HomeMy WebLinkAboutContract 27845-A3 AMENDMENT NO. 3 STATE OF TEXAS b CITY SECRETARY CONTRACT No-n45-M (MSC Required) COUNTY OF TARRANT 8 WHEREAS, the City of Fort Worth (City) and Wade & Associates, Inc. , (Engineer) made and entered into City Secretary Contract No. 27845, (the Contract) which was authorized by the City Council by MSC C-19111 on the 4th day of June, 2002 and subsequently revised by two previous amendments; and WHEREAS, the Contract involves engineering services for the following project: Sanitary Sewer Main 286 and CDSL 32-T Drainage Areas Sanitary Sewer Improvements. WHEREAS, it has become necessary to execute Amendment No. 3 to said Contract to CH2M Hill, Inc. , include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Engineer shall be CH2M Hill, Inc. 2. Article I, of the Contract is amended to include the additional engineering services specified in MSC C-23694, adopted by the City Council on the 28th day of July, 2009, and further amplified in a proposal letter dated November 6, 2008, copies of which are both attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $168,001.00. 3. Article II, of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $1,538,156.00. DISCUSSION: On June 4, 2002, (M&C C-19111) the City Council authorized the City Manager to execute an engineering agreement with Wade and Associates, Inc., in the amount of$998,881.00 for the Sanitary Sewer Main 286 and CDSL 32-T Drainage Areas Sanitary Sewer Evaluation Study and Improvements. On January 28, 2003, (M&C C-19448) the City Council authorized the City Manager to execute Amendment No. 1 in the amount of$298,915.00 for additional pipe cleaning, closed circuit television inspection (CCTV) and geographic information system (GIS) mapping. On February 10, 2004, (M&C C-19961) the City Council authorized the City Manager to execute Amendment No. 2 in the amount of$72,359.00 for design of additional sanitary sewer. This proposed Amendment No. 3 compensates the engineer for additional design services necessary to rehabilitate the sanitary sewer system. The design services include design for about 23,000 linear feet of additional sanitary sewer pipe, and the addition of regulatory required odor control systems, traffic control plans and storm water pollution prevention plans. In addition to the contract price $10,000.00 will be needed for plan review. CH2M Hill, Inc., is in compliance with the City's M/WBE Ordinance by committing to an additional 16 percent M/WBE participation on this Amendment No. 3. The City's goal on this Amendment is 16 percent. This project is located in COUNCIL DISTRICTS 3 and 6. Contract Study Services L Smoke Testing and Manhole Inspections.Additional smoke testing and manhole inspections were performed above the contracted quantities.The table below summarizes the additional work performed. Odor Control Recommendations. During preparation of the Draft Study Report,the City directed the Engineer to incorporate system recommendations addressing odor control in the Study.This task was not included in the original contract or amendments. To complete this task,the Engineer reviewed confined space entry records,customer odor complaint records and tape review logs.A technical write-up for odor control was incorporated into the Study along with an exhibit(Figure VII-4),illustrating odor control recommendation locations.Review comments from the City have been received on the Draft report and require incorporation into the Final.report The table below summarized the level of effort for this additional work. Update Base Maps and Pipeline Rehabilitation Schedule.The City has directed the Engineer to update all GIS base maps with current system conditions including current maintenance records and overlaying current digital orthographic aerial images on each base map.The Engineer will incorporate maintenance records and revisit rehabilitation recommendations noted in Appendix M-Recommended Pipeline Rehabilitation Schedule of the Final Report.The City shall provide the Engineer current geodatabase files and digital orthographic aerial images.The table below summarizes the effort for this additional work. Study Review Meetings.The Contract provided a total of two review meetings with the City to complete the Draft and Final reports.These meetings have already occurred and from recent discussions with the City staff,the City wants to hold numerous additional meetings with Field Operations to review tapes and cross check report recommendations. From the table above,the net increase in system design footage is 5,548 LF of which 4,617 LF is pipe abandonment and 931 LF is new design.The additional footage at the unit price for new design of$14.79/LF equates to$13,770.The additional footage at a unit price for pipe abandonment of$7.00/LF equates to$32,319. The total for additional design footage is$46,089. 6. Redesign Pipe Footage.The City has directed the Engineer to redesign and relocate Line J from STA 0+00 to 8+90,and 1,4901 from STA 0+00 to 7+36,that were called to be installed by pipe bursting methods.The relocation is due to concerns that vibration from pipe bursting could damage existing structures behind homes(pools,decks,etc.). The City has requested a new line be installed at the front of homes in this area along Rowan Drive and Brants Lane. The redesign will result in approximately 1,790 LF of new pipe and 1,626 LF of pipe abandonment.At the unit cost of$14.79/LF for new design and$7.00/LF for pipe abandonment,the requested engineering fee is$37,856. Relocation of the line will also additional survey in the amount of$3,932. Ms.Madeline Rafalko,P.E. City of Forth Worth Water Department Page 5 November 6,2008 The total engineering and survey fees for the redesign are$44,256.This fee includes a 10% subconsultant mark-up. 7. SW3Ps.Amendment No.2 estimated two Storm Water Pollution Prevention Plans (SW3Ps)would be required at a cost of$2,000 each. Due to the diverse locations of the project sights,the approved funding is not adequate. Our subconsultant,ANA,has provided a quote of$9,350 to complete the SW3Ps for Clear Fork Parts 2 and 4. Therefore we request an additional$5,585 for the preparation of SW3Ps.This fee includes a 10% subconsultant mark-up. 8. Traffic Control Plans.The City has directed the Engineer to provide Traffic Control Plans(TCPs)for Clear Fork Part 2 and 4 construction packages. ANA Consultants,an M/WBE subconsultant,will complete the Traffic Control Plans. The total fee to develop TCPs is$14,740.This fee includes a 10% subconsultant mark- up. 9. SSO Coordination Meetings. The Engineer was directed by the City in February,2008 to provide monthly reporting and attend monthly coordination meetings to assist the City document progress on existing projects under the SSO initiative.Attending the meetings and providing monthly reports necessary for the meetings is out of scope work. Update Contract Specifications.In May 2008;the City's Contract Front Ends/Specifications have changed and require updating prior to the advertisement of Clear Fork Parts 2 and 4 construction packages.This will result in essentially a complete replacement of the outdated specifications which were 90 percent plus complete.The table below estimates the level of effort required to update the packages. We intend to use Spooner and Associates,Inc for additional survey for a total fee of$3,575.The percentage of the requested Amendment that would be performed by M/WBEs is approximately 16 percent. We recognize that this is a large amendment request addressing legacy work associated with this contract We have now implemented processes to ensure that amendments are requested in a timely mariner in response to the City's requests.
