 LF x S14.79/LF). A new TxDOT construction pernvt had to be obtair.ed for this project in the amount of $1,000.00 due to the expiration cf the original }permit and system changes in the East L,•,jp 820 fruntage road. ANA Consultants,a M/W BE subconsultant will complete the TCPs. The total fee to develop TCPs is$6,600.This price includes it 10% subconsultant mark- up. M-170A Area Design 5. Design Footage increase. The revised Pipe footage for the M-170A arca improvemontc is approximately 7,100 LF which is 1,365 LF greater than the length in the Contram Additionally, this design project location included the abandonment of approximately 5.030 LF of existing sewer mains not included in the Contract. Therefore we are seeking additional design fees for 1,365 LF x$19.79/LF of new design footage and 5,030LF x $7.00/LF of abandonment pipe footage. Lastly,a total of 43 service reroutes were required for this project location. No budget was established for the design of these sewer service relocations resulting from the extensive sewer main realignment in the area. We are seeking$200.00 per service reroute and an additional$3,900 to update and survey these re-routes. We are requesting$68,298 in labor and expenses associated with the revised design footage and service reroutes. 6. 'Traffic Control flans. The City has directed the Engineer to provide'rraffic Control Plana(TCPs) for this project. ANA Consultants,an M/WBE subconsultant will complete the TCPs. Junction Structure Design. This special project location design required the design of nvo large junction structures and an aerial pipeline crossing a heavily rip-rap lined drainage channel near Lake Arlington The site's complexities(continually changing conditions in the creek topography and existing rip-rap lining)and heavy structural design requirements necessitated approximately$10,166 in additional detailed design work than was originally scoped. The Engineer was directed by the City in February 2008 to provide monthly reporting and attend monthly coordination meetings to assist tile City document progress on existing projects under the SSO initiative. Attending the meetings and providing monthly reports necessary for the meetings is out of.scope work. It is assumed these meetings will continue through February 2009. We recognize that this is a large amendment request addressing legacy work associated with this contract. We have now implemented processes to ensure that amendments are requested in a timely manner in response to the City's requests.
