HomeMy WebLinkAboutOrdinance 16605-09-2005Ordinance No 0~-4q a~5 AN ORDINANCE INCREASING APPROPRIATIONS IN THE SOLID WASTE FUND IN THE AMOUNT OF $174 790 AND DECREASING THE UNRESERVED RETAINED EARNINGS BY THE SAME AMOUNT FOR THE PURPOSE OF TRANSFERRING SAID FUNDS TO THE SOLID WASTE CAPITAL IMPROVEMENTS FUND MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2004- 2005 in the Budget of the City Manager there shall also be increased appropriations in the Solid Waste Fund in the amount of $174 790 and decreasing the unreserved retained earnings by the same amount, for the purpose of transferring said funds to the Solid Waste Capital Improvements Fund. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction such decision, opinion or judgment shall in no way impair the remaining portions, sections or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No. 16061 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed SECTION 4 This ordinance shall take effect upon adoption APP AST R AN LEGALITY Assistant A ney ADOPTED AND EFFECTIVE. ~2,/I/~.~(~~' ~, ~~ City of Fort Worth, Texas Mayor and Council Communication SUBJECT Adopt Appropriation Ordinances and Authorize Execution of Amendment No 1 to Engineering Agreement with DeOtte Inc for Landfill Access Road and I H 20 Access Road i I RECOMMENDATION It is recommended that the City Council 1 Adopt the attached appropriation ordinance increasing appropriations in the Solid Waste Fund by $174 790 00 and decreasing unreserved retained earnings by the same amount; 2. Authorize the transfer of $174 790 00 from the Solid Waste Fund to the Solid Waste Capital Improvements Fund 3 Adopt the attached appropriation. ordinance increasing estimated receipts and appropriations in the Solid Waste Capital Improvements Fund by $174 790 00 from available funds and 4 Authorize the City Manager to execute Amendment No 1 to City Secretary Contract No 31326 with DeOtte Inc in the amount of $157 790 00 for additional engineering services on the project, thereby increasing the contract amount to $948 710 00 DISCUSSION On February 8 2005 (M&C C-20519) the City Council authorized the execution of an engineering agreement with DeOtte Inc. in the amount of $790 920 00 for the southeast Landfill Access Road from existing Southeast Landfill Weight Station to I H 20 and Improvement to the I H 20 Access Road near the Southeast Landfill Access Road On May 10 2005 (M&C C-20730) the City Council authorized the execution of a Memorandum of Understanding (MOU) with the City of Forest Hill Texas for the construction of the Southeast Landfill Access Road The MOU provides the terms and conditions to be undertaken by Fort Worth and Forest Hill for the boundary adjustments and conveyance of certain land that is needed to construct an adequate and safe entrance road (Southeast Landfill Access Road) into the City's Southeast Landfill facility The MOU also requires both municipalities to execute an Interlocal Agreement for the rehabilitation of Wichita Street, from the southern right-of-way of US Highway 820 to a location north of the northern right-of-way of Alta Mesa Boulevard East; Anglin Drive from the southern right-of-way of I-20 Service Road to the southern right-of way of Lon Stephenson Drive and Lon Stephenson Drive from the eastern right-of-way of Forest Hill Drive to the western right-of-way of Anglin Drive Amendment No 1 will allow DeOtte Inc to provide the engineering services for the rehabilitation of Wichita Logname 30LANDFILL Page 1 of 2 Street, Anglin Drive and Lon Stephenson Drive within the limits described above DeOtte Inc. proposes to perform the necessary additional engineering services for a lump sum fee of $157 790 00 City staff considers this fee to be fair and reasonable for the scope of services proposed In addition to the amendment amount, $17 000 00 is required for additional project management by the Engineering Department.
