1 . PAY$ Award Presentation - Douglas Harman, City Manager and
Charles Boswell , Management Services Director
Bobbie Montgomery, OMS; Mary Luers , Water; Jack Sterling and
James Sullivan, T/PW; Louis Martin, Equipment Services ; Trent
Frazier , Water; and Donald Ford, Water , received certificates for
the suggestions they submitted which have saved the City money .
2 . Park Land Dedication Policy Review - Mary Rogers , Chair, Park
and Recreation Advisory Board
Ms . Rogers advised Council that the present park land dedication
policy has been in effect for 15-18 years . The Park Advisory
Board seeks the Council 's permission to form a committee to
review and update the policy. Ms . Rogers also stated that
Council may be represented on the Committee if it so desires .
Council gave the Park Board permission to proceed.
3 . Illegal Carports - Joe Bilardi , Development Director and Wade
Adkins , City Attorney
Mr . Bilardi informed Council that three applications have been
received by the Board of Adjustments for variances in regards to
carports . The Board denied the variances and the parties
involved are now seeking legal remedy. He also stated that the
only way to alleviate the property owners problem in this area is
to amend the zoning ordinance which would be a controversial
route. Mr . Bilardi stated that staff recommends no such change.
Councilmember Murrin explained that this problem stems from
construction in the 1940s and 1950s when no provision was made
for second vehicles . He stated that each individual neighborhood
should be viewed separately.
Wade Adkins , City Attorney , advised Council that the Board of
Adjustments does not have the authority to give a variance on a
set back requirement . The Zoning Commission would have to review
the issue to decide if there is any basis for a variance. Mr.

Adkins also stated that without Council direction, a department
cannot arbitrarily decide to overlook the enforcement of certain
ordinances .
Council will draft a Council Policy which will then be sent to
the Zoning Commission asking them to review this issue in light
of these developments .
4 . Development Policy : Letters of Credit and Community Facility
Agreements - David A. Ivory, Senior Assistant City Manager and
Gary Steinberger , Assistant City Attorney
Mr . Ivory stated that changes in financial institutions have
affected the collateral required by the City under a Community
Facility Agreement . As the situation currently stands , there are
four ways to secure an agreement : 1 . ) cash 2 . ) surety bonds 3 . )
certificate of deposit , and 4 . ) a letter of credit .
Approximately 50% of the developers now secure the agreement with
a letter of credit .
A problem exists when the developer files for bankruptcy . The
City is then in the position of waiting for its money along with
all other creditors . Although surety bonds and cash requirements
would give the most security to the City, it would also exclude a
large number of developers from competing for Community
Facilities Agreements .
5 . Issues List Update - Douglas Harman, City Manager
Mr. Harman asked that Council direct any questions it might have
regarding the issues list to staff so that they can be addressed.
Mr. Harman also commented that an article appeared in the Fort
Worth Star Telegram which stated that homicide statistics in Fort
Worth have decreased in the last two years while in Dallas they
have increased. This is significant because in recent years , the
statistics for both cities have been relatively the same.
6 . Fiscal Impact Analysis ( I .R. No. 7342) - Charles Boswell ,
Management Services Director
Louis McLane , Administrative and Fiscal Consulting Services ,
presented a model of fiscal impact analysis from McKinney , Texas .
The model is a case study of McKinney when the city was faced
with an annexation which was 50% greater than the existing city .
The model has also been used on two smaller developments with
success . The model does not , by itself , give a recommendation
for or against a particular development , but rather gives
direction for making that decision . This model would be employed
at the concept stage in conjunction with annexation.
7 . Proposed City Council Retreat - Mayor Bob Bolen
Mayor Bolen asked that Council set the time for the retreat and
then allow staff to formulate the agenda .
The retreat was set for February 24 and 25 , 1989 .
8 . Methane Gas Recovery Project at Northeast Landfill ( I .R. No.
