a criminal justice or law enforcement agency,hereinafter referred to as the User Agency.
The Department of Public Safety reserves the right to restrict the type and scope of data to which individual
users may access.
This Agreement sets forth duties and responsibilities for the User Agency.
The User Agency may retrieve criminal justice information under this agreement only for those purposes
permitted by state and federal law. Any use of criminal justice information retrieved under this agreement shall
be limited to those uses permitted by state and federal law.
The User Agency and its employees shall abide by all present and hereafter enacted state and federal laws,
rules, and regulations concerning the collection, storage, retrieval, use, destruction, disclosure, and
dissemination of criminal justice information.
The User Agency shall be responsible for ensuring that the User Agency and its employees accessing criminal
justice information under this agreement are informed of all applicable state and federal laws, rules, and
regulations concerning the collection, storage, retrieval, use, destruction, disclosure, and dissemination of
criminal justice information. The User Agency shall promptly notify the Department of Public Safety of a
violation by the User Agency,or by an employee of the User Agency,of any applicable state or federal law,
rule, or regulation relating to the collection, storage,retrieval,use,destruction,disclosure,or dissemination of
criminal justice information retrieved under this agreement.
The Department of Public Safety reserves the right to immediately suspend service to the User Agency when
the Department determines that this agreement or any applicable state or federal law, rule,or regulation has by
violated by the User Agency or an employee of the User Agency. The Department of Public Safety may
reinstate service following such instances upon receipt of satisfactory assurances that such violations have been
corrected and measures have been taken to prevent future violations. The Department of Public Safety shall
have the authority to inspect and audit the equipment,records,and operations of the User Agency to determine
compliance with this agreement and all applicable state and federal laws.
The User Agency agrees to hold harmless the Texas Department of Public Safety, its Director,and employees
from and against any and all claims,demands, actions and suits, including but not limited to,any liability for
damages by reason of or arising out of any negligence on the part of the User Agency or its employees with
regard to criminal justice information under this agreement,to the extent permitted by the Constitution and laws
of the State of Texas.

The User Agency agrees to contact the Texas Department of Public Safety with any changes in existing and/or
additional personnel or any changes to account information In order to maintain the proper permissions in the
site.
This agreement will become effective upon receipt by the Department of Public Safety of the signed agreement.
In WITNESS WHEREOF, the parties hereto caused this agreement to be executed by the proper officers and
officials.
