Consultants, L.L.C. , (Engineer) made and entered into City Secretary Contract No. 27555, (the Contract) which was authorized by the City Council by M&C 18984 on the 5th day of March, 2002 and subsequently revised by three previous amendments; and WHEREAS, the Contract involves engineering services for the following project: Engineering Design of Sanitary Sewer Rehabilitation Contract LIX (59) . WHEREAS, it has become necessary to execute Amendment No. 4 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I, of the Contract is amended to include the additional engineering services specified in MSC C-24115, adopted by the City Council on the 2nd day of March, 2010, and further amplified in a proposal letter dated August 12, 2009, copies of which are both attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $24,846.00. 2 . Article II, of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $217,704.00. ui4liCIAL RECORD CITY SECRETARY F-'.%'CRTH,TX 3. Authorize the transfer of$24,846.00 from the Water and Sewer Operating Fund to the Sewer Capital Projects Fund; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Sewer Capital Projects Fund in the amount of$24,846.00 from available funds; and 3. Authorize the City Manager to execute Amendment No. 4 in the amount of$24,846.00 to City Secretary Contract No. 27555 with A.N.A. Consultants, L.L.C., for Sanitary Sewer Rehabilitation Contract LIX, thereby increasing the contract amount to$217,704.00. DISCUSSION: On March 5, 2002, (M&C C-18984) the City Council authorized the City Manager to execute an Engineering Agreement in the amount of$105,160.00 with A.N.A. Consultants, L.L.C., for Sanitary Sewer Rehabilitation Contract LIX (59). The Agreement was subsequently revised by three amendments totaling $87,698.00 that are further described as follows: Amendment No. 1, in the amount of$29,000.00 (M&C C-191731, July 30, 2004) provided for the design of an additional 2,500 linear feet of severely deteriorated sanitary sewer pipe; Amendment No. 2, in the amount of $43,990.00 (M&C C-19255, September 24, 2002) provided for the design of sanitary sewer lines on Maddox Avenue and Mitchell Avenue; and Amendment No. 3, in the amount of $14,708.00 and administratively approved by the City Manager on April 21, 2008, provided for the design of sanitary sewer mains on Vickery Boulevard. Amendment No. 4 will provide compensation for the following: Revisions to the plans and specifications to reflect current City standards; Design for sewer service relocation; Additional survey and easement and permit preparation; and Traffic control plan preparation. A.N.A. Consultants, L.L.C., propose to perform the additional design work for a lump sum fee of $24,846.00. City staff considers this fee to be fair and reasonable for the scope of services proposed. A.N.A. Consultants, L.L.C., is in compliance with the City's M/ BE Ordinance by committing to five percent M/ BE participation on this Amendment No. 4. City of Fort Worth Water Department 1000 Throckmorton Street Fort Worth, Texas 76102 Re: Amendment No, 4— Sanitary Sewer Rehabilitation Contract LIX (59) — Parts 1 & 2, Part 1 DOE No.: 3575; Part 2 DOE No. 3946 Dear Mr. Sholola: Please accept this request for additional fees based on the following information related to the above mentioned project. A.N.A. completed Part 1 final plans for this project which were submitted to the city for final review on May 19"2003,and Part 2 final plans were submitted on November 24,2003. As a part of each 100% submittal the following were included: final sealed engineering plans, mylar cover sheet, cost estimates, temporary right-of-entries and TxDOT Permit. However due to City funding issues the project was placed on hold. Periodically over the last 6 years the City has requested updated cost estimates project status reports, additional plan sets and electronic topo. Over the last 5 years the following series of City's request were completed to assist the City in completing projects on a timely basis as emergencies arose: o November 16th, 2004 L-347 and L-294-B were sent to David Cooper with RJN Group to be constructed under another contract o June 30th, 2005 L-179 was sent to the city to be constructed on an emergency basis o October 10`x'2006 L-294-B electronic topo was sent to the city to be used for a roadway replacement project by city forces To date we have been unable to verify whether these lines have been built or if they are still part of this project. During the time period between 2003 and 2009, city specifications, bid documents, cost estimate formats, city border size and city standards have changed. The time and cost necessary to update plans, estimates, specification, additional project status reports, and updating of project schedules is not included in our current contract. Therefore, we respectfully request this amendment to our current contract in order to finalize this project in a timely manner. A.N.A.