7343 ) - Tom Davis , City Services Director
It is proposed that a portion of the closed landfill located at
6901 Randal Mill Road be leased to Clark Industries to allow them
to recover methane gas which is currently being vented into the
air . The contract would be for three years and could yield $5000
- $9000 in revenue a month for the City ( the City would receive
a one-eighth royalty) . This is a standard route which is
currently being used in San Antonio and Witchita Falls . The
project also carries with it no liability for the City .
9 . Change in March 14 , 1989 Council Meeting due to NLC
Congressional Cities Conference - Ruth Howard, City Secretary
The March 14 , 1989 meeting was rescheduled to March 16 , 1989 .
10 . Contract with Women' s Center of Tarrant County for Whispering
Oaks Transitional Housing Demonstration Project (M&C-11373) -
Sandra Gonzales , Housing/Human Services Director
This was a sole-source contract , therefore no bids were
solicited. This contract is not an extension of the existing
contract but rather is for the concept of self-sufficiency for
the residents . Staff will be added at Whispering Oaks for the
implementation of the program.
11 . Rental Assistance Demonstration Program (M&C G-7886) - Ramon
Guajardo , Assistant City Manager
Mr. Guajardo reviewed the proposal for the program which will
assist low-income families in reaching self-sufficiency . The
City also will have the option to eliminate a family from the
program if it does not take appropriate steps to gain
self-sufficiency .
The housing will not be provided on a competitive basis because
the staff has determined that Regal Ridge satisfies the
requirements .
Councilmember Webber asked that the proposal be addressed by
another meeting of the full Housing Committee . She also asked
that the matter be delayed until the procedures involved can be
addressed .
12 . Construction of the Botanic Garden Entry (M&C C-11393) -
Ralph Emerson, Park and Recreation Director
A plan was presented which would allow for the construction of
gates at the University Street entrance to the Botanic Gardens .
The project will cost $165 ,000 . Park and Recreation is asking
for a transfer of $30 ,000 for the project and Council 's
permission to proceed. The gate and entryway will cost $5000 a
year in maintenance which will be funded by a donation from
General Dynamics .
13 . In-House Engineering Guidelines (M&C G-7844) - Charles
Boswell , Management Services Director and Costa Triantaphilides ,
Director , Internal Audit
The guidelines will be implemented as Council directs . This item
was withdrawn and will be brought back at a later date .
14 . Zoning Ordinance Text Amendment : Buffer Yard Ordinance
(Z-88-073) - David Fielding, Chair , Zoning Commission
The Buffer Yard Amendment stipulates that a buffer must separate
a commercial from a residential area . The buffer must include a
masonry fence, green space, and a building set-back. The Zoning
Commission will review the development options portion of the
amendment and report back to Council in approximately six months
with their recommendations .
15 . Aviation Advisory Board Presentation on 1989 Airshow Promoter
- Representative from the Aviation Advisory Board
Ann Cozart , Chair , Aviation Advisory Board, told Council that the
Board recommends Fort Worth Aviation Heritage Association as the
1989 Airshow Promoter .
Councilmember Zapata questioned the selection of this group
because he felt that the other proposal from the Hotel/Motel
Association was more complete. Mr. Zapata also asked for a one
week delay in order to obtain a legal opinion on the alleged
conflict of interest of Neal Anderson.
16 . Contract for State Affairs Consultation and Representation
(M&C C-11399) - Councilmember Garey Gilley, Chair, City Council
Legislative and Intergovernmental Affairs Committee
Due to the void left by Jim Wilson' s death, Councilmember Gilley
briefed Council on the proposed contract with Charles Evans to
act as a representative for the City of Fort Worth in the Texas
Legislature . The cost of the two year contract is $60 , 000 .
Cynthia Weatherby has been hired into the position left vacant by
Mr. Wilson. Mr. Harman stated that the approval of the contract
with Mr. Evans will provide for a two year period in which Ms .
Weatherby can become familiar with the process and the needs of
Fort Worth. During this time, the City will be protected by the
added expertise of Mr . Evans .
