COUNTY OF TARRANT §
WHEREAS, the City of Fort Worth ("City") and Camp Dresser & McKee, Inc. (CDM)
("Engineer") made and entered into City Secretary Contract No. 27797 (the "Contract")which was
authorized by City Council via M&C C-19114 on the 41 day of June 2002; and
WHEREAS, the Contract involves engineering services for the following project:
Village Creek Wastewater Treatment Plant
Trinity River Pipeline Crossing (Parallel Siphon)
Project No. P171-070171300040 (City Project No. 00186)
WHEREAS, it has become necessary to execute Amendment No. 3 to said Contract to
increase the scope of services and/or the maximum fee.
NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized
representatives, enter into the following agreement that amends the Contract:
1.
Article I, of the Contract is amended to include the additional engineering services
specified in the Engineer's proposal letter dated August 13, 2009 and attached hereto. The cost
to City for the additional services to be performed by Engineer total $154,990.00. .

Article II of the Contract is amended to provide for an increase in the maximum fee to be
paid to Engineer for all work and services performed under the Contract, as amended, so that the
total fee paid by the City for all work and services shall not exceed the sum of$879,432.00.
3.
All other provisions of the Contract which are not expressly amended herein shall remain
in full force and effect.

Engineering Services Fee-Requested Amendment No. 3
Dear Madelene:
CDM has prepared an amendment for additional services associated with the Village Creek
Wastewater Treatment Plant, Trinity River Pipeline Crossing (Parallel Siphon) Project. The
amendment covers services for the following items:
• Additional professional services due to the construction duration allowed in the
contract documents was longer than anticipated when the original engineering scope
was established and the fact the contractor has been allotted additional time due to
unforeseen ingress/egress stoppage by the landowner.
�• Additional construction representative representation services due to the construction
duration allowed in the contract documents was longer than anticipated when the
contract was established and the fact the contractor has been allotted additional time
due to unforeseen ingress/egress stoppage by the landowner
• Construction administration and field visits for M/WBE subconsultant to review and
inspect work at junction Boxes D, DD, and EE.

1. Construction Administration Services-During the design,it was established that the
construction duration for the Parallel Siphon project was going to be set for 15 months.
Near the end of the design, the project was placed on hold from March 2006 to
September 2007. Prior to bidding the project,Maebelle Brown,City of Fort Worth
Water Department,increased the construction duration to allow the winning
contractor two independent dry weather periods to build the project. CDM's original
contract was scoped to provide professional services (construction administration and
resident project representation) for a 15-month contract duration. The following is a
summary of major items necessary for the additional construction administration:
o Project manager and/ or construction manager to prepare meeting agendas, attend
onsite bi-weekly meetings, complete and distribute meeting minutes throughout
the duration of the project- anticipated project completion date October 2009.
o Project manager and/ or construction manager to answer RFIs and project change
documentation throughout the duration of the project-anticipated project
completion date October 2009.
o Review shutdown procedures for 1.The removal of M280 and M338 inside
junction Box DDD,2. Cleaning of the existing siphons,3. Rehabilitation of junction
boxes D, DD, E, and EE 4. Barscreen building III flume removal and pipe slice.
o Provide Cadd exhibits as needed throughout the duration of the project-
anticipated project completion date October 2009.
o Conduct bi-weekly filed visits.
o Assists resident project representative on 24-hour shutdowns.
These additional services resulted in additional engineering costs of$42,140.00
2. Additional Services for resident project representative. CDM will provide a resident
project representative to monitor the construction of the Parallel siphon project 32-hours
per week from May 2009 to October 2009 (26 weeks) and 60-hours per week during the
two week shutdown of Barscreen building III. In addition,CUM will provide clerical and
Cadd assistance to the resident project representative.
This additional service resulted in addition costs of$101,350.00

3. Construction Administration for Junction Box D,DD,and EE. During the design,the
rehabilitation of junction Boxes D, DD, and EE were placed into the bid tab as
"Alternative bid items". The design of these items was paid for previously,but the
construction administration and resident project representation were excluded in the
event that the City chose not to accept the Alternative bid items.
This additional service resulted in addition costs of$11,500.00
The proposed amendment to CDM's engineering contract for performing the additional
services is detailed on the attached spreadsheet. The total amendment is $154,990.00 which
results in a new not-to-exceed limit for the contract of$879,432.00 Shown below is the
original contract amount and the previous and requested amendments.

Authorize the Execution of Amendment No. 3 in the Amount of$154,990.00 to City Secretary Contract No.
27797, an Engineering Agreement with Camp, Dresser and McKee, Inc., for the Design of the Trinity River
Pipeline Crossing at the Village Creek Wastewater Treatment Plant Located at the Northwestern Boundary
of the Village Creek Wastewater Treatment Plant at the Trinity River(COUNCIL DISTRICT 5)
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute Amendment No. 3 in the
amount of$154,990.00 to City Secretary Contract No. 27797, an Engineering Agreement with Camp,
Dresser and McKee, Inc., for the design of the Trinity River Pipeline Crossing at the Village Creek
Wastewater Treatment Plant located at the northwestern boundary of the Village Creek Wastewater
Treatment Plant, thereby increasing the contract cost to $879,432.00.
DISCUSSION:
On June 4, 2002, (M&C C-19114) the City Council authorized the execution of an Engineering Agreement
with Camp, Dresser and McKee, Inc., in the amount of$299,629.00 for the design and preparation of
construction documents for a third parallel siphon pipeline under the Trinity River to the Village Creek
Wastewater Treatment Plant and an upstream siphon interconnection structure and the preparation of
applications for United States Corps of Engineers permits.
Amendment No. 1, in the amount of$333,113.00, included additional design phase services and the
addition of construction management services for the project. Amendment No. 2, in the amount of
$91,700.00, compensated the engineer for condemnation assistance related to obtaining the upstream
easement, compliance with the City's newly adopted tree ordinance, additional effort for coordinating the
United States Corps of Engineers River Crossing Permit, additional design and construction management
services for the rehabilitation of existing downstream junction boxes and the addition of materials testing
services to the contract.
Proposed Amendment No. 3 compensates the Engineer for additional construction administration services
necessary due to changes in construction contract duration. At the time of advertisement, the Water
Department changed the construction contract time to span two summer(dry weather) periods to provide
adequate time for the contractor to complete the specified work. This increased the construction contract
time from the allocated time established in the Engineer's Construction Management Agreement
(Amendment No. 2). The construction contract time was further modified by Construction Contract Change
Order No. 1, extending the completion time by 30 days for a completion date of October 15, 2009.
Camp, Dresser and McKee, Inc., is in compliance with the City's M/WBE Ordinance by committing to an
additional seven percent M/WBE participation on this Amendment No. 3. The City's goal on this
amendment is seven percent.
