HomeMy WebLinkAboutOrdinance 16710-11-2005Ordinance No ~7 ~ ~ _~ ~'~~ AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER CAPITAL PROJECT FUND IN THE AMOUNT OF $2,522 AND THE SEWER CAPITAL PROJECT FUND IN THE AMOUNT OF $21,222 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING AMENDMENT NO 6 TO CITY SECRETARY CONTRACT NO 28790 WITH LOCKWOOD ANDREWS & NEWNAM INC FOR ADDITIONAL DESIGN SERVICES, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2005-2006 in the Budget of the City Manager there shall also be increased estimated receipts and appropriations in the Water Capital Project Fund in the amount of $2,522 and the Sewer Capital Project Fund in the amount of $21,222 from available funds for the purpose of funding Amendment No 6 to City Secretary Contract No 28790 with Lockwood, Andrews & Newnam, Inc. for additional design services. SECTION 2 That should any portion, section or part of a section of this ordinance be declared invalid inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No 16582 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water Capital Project 1=und in the amount of $2,522:00 and the Sewer Capital Project Fund in the amount of $21 222 00 from the available funds and 3 Authorize the City Manager to execute Amendment No 6 to City Secretary Contract No 28790 with Lockwood Andrews &Newnam Inc. in the amount of $23 744 00 for additional design services thereby increasing the contract amount to $434 460 00 Subsequent amendments, if necessary will be processed administratively up to a $25 000 total DISCUSSION On May 13 2003 (M&C C-19575) the City Council authorized an engineering agreement with Lockwood Andrews &Newnam Inc in the amount of $260 706 00 for the design of sanitary sewer rehabilitation contract LXVII (67) The agreement was subsequently revised by five previous amendments totaling $150 010 00 as follows Amendment No 1 (City Secretary No 30208) in the amount of $22,350 00 and administratively approved by the City Manager on July 15 2004 provided for the design of additional sanitary sewer mains as requested by the Water Department; Amendment No 2 (City Secretary No 30442) in the amount of $20 410 00 and administratively approved by the City Manager on September 20 2004 provided for the rerouting of a segment of sewer main M-132 currently located on private property into public right-of-way' Amendment No 3 (City Secretary No 30538) in the amount of $14 900 00 and administratively approved by the City Manager on September 20 2004 allowed for the preparation of an alignment study that provided several alternate routes for a sewer main to convey wastewater from the Logname• 30LOCKWOOD 6 Page 1 of 2 redevelopment of the Montgomery Ward property and surrounding areas, Amendment No 4 (M&C C-20452 December 12 2004) in the amount of $80 710 00 provided for survey and design of the selected route from the alignment study conducted in Amendment No 3 and the rerouting of a segment of a sewer main in conflict with the proposed Trinity River Vision Improvements and Amendment No 5 (City Secretary No 31606) in .the amount of $11 640 00 and administratively approved by the City Manager on April 6 2005 provided for the necessary design and survey services to replace two severely deteriorated water mains that were encountered during construction of Part 1 of the project. Amendment No 6 will address the following This project includes the design of a 21-inch sanitary sewer main to replace the severely deteriorated sanitary sewer main M-132 located on White Settlement Road and Wimberly Street. During the reconstruction of Wimberly Street (from Wingate Street to Merrimac Street) a 1998 CIP project, a new segment of M-132 was installed and left inactive in order to avoid cutting the new concrete pavement at a future date to replace two severely deteriorated sanitary sewer mains that are also located on the street. The identified segment of M-132 could not be put into service until the design and construction of the replacement lines for four other severely deteriorated segments of M-132, located downstream of Wimberly Street and White Settlement Road are complete Additional engineering is necessary for the design of the four segments of M-132, rerouting all connecting service lines from the sewer mains to be abandoned to the proposed new mains and connecting the new sewer segments to the currently inactive main on Wimberly Street. After design is completed the proposed improvements will be advertised for bid as Part 3 of this project. Parts 1 and 2 are currently under construction Lockwood Andrews & Newnam Inc. proposes to perform the additional services for a lump sum fee of $23 744 00 City staff considers this fee to be fair and reasonable for the scope of services proposed This project is located in COUNCIL DISTRICT 9 Mapsco 62X and Y FISCAL INFORMATION/CERTIFICATION The Finance Director certifies that upon approval and completion of recommendation 1 and the adoption of the attached appropriation ordinance funds will be available in the current capital budget, as appropriated of the Water and Sewer Capital Projects Funds.
