AN ORDINANCE ADOPTING APRO-RATA CONNECTION FEE AGAINST
EACH LOT CONTAINED WITHIN THE WILLOW SPRINGS RANCH, AN
ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY TEXAS
AS FOLLOWS BLOCK 1 LOTS 9 THOUGH 25 INCLUSIVE, BLOCK 3
LOTS 1 THROUGH 14 INCLUSIVE, BLOCK 4 LOTS 1 THROUGH 17
INCLUSIVE, BLOCK 5 LOTS 1 THROUGH 14 INCLUSIVE, BLOCK 6,
LOTS 1 THROUGH 8 INCLUSIVE, BLOCK 7 LOTS 1 THROUGH 8
INCLUSIVE, BLOCK 8, LOTS 1 THROUGH 18 INCLUSIVE, PROVIDING
FOR THE CALCULATION OF THE PRO-RATA CONNECTION FEE,
PROVIDING FOR THE ASSESSMENT AND PAYMENT OF THE PRO-
RATA CONNECTION FEE, MAKING THIS ORDINANCE CUMULATIVE
OF PRIOR ORDINANCES REPEALING ALL ORDINANCES AND
PROVISIONS OF THE FORT WORTH CITY CODE IN CONFLICT
HEREWITH, PROVIDING A SAVINGS CLAUSE, PROVIDING A
SEVERABILITY CLAUSE, AND PROVIDING AN EFFECTIVE DATE.
WHEREAS the D R. Moss Development Company ("Developer") has entered into a
community facilities agreement with the City of Fort Worth for the development of the Willow
Springs Ranch, an addition to the City of Fort Worth, Tarrant County Texas, such community
facilities being hereinafter referred to as the `Contract" and
WHEREAS pursuant to the terms of the Contract and as more fully described therein,
Developer is to construct certain water improvements within the Willow Springs Ranch, the total
cost of such improvements to include construction inspection and materials testing fees, and
WHEREAS the City of Fort Worth has agreed to reimburse Developer for the total cost
of the water improvements as described in the Contract; and
WHEREAS, the section 395 001(1)(B)(4)(C) of Chapter 395 Texas Local Government
Code, allows for the assessment of lot or acreage fees for the purpose of reimbursing developers
for oversizmg or constructing water or sewer mains or fines by such developers, and
WHEREAS section 395 001(1)(B)(4)(D) of Chapter 395 Texas Local Government
Code, allows for the assessment of pro rata fees for the purpose of reimbursing the City for costs
incurred for the extension of water or sewer mains or lines by the Crty• and
WHEREAS, rt is m the best interest of the Developer as well as the Crty of Fort Worth to
allow for the establishment pro rata connection fees to recoup the cost incurred for the
construction of water improvements to provide service to the Willow Spring Ranch.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH.

Section 1.
In accordance with Chapter 395 Texas Local Government Code, there is hereby adopted
and assessed apro-rata connection fee in the amount of $5,841.53 against each lot within the
Willow Spnngs Ranch, an addition to the Crty of Fort Worth, Tarrant County Texas, as
described below
Block 1 Lots 9 though 25 inclusive
Block 3 Lots 1 through 14 inclusive
Block 4 Lots 1 through 17 inclusive
Block 5 Lots 1 through 14 inclusive
Block 6, Lots 1 through 8 inclusive
Bock 7 Lots 1 through 8 inclusive
Block 8, Lots 1 through 18 inclusive,
more particularly as shown on Exhibit A attached hereto and made a part hereof for all
purposes.
Section 2.
The calculation of the pro-rata connection fee is calculated is follows.
Construction Cost $539,218
Construction Inspection Fees 10 784
Materials Testing Fees 10,784
Total Construction Cost 560 787
The pro-rata connection fee is determined by dividing the Total Construction Cost by the
number of lots (96) within the Willow Springs Ranch that are located wrtlun the Crty of Fort
Worth, Tarrant County Texas.
$560 787 / 96 = $5,841.53 (rounded)
Section 3.
The pro-rata connection fee assessed against each lot shall be paid at the time of the
issuance of the building permit or connection to the system, which ever occurs later
Section 4.
This Ordinance shall be filed m the Tarrant County Deed Records and such filing shall be
deemed actual notice to the purchaser of any lot within the Willow Spnngs Ranch that this
Ordinance is intended to cover

Section 4.
This ordinance shall be cumulative of all provisions of ordinances and of the Code of the
City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are
m direct conflict with the provisions of such ordinance and such Code, m which event conflicting
provisions of such ordinances and such Code are hereby repealed.
Section 5.
It is hereby declared to be the intention of the City Council that the sections, paragraphs,
sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause,
sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid
judgment or decree of any court of competent ~unsdiction, such unconstitutionality shall not
affect any remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since
the same would have been enacted by the Crty Council without the incorporation in this
ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section.
SECTION 6.
This ordinance shall take effect upon adoption.

1 Authorize the City Manager to execute a Community Facilities Agreement with D R. Moss Land
Development Company for the installation of water services to serve Willow Springs Ranch located in far
northwest Fort Worth and
2. Adopt the attached Pro-Rata Connection Fee Ordinance to provide the City reimbursement for cost of
the water system improvements, including construction inspection and material testing fees.
DISCUSSION
D R. Moss Land Development Company has executed a proposed contract for community facilities to
serve asingle-family development located in the far northwest portion of Fort Worth south of Avondale-
Haslet Road and west of Willow Springs Road (see attached map) This subdivision has annexed into the
City of Fort Worth on November 8 2005 (AX02-009) Ordinance No 16704 where 96 lots are now in the
City and 42 lots remained in Tarrant County The 42 subdivision lots located in the County will not connect
to the water system
The total cost for water improvements for this development is $560 786 00 including construction
inspection and material testing fees The developer will pay for the water system improvements and be
reimbursed by the City as follows forty percent of the cost will be reimbursed upon completion of 50
percent of the water system improvements and the remaining sixty percent of the cost will be reimbursed
upon completion inspection and acceptance of the water system improvements. The City will be
reimbursed for the cost of the water system improvements through the pro-rata connection fee
ordinance The pro-rata connection fee ordinance will apportion the cost of the water system
improvements among the 96 lots in the subdivision that will connect to the water system which is equal to
$5 841 53 per lot, and will be collected at the later of the issuance of a building permit or the connection to
the water system The City will be responsible for the filing of the ordinance in the Tarrant County Deed
Records.
