Although the meeting is open to the public , citizens are requested to reserve comments and questions for the subsequent Council meeting so they will be a part of the uppgg pL d. Bolen: Is formal action required on today's agenda? (Alexander: Will be on next week's agenda.) Wetherby: Didn't we address poor attendance records back in October? Believe picture since October would be very different from picture over entire year. Bolen: Is report based on calendar year? (Alexander: Reporting of absent members is an on-going process.) Stute: How do we handle members with poor records we would like to retain? (Alexander: Council must take action to retain them at next Council meeting.) Newkirk: Aren't some members appointed by City Manager? (Alexander: Yes, appointed by City Manager but confirmed by City Council.) Herchert: Will have recommendations to the Council on those appointees. LL 2) Proposed Contract with Waste Management, Inc. (M&C C-8286) Ivory: (Reviewed progress on contract negotiations.) Stute: Where will $500,000 in payments be used? (Ivory: For development of Gateway Park.) Fielding: Contract states funds must be used on property where landfill is being operated. 3) Consideration of Ordinance Authorizing and Approving the Creation of an Industrial Development Corporation (M&C G-5963) and Stockyards Redevelopment Financing (I.R. No. 6931) Matson: (Reviewed M&C and I.R.) Williams: Who would set parking rates? (Matson; Rates would be set in contract between City and investors. By law, all parking must be uniformly priced and uniformly available to all the public.) Bolen: Would like to see area. Pre-Council Minutes April 10,1984 Page 2 Toal: Concept of Stockyards is commercial revitalization. Concerned not only with core but also with corridor, from Main Street to Meacham Field. Boundaries are 38th Street on the north to the river downtown, and from Could to Decatur on the east. Williams: All this would be defined as "blighted area?" (Toal: Yes.) Lancaster: Are these the same bonds we opposed in a resolution passed a few years ago? (Matson: No, resolution concerned small issue conduit bonds limited to $10 million, the proceeds of which are used for trade or business of a private firm.) Lancaster: Will these bonds be available to all? (Matson: Will be decided' by corporation you create; sale of bonds must be approved by City Council. ) Wetherby: Bonds can be applied only for public use? (Matson: Council is authorized to apply to private uses, though you have passed a resolution opposing bonds for such uses.) Lancaster: What is difference between this and City issuing regular bonds? (Matson: Fort Would could issue bonds, but it would be much more difficult to protect City from financial responsibility. These bonds protect the City and the bondholders by using a third party. These bonds will not be reflected on the City's financial statements. ) Lancaster: So there are three or four levels of protection? (Matson: The degree of guarantee required is established by the City.) Who makes decisions after sale of bonds? (Matson: The cor- portation operates the project but must come to Council for approval of bonds. Also, Council might want to serve as board of directors.) Do not want the financial liability to fall on the taxpayers. (Bolen: We will have letter of credit.) Newkirk: Under new accounting rules, will we have to disclose these bonds in our financial statements? (Bill Dillon: City may have to.) Even if guaranteed by another entity? (Dillon: Will have to see the new rule. ) Under present rule, we do not have to make disclosure? (Dillon: Correct.) Williams: What is effect of disclosure of these bonds on the taxpayers? (Herchert: Disclosure refers to accounting treatment; City would still not be liable.) Matson: We would be concerned only if City's credit rating is affected by additional disclosure; rating agency would probably look to the guaranteeing entity. Williams: Would City be obligated as with Braniff Place? (McCall: No, some liability existed in that case because of partial ownership of airport. No liability exists with this separate agency.) Pre-Council Minutes April 10,1984 Page 3 Stute: It would be explained in financial statements, if disclosed, that City has no liability for bonds? (Dillon: Yes.) Lancaster: If investors default, does financial institution have claim to improvements? (Matson: Institution would recover investment by hiring a third party to manage facility for duration of the lease with the City.) Lancaster: Effect on sale of City's own bonds? (Matson: Different set of people buying these bonds.) Newkirk: City would not mortgage Coliseum, correct? (McCall: Exposure would exist only for operation of facility during lease.) Zapata: Seems no different from what we've done for American Airlines. Think financial institutions are the ones who should be concerned, and we should be prepared to support it. Bolen: Council would need enough control over contract that City is not liable in any way; no mortgage would exist on city-owned facility, but possibly on privately-owned parking lot. Fort Worth has two major attractions: cultural district and historical heritage, which we must protect. Stute: City does same thing at Meacham Field when it agrees bank can take over contract on hangar if the original leaseholder defaults. Matson: Need to know who to appoint to board of directors. Bolen: Confused about best composition of board from a liability stand- point. (McCall: Better if entire Council is not on board.) Matson: Those willing to serve are Councilmembers Zapata, Johnson, Bagsby, and Wetherby. Barnett: Want to repeat that no liability exists for the City. Johnson: Will letter of credit cover same period as contract? (Sam Florence: Will cover bonds, but not entire length of a possibly 20-year contract.) 4) Job Training Partnership Act (JTPA) Title II-A Plan (M&C G-5962) Newell: (Reviewed M&C) Bolen: Thank you for the job you are doing. Bagsby: Would like to see some statistics on the program. Newell: Have some figures as of March 14, 1984 we had 1488 applicants, 609 qualified as participants, 73 entered positive terminations, 5 entered negative terminations. Did not get program fully operative until early January. 'Pre-Council Minutes April 10, 1984 Page 4 Bagsby: Concerning priorities set by State, how many female, heads of households have been placed? (Newell: Do not have those figures here.) Sapp: Will get you that report. RG Williams: Would like to recognize tremendous job Dave Newell is doing. I understand the program is treating women, heads of households as the number one priority. Bagsby: Important thing is getting these people employed, not just running them through application process. 5) Fixed Asset Records Project, Phase I (M&C G-5960) McKinney: (Reviewed M&C) Johnson: Has Audit Committee reviewed proposal? Lancaster: Yes, we are concerned about cost. Is this based on an hourly rate or a fixed fee? (McKinney: Will work out in contract at least cost to City.) Newkirk: Does this include cost of software? (McKinney: No, but does include cost of selecting software.) Lancaster: This inventory is something we have to do. Williams: To City's advantage to go through bid process? (McKinney: Looked at idea, but Arthur Andersen is already familiar with our accounting system.) Williams: Looks like a very expensive education we're paying for. (Nelson: This is a 3-4 year project. First, we will capture existing information, which is an initial investment. Then City needs a system to maintain the records. As with Austin, we expect our involvement to decline after first two years; City will assume responsi- bility.) Lancaster: Committee had concerns about cost, but was impressed with their past experience. Zimmer: Have worked with cities, TESCO, and other utilities. Cecil: Feel we need someone with experience in inventory systems for rate making. Lancaster: Hope new system will provide better documentation for setting rates to customer cities. Williams: Does $180,000 include the computer system? (McKinney: No, includes difficult selection process.) Zimmer: As with Austin, city will assume a larger and larger role.
