WHEREAS, Railhead Fort Worth is an Addition to the City of Fort
Worth, Tarrant County, Texas;and,
WHEREAS, Pate Engineers. Inc. has prepared and submitteg::; of
said area to the City of Fort Worth for its approval prior to such plat being recorded in the office
of the County Clerk of Tarrant County,Texas,and by virtue of such plat, Owner proposes to
dedicate to the City of Fort Worth a drainage easement which extends North,
and is shown as the area outlined on the attached diagram,which is marked Exhibit"A"and
hereby incorporated herein by reference for all purposes;
NOW THEREFORE, Railhead Industrial Park Investors, L.P., of Tarrant County,Texas,
being the owner of Railhead Fort Worth Addition to the City of Fort Worth,
Tarrant County,Texas, hereinafter called"Owner", one dollar and 001100 ($1.00), to him in
hand paid by the City of Fort Worth, and other good and valuable consideration,the receipt and
sufficiency of which is hereby acknowledged, hereby covenants as follows with the public and
City of Fort Worth, such covenants to constitute a servitude upon and to run with the land and
be binding upon Railhead Industrial Park Investors,L.P., and all future owners of the following
described real property situated in Fort Worth, Tarrant County, Texas:
Drainage & Lot Detention Easement Block 1, Lot 4 (6.267 Acres)LEGAL DESCRIPTION
ATTACHED.
1.
Owner covenants and agrees to maintain at all times the bed and banks of the detention pond in
the drainage easement outlined on the attached Exhibit"A"in accordance with the current
standards then in force and effect in the City of Fort Worth at no expense to the City of Fort
Worth. In the event Owner fails or refuses to correct any deficiencies or to make any
improvements in the bed and banks of the detention pond which are necessary in the opinion of
the City of Fort Worth to bring such detention pond into compliance with the current standards
for such ponds then in force and effect in the City of Fort Worth within 60 days after being
directed in writing by the City of Fort Worth to correct such deficiencies or make such
improvements, then and in such event the City of Fort Worth shall be authorized to enter in and
upon such detention pond and to correct such deficiencies or make such improvements or
cause same to be done on behalf of and at the expense of the Owner and to impress a lien for
the cost of such work upon the real property in Railhead North Side Infrastructure, an Addition
to the City of Fort Worth, Tarrant County,Texas,adjacent to and abutting the area in the
detention pond where such work was performed in order to secure reimbursement for such cost
to the City. Such lien shall be perfected by filing in the office of the County Clerk of Tarrant
County, Texas,an affidavit identifying the property to be charged with such lien, stating the
amount thereof, and making reference to this agreement.

Owner covenants and agrees and does hereby indemnify hold harmless and defend the City of
Fort Worth, its agents,servants and employees from and against all costs, expenses, losses,
damages, claims or causes of action whatsoever arising, or which might arise,from the failure
of Owner or any future owners of the above described property to maintain the bed and banks
of the detention pond in accordance herewith, or as a result of any damages caused to person
or property due to(1)flooding of the pond and its banks,(2)slope failure of the bank of the
pond, and(3)any failure of the pond and its bank to operate in a manner consistent with City of
Fort Worth criteria to perform any of its duties or obligations hereunder.

Owner covenants and agrees that no habitable building shall be erected within the drainage
easement outlined on Exhibit"A", but this paragraph shall not preclude construction of other
improvements within the drainage easement which do not impede drainage.

Owner covenants and agrees that no habitable building shall be erected on the above described
property abutting such easement which shall have a finished floor at an elevation less than two
feet above the maximum depth of water in the detention pond which would occur during a 100-
year frequency flood.
5.
Owner agrees that the above described real property abutting/containing the detention pond will
not be subdivided into smaller parcels or tracts, and that individual lots will not be sold, unless
and until an agreement in writing is made between the City of Fort Worth and the then owners
thereof providing for the improvement,at no expense to the City, of the bed and banks of the
detention pond to the extent deemed necessary by the City, impressing a lien upon such
parcels or tracts or lots for the cost of such improvements and indemnifying the City of Fort
Worth, its agents,servants and employees from and against all cost, expenses, losses,
damages to the bed and banks of the detention pond in accordance herewith, or to perform any
of their respective duties and obligations hereunder. It is further agreed that any attempt by
Owner to subdivide said real property or to sell individual lots without first complying herewith
and any purported conveyance made pursuant thereto shall be void.
The above covenants and agreements shall constitute a servitude upon and shall run with the
land and be binding upon the Owner and all subsequent owners of the above described real
property abutting the drainage easement outlined on the attached Exhibit"A", and hereby
incorporated herein by reference for all purposes.

