ORDINANCE APPROVING AND ADOPTING ESTIMATES OF THE COST
OF IMPROVEMENTS AND OF AMOUNTS TO BE ASSESSED FOR
IMPROVEMENTS ON PORTIONS OF WILLIE STREET, DUNBAR STREET,
CHAPMAN AVENUE, AND CALLAHAN STREET IN THE CITY OF FORT
WORTH, TEXAS., FIXING TIME AND PLACE FOR HEARING TO THE
OWNERS OF ABUTTING PROPERTY AND TO ALL OTHERS INTERESTED,
AND DIRECTING THE CITY SECRETARY TO GIVE NOTICE.
WHEREAS, the City Council of the City of Fort Worth, Texas, has
heretofore ordered that each of the hereinafter described portions of street
and avenues in the City of Fort Worth, Texas, be improved by raising, grading
and filling same and by constructing thereon a 72 inch Flexible Base Course
of crushed limestone with a 1i inch Hot Mix Asphaltic Concrete Surface, and
by further constructing thereon combined concrete curbs and gutters on proper
grade and line where same are not already so constructed, together with storm
sewers and drains and other necessary incidentals and appurtenances; all of
said improvements to be constructed as and where shown on the Plans and in
strict accordance with the Plans and Specifications therefor; and contract
therefor has been made and entered into with General Construction Company; 'and,
WHEREAS, the City Council of the City of Fort Worth, Texas, has
caused the Public Works Director to prepare and file estimates of the cost of
such improvements and estimates of the amounts per front foot proposed to be
assessed against abutting property and the owners thereof, and such estimates
have been examined, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF FORT WORTH, TEXAS, THAT:
SECTION I.
Such estimates be, and they are hereby, adopted and approved.
SECTION II.
It is hereby found and determined that the cost of improvements on
each portion and avenue hereinafter described, with the amount or amounts per
front foot proposed to be assessed for such improvements against the abutting
property and the owners thereof, are as follows, to wit:
On WILLIE STREET: from the easterly line of Amanda Street to the
westerly line of Vincennes Street, known and designated as Unit No. 1: the
estimated cost of the improvements is $15,553.00; the estimated amount per
front foot to be assessed against abutting property and the owners thereof
for curb and gutter is $2.15; the estimated amount per front foot to be
assessed against abutting property and the owners thereof for improvements
exclusive of curb and gutter is $5.21; total estimated amount per fronttfoot
to be assessed against abutting property and the owners thereof is $7.36.
On DUNBAR STREET: from the easterly line of Amanda Street to the
westerly line of Vincennes Street, known and designated as Unit No. 2; the
estimated cost of the improvements is $15,467.00; the estimated amount per
front foot to be assessed against abutting property and the owners thereof
for curb and gutter is $2.15; the estimated amount per front foot to be
assessed against abutting property and the owners thereof for improvements
exclusive of curb and gutter is $4.41; total estimated amount per front foot
to be assessed against abutting property and the owners thereof is $6.56.

On CHAPMAN AVENUE: from the easterly line of Amanda Street to the
westerly line of Walter Willi Addition, known and designated as Unit No. 3;
the estimated cost of the improvements is $33,001.00; the estimated amount
per front foot to be assessed against abutting property and the owners thereof
for curb and gutter is $2.15; the estimated amount per front foot to be assessed
against abutting property and the owners thereof for improvements exclusive of
curb and gutter is $5.20; total estimated amount per front foot to be assessed
against abutting property and the owners thereof is $7.35.
On CALLAHAN STREET: from the easterly line of Amanda Street to the
westerly line of Lena Street, known and designated as Unit No. 4; the estimated
cost of the improvements is $9,251.50; the estimated amount per front foot to
be assessed against abutting property and the owners thereof for curb and
gutter is $2.15; the estimated amount per front foot to be assessed against
abutting property and the owners thereof for improvements exclusive of curb
and gutter is $3.35; total estimated amount per front foot to be assessed
against abutting property and the owners thereof is $5.50.
SECTION III.
A hearing be given and held by and before the City Council of the
City of Fort Worth, Texas, to all owning or claiming any property abutting upon
said portions of streets and avenues, as well as to all owning or claiming any
interest in any such property. Such hearing shall be given and held on the
,L2t/i day of _ v N eA.D., 1959, at
o'clock, A. M., in the Council Chamber in the City Hall in the City of
Fort Worth, Texas, and the Acting City Secretary is hereby directed to give notice
of the time and place of such hearing and of other matters and facts in accordance
with the terms and provisions of an Act passed at the First Called Session of the
Fortieth Legislature of the State of Texas, and known as Chapter 106 of the Acts
of said Session, now being shown as Articles 1105b of Vernon's Texas Civil Statutes.
Such notice shall be by advertisement inserted at least three times in a newspaper
published in the City of Fort Worth, Texas, the first publication to be made at
least ten days before the date of said hearing. Said notice shall comply with and
be in accordance with the terms and provisions of said Act. Notice of hearing shall
be sufficient, valid and binding upon all owning or claiming such abutting property
or any interest therein when same shall have been given by newspaper advertisement
as first hereinabove provided.

