UZ+T�2 WHEREAS, the City of Fort Worth (City) and Union Pacific Railroad Company, a Delaware corporation (Developer) entered into a Community Facilities Agreement, City Secretary Contract No. 44754 ("CFA"); and WHEREAS, it has become necessary to execute Amendment No. 1 to the CFA to add City participation in an amount not to exceed $105,794 for the City's portion of the costs associated with Union Pacific Railroad Tower 55 water and sanitary sewer improvements contemplated by the CFA; and WHEREAS, the City Council authorized execution of Amendment No. 1 to the CFA on the 2015 via M&C 1671, NOW THEREFORE, City and Developer, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CFA: 1. The City's portion of inspection and material testing fees are directly allocated to the City's accounts for charges and does not reimburse the Water Inspection and Material Testing Fees to the developer. The City's cost participation shall be in an amount not to exceed $105,794 ("Participation"), but the reimbursement of the Participation (excluding inspection and material testing fees) is not a lump sum amount and may be less than stated above depending upon actual quantities from the Notice of Final Completion package (`Green sheet'). DISCUSSION: On July 18, 2013, the City and Union Pacific Railroad executed a Community Facilities Agreement (City Secretary No. 44754, M&C C-26197)to make various improvements to the City water and sanitary sewer facilities as part of the Tower 55 railroad improvements. Additional water and sewer work has been identified which will benefit the City, thus it is necessary to add City participation for water and sanitary sewer improvements at the following locations: upsizing an 8 inch water line to a 12 inch line just south of Pecan Street, through the UPRR right-of-way and connecting at 12th Street and abandonment of two sections of sanitary sewer under Cold Springs Road and at a point northwest of Windmill Street under the UPRR ROW.