Texas, more particularly described by metes and bounds as follows: (All bearings based on the record
bearings of said 153.78 acre tract)
COMMENCING at a 1/2"iron rod found for the southeastern comer of said 153.78 acre tract, said point also
being in the west right-of-way line of the Burlington Northern-Santa Fe Railroad (Fort Worth and Denver
Railway Company- 100' R.O.W.), from which a 1/2" iron rod found for the northeast corner of said 153.78

THENCE, North 62 degrees, 55 minutes, 18 seconds East, departing the said northeast line of
Low Iron Crossing Drive and along the northwest line of said Lot 2 and the southeast line of said
Lot 4, a distance of 1,505.78 feet to a point; said point being the north corner of said Lot 2 and

ROUTINE MAINTENANCE REQUIREMENTS:
Inspections:
• Periodically schedule inspections with a specified checklist at least once a year, if not every 6 months.
• Inspections should occur after major rainfall events to check for obstructions, damage, and debris/trash.
Vegetation Management:
• Mowing shall be on a regular basis to prevent erosion or aesthetic problems, at minimum twice during the
months of April and October and/or vegetation exceeds 12 inches in height. Maintain healthy grass at 4 to
6 inches in height.
• Limit the use of fertilizers and pesticides in and around the ponds to minimize entry into pond and
subsequent downstream waters.
• Do not leave grass clippings or trimming residue in pond, collect and dispose in trash.
Trash,debris and litter removal:
• Remove any trash causing any obstruction at the inlet, outlet, orifice, emergency overflow, or trash rack
during periodic inspections.
• Remove any trash after every runoff producing rainfall event.
• General pickup of trash in and around the pond during all inspections.
• Do not attempt to pick up or clean up any hazardous materials.
Mechanical Equipment check:
• Inspect any fences and gates, locks, or mechanical components during periodic inspections and replace or
repair as necessary.
Structural Component check:
• Inspect the outlet works, inlet, orifice, trash rack, and ernergency overflow with the periodic inspections.
• Remove any weeds that may interfere with operation.
NON-ROUTINE MAINTENANCE REQUIREMENTS:
Bank erosion/stabilization:
• Maintain effective ground cover on all vegetated areas in order to ensure proper infiltration of runoff and
effective filtering of pollutants.
• All areas not vegetated should be re-vegetated and stabilized immediately.
Sediment removal:
• Once a year, the accumulated sediment should be removed from the bottom of the outlet structure and the
pond depths checked at several points. If the depth of the accumulated sediment is greater than 25% of the
original design depth or the pond does not drain within 72 Hours, sediment should be removed.
Structural Repair/Replacement:
• During periodically scheduled inspections, inspect all structural components for repairs and replacement.

Subject: First Amendment to Detention Pond Maintenance Agreement with Railhead Association
Losi,
Please assign a City contract number to the "Detention Pond Maintenance Agreement" with Railhead Industrial Park
Investors. LP., dated November 2, 2004 (Instrument Number D204354349). While this agreement, which imposes
covenants restrictive on the use and maintenance of a piece of property, was never signed by the City or filed with the
City Secretary's Office, it is binding on the property owner and was filed in the real property records of the Tarrant
County Clerk's Office. Due to recent events, the City agreed with the property owner to amend the maintenance
agreement in order to revise the land areas that are subject to the continuing maintenance obligations.
The "First Amendment to Detention Pond Maintenance Agreement" was recently signed by both the property owner
and the City, and it will also be filed with the Tarrant County Clerk's Office. Please assign to this First Amendment an
amendment number sequential to the "Detention Pond Maintenance Agreement."
