JV AN ORDINANCE PROVIDING THAT HORNE STREET LYING WEST OF AND ADJACENT TO LOTS 23 AND 18, BLOCK 52, CHAMBERLIN ARLINGTON HEIGHTS, FIRST FILING, AN ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, BE ABANDONED, VACATED AND CLOSED, AND FURTHER PROVIDING FOR THE DEDICATION OF OTHER PROPERTY FOR STREET PURPOSES AND AS A PORTION OF HORNE STREET FOR THE PURPOSE OF WIDENING, STRAIGHT- ENING AND IMPROVING SAID ST REET X AND EXCEPTING THE RIGHTS OF ALL PUBLIC UTILITIES HERETOFORE AC- QUIRED IN SAID STREET, AND PROVIDING FOR THE RE- VERSION OF THE FEE TO SAID LAND. YMEREAS, it appearing to the City Council of the City of Fort Worth that Horne Street running north and south between Block 4 of Westover Addition and adjacent to Lots 23 and 18 in Block 52 Chamberlin Arlington Heights, First Filing, and inter- secting with Byers Avenue and Merrymount Road, is so laid out and dedicated that traffic proceeding north on Horne Street, upon reach- ing its intersection with Collinwood Avenue must detour to the east approximately sixty (60) feet in order to reach Byers Avenue and Merrymount Road, and that the dedication of Horne Street in Block 52 of Chamberlin Arlington Heights, First Filing, as it now exists, results in a jog that is not only unsafe for traffic pur- poses, but will prevent the orderly development of said property; and, WHEREAS, it is to the best interest of the public that said street be closed, abandoned and vacated as a public thorough- fare as it now exists and that the fee to the land in said street revert as provided by law; and, WHEREAS, it appears that the Fort Worth Extension Company, a corporation, has heretofore executed a deed to the City of Fort Worth to a sufficient amount of property immediately west of Horne Street in Block 52,Chamberlin Arlington Heights, First Filing, to straighten and extend said street in such a manner as to eliminate the hazards created by said street as it now exists, said property being more particularly hereinafter described, NOW, THEREFORE, f BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION I. That that portion of Horne Street lying west of and ad- 3acent to Lots 23 and 18, Block 52, Chamberlin Arlington Heights, First Filing, which runs north and south, be and the same is hereby vacated, closed and permanently abandoned as a street and public thoroughfare of any kind or character whatever. SECTION II. That the following described property, as shown in the deed this day executed by the Fort Worth Extension Company to the City of Fort Worth, is hereby dedicated for street purposes and shall hereafter be known and dedicated as Horne Street: A triangular parcel of land off a tract of land at the in- tersection of Byers Avenue and Merrymount Road west of Horne Street in Westover Hills Addition to the City of Fort Worth, Tarrant County, Texas, more fully described as follows: Beginning at a point in the northwesterly line of Merry- mount Road, said point being 160 feet west of and 30 feet north of the northwest corner of Lot 18, Block 52, Chamberlin Arling- ton Heights, First Filing; thence north 370 321 west a dis- tance of 200 feet to a point in the Southwesterly line of Byers Avenue, said point being 100 feet 36 301 west from the most southerly southwest corner of Lot 18, Block B. Westover Hills Addition; thence in a southeasterly direction following the line of the above described tract to its most easterly corner; thence in a southwesterly direction along the southeasterly line of said tract and along the northwesterly line of Merry- mount Road to the place of beginning. A parcel of land out of Lot 1, Block 4, 'Westover Hills Addi- tion to the City of Fort Worth, Tarrant County, Texas, more fully described as follows: Beginning at a point 110 feet west of the southwest corner of Lot 23, Block 52, Chamberlin Arlington Heights, First Filing, said point being in the east line of Lot 2, and the south line of Lot 1, Block 4, Westover Hills Addi- tion; thence north 90 031 west a distance of 192.3 feet to a port in the northerly line of said Lot 1, Block 4, West- over Hills Addition; thence in a northeasterly direction fol- lowing the northwesterly line of said lot to its northeast corner, said point being 50 feet west of the northwest cor- ner of Lot 18, Block 52, Chamberlin Arlington Heights, First Filing; thence south along the east line of said Lot 1, a distance of 266 feet to a point in the south line of Block 52, Chamberlin Arlington Heights, First Filing, produced; thence west along the south line of said Lot 1 a distance of 60 feet to the place of beginning. t4 SECTION III. That the rights of all public utilities heretofore ae- quired by said utilities for the purposes of constructing and main- taining service lines shall not be disturbed, destroyed, revoked or abrogated by any of the provisions of this ordinance; that said rights as above set out shall remain in full force and effect. SECTION IV. That the fee to the land in said strsgt is hereby released and will revert to the owners as provided by law. SECTION V. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION VI.
