HomeMy WebLinkAboutOrdinance 16509-07-2005ORDINANCE NO. ~~Sn~~07'a.p05 AN ORDINANCE AMENDING CITY ORDINANCE NO. 15819 BY INCREASING FROM TWENTY (20) TO ONE HUNDRED (100) THE NUMBER OF SHUTTLES WHICH SUPERSHUTTLE DFW CORPORATION IS AUTHORIZED TO OPERATE UPON THE PUBLIC STREETS, ALLEYS AND THOROUGHFARES OF THE CITY PROVIDING THAT THE FINDINGS AND RECITATIONS CONTAINED IN THE PREAMBLE ARE THE FINDINGS ~OF THE CITY COUNCIL, PROVIDING FOR WRITTEN ACCEPTANCE OF THIS ORDINANCE BY SUPERSHUTTLE DFW CORPORATION MAKING THIS ORDINANCE CUMULATIVE OF ALL ORDINANCES, PROVIDING A SEVERABILITY CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on January 12, 2004 SuperShuttle DFW Corporation was granted the privilege to use the present and future streets, alleys and public thoroughfares of the City of Fort Worth, Texas, m its business of providing public shuttle service within the City's municipal limits wrath one hundred (100) shuttles for the period beginning January 23 2004 and expnring January 22, 2009• and WHEREAS, on Apn•i126, 2005 Ordnnance No 15819 was amended to decrease from one hundred (100) to twenty (20) the number of shuttles which SuperShuttle DFW Corporation ns authorized to operate ui the City of Fort Worth, WHEREAS, SuperShuttle DFW Corporation has requested that the City amend its grant of privilege to allow SuperShuttle DFW Corporation to increase the number of shuttles upon the City streets; and WHEREAS, the Crty Council finds that the public necessity and convenience requrre the increase of shuttles, and WHEREAS, the City Council desrres to further amend City Ordrnance No 15819 to increase from twenty (20) to one hundred (100) the number of shuttles which SuperShuttle DFW Corporation is authorized to operate in the Crty of Fort Worth; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS 1 _.s ...~ SECTION 1. That Ordinance No 15819 of the City of Fort Worth, Texas, ~ hereby further amended by increasing from twenty (20) to one hundred (100) the number of shuttles which SuperShuttle DFW Corporation is authorized to operate upon the public streets, alleys and thoroughfares of the City of Fort Worth. SECTION 2. That the findings and recitations contained in the preamble hereof are expressly incorporated into and made a part of this ordinance as the findings of the City Council. SECTION 3. That after adoption of this ordinance, SuperShuttle DFW Corporation shall file with the City Secretary written acceptance of the terms and provisions hereof. Such acceptance of and agreement to the provisions of this ordinance shall be evidenced by the signature of the authorized representative of SuperShuttle DFW Corporation on the final page of tlis ordinance. SECTION 4. That the provisions of this ordinance shall be and are hereby declared to be cumulative of all provisions of the Code of the City of Fort Worth, Texas (1986), as amended, with respect to the regulation and operation of public shuttle service within the Crty's mumcipal limits, and, in the event of conflict between the provisions of this ordinance and such Code, the provisions of the City Code shall govern and prevail. SECTION 6. SunerShuttle DFW Corporation City of Fort Worth, Texas Mayor and Council Communication COUNCIL ACTION Approved on 7/19/2005 Ordinance No 16509-07 2005 DATE Tuesday July 19 2005 LOG NAME 38SUPERSHUTTLE REFERENCE NO *G-14859 SUBJECT Consideration of Request for Increase in the Number of Shuttles Supershuttle DFW Corporation is Authorized to Operate on City Public Streets and Thoroughfares of the City of Fort Worth RECOMMENDATION It is recommended, that the City Council approve amendment of City Ordinance No 16395 to increase the number of shuttles that Supershuttle DFW is authorized to operate on public streets alleys and thoroughfares in the City of Fort Worth from 20 to 100 shuttles. DISCUSSION On January 12, 2004 (M&C G-14219) the City Council approved City Ordinance No 15819 authorizing Supershuttle DFW to operate 100 shuttles on public streets alleys and thoroughfares in the City of Fort Worth On April 26 2005 (M&C G-14763) the City Council authorized City Ordinance No 15819 reducing the number of shuttles Supershuttle. DFW is authorized to operate upon City streets and thoroughfares from 100 to 20 shuttles On May 5 2005 a request was received from Mr Stephen Janicek, General Manager of Supershuttle DFW to increase the number of shuttles the Company is authorized to operate from 20 to 100 The request was made in response to action taken on April 8 2005 by the Dallas/Fort Worth international Airport, which authorized a concessionaire contract that requires all shared-ride service providers to service ten counties instead of six counties. The number of shuttles that are currently authorized in the City of Fort Worth is not sufficient to operate within those surrounding counties.