Gentlemen:
In accordance with the proceedings of your Honorable Body, I have
prepared estimates of the cost of street improvements as shown below:
Estimate of the total cost of improvements on portions of Willie
Street, Dunbar Street, Chapman Avenue and Callahan Street in the City of
Fort Worth, Texas, and estimated amounts per front foot to be assessed
against abutting property and the owners thereof on said portions of street
and avenues are as follows, to wit:
On WILLIE STREET: from the easterly line of Amanda Street to the
westerly line of Vincennes Street, known and designated as Unit No. 1: the
estimated cost of the improvements is x$1.5,553.00; the estimated amount per
front foot to be assessed against abutting property and the owners thereof
for curb and gutter is $2.15; the estimated amount per front foot to be
assessed against abutting property and the owners thereof for improvements
exclusive of curb and gutter is $5.21; total estimated amount per front foot
to be assessed against abutting property and the owners thereof is $7.36.
On DUNBAR STREET: from the easterly line of Amanda Street to the
westerly line of Vincennes Street, known and designated as Unit No. 2; the
estimated cost of the improvements is $1.5,467,00; the estimated amount per
front foot to be assessed against abutting property and the owners thereof
for curb and gutter is $2.15; the estimated amount per front foot to be
assessed against abutting property and the owners thereof for improvements
exclusive of curb and gutter is x$4.41; total estimated amount per front foot
to be assessed against abutting property and the owners thereof is $6.56.
On CHAPMAN AVENUE: from the easterly line of Amanda Street to the
westerly line of Walter Willi Addition, known and designated as Unit No. 3;
the estimated cost of the improvements is $33,001.00; the estimated amount
per front foot to be assessed against abutting property and the owners thereof
for curb and gutter is $2.15; the estimated amount per front foot to be
assessed against abutting property and the owners thereof for improvements
exclusive of curb and gutter is $5.20; total estimated amount per front foot
to be assessed against abutting property and the owners thereof is $7.35•

TO ALL OWNING OR CLAIMING ANY PROPERTY ABUTTING
UPON THE HEREINAFTER DESCRIBED PORTIONS OF WILLIE
STREET, DUNBAR STREET, CHAPMAN AVENUE, AND CALLAHAN
STREET IN THE CITY OF FORT WORTH, TEXAS, AND TO ALL
OWNING OR CLAIMING ANY INTEREST IN ANY SUCH PROPERTY:
The City Council of the City of Fort Worth, Texas, has heretofore
ordered that each of the hereinafter described portions of street and avenues
in the City of Fort Worth, Texas, be improved by raising, grading and filling
same and by constructing thereon a 71 inch Flexible Base Course of crushed
limestone with a 1i inch Hot Mix Asphaltic Concrete Surface, and by further
constructing thereon combined concrete curbs and gutters on proper grade and
line where same are not already so constructed, together with storm sewers
and drains and other necessary incidentals and appurtenances; all of which
said improvements are to be constructed as and where shown on the Plans and
in strict accordance with the Plans and Specifications therefor; and contract
has been made and entered into with General Construction Company for the
making and construction of such improvements. Estimates of the cost of such
improvements for each said portion of street and avenue have been prepared.
The portions of said street and avenues so to be improved, together
with the estimated cost of the improvements for each such portion of street
and avenue, and the amount per front foot proposed to be assessed against the
abutting property and the owners thereof on each such portion of street and
avenue are as follows, to wit:
On WIUIS STREET: from the easterly line of Amanda Street to the
westerly line of Vincennes Street, known and designated as Unit No. 1: the
estimated cost of the improvements is $15,553.00; the estimated amount per
front foot to be assessed against abutting property and the owners thereof
for curb and gutter is $2.15; the estimated amount per front foot to be
assessed against abutting property and the owners thereof for ilnprovelnents
exclusive of curb and gutter is $5.21; total estimated amount per front foot
to be assessed against abutting property and the owners thereof is $7.36.
On DUNBAR STREET: from the easterly line of Amanda Street to the
westerly line of Vincennes Street, known and designated as Unit No. 2; the
estimated cost of the improvements is $15,467,00; the estimated amount per
front foot to be assessed against abutting property and the owners thereof
for curb and gutter is $2.15; the estimated amount per front foot to be
assessed against abutting property and the owners thereof for improvements
exclusive of curb and gutter is ,$4.41; total estimated amount per front foot
to be assessed against abutting property and the owners thereof is $6.56.
On CHAPMAN AVENUE: from the easterly line of Amanda Street to the
westerly line of Walter Willi Addition, known and designated as Unit No. 3;
the estimated cost of the improvements is $33,0011.00; the estimated amount
per front foot to be assessed against abutting property and the owners thereof
for curb and gutter is $2.15; the estimated amount per front foot to be
assessed against abutting property and the owners thereof for lgprove.lents
exclusive of curb and gutter is $5.20; total estimated amount per front foot
to be assessed against abutting property and the owners thereof is $7.35.
On CALLAHAN STREET: from the easterly line of Amanda Street to the
westerly line of Lana Street, known and designated as Unit No. 4; the estimated
cost of the improvements is $9,251.50; the estimated amount per front foot to
be assessed against abutting property and the owners thereof for curb and
gutter is $2.15; the estimated amount per front foot to be assessed against
abutting property and the owners thereof for improvements exclusive of curb
and gutter is $3.35; total estimated amount per front foot to be assessed
against abutting property and the owners thereof is $5.50.

A hearing will be given and held by and before the City Council
of the City of Fort Worth, Texas, on the _ N52t'�- day of
-XI//V , 1959, at /0.1.00 o'clock, —„ 0•—.K.,
in the Council Chamber in the City Hall in the City of Fort Worth, Texas, to
all owning or claiming any property abutting upon said portions of street and
avenues, and to all owning or claiming any interest in any such property. At
said time and place, all owning or claiming any such abutting property or any
interest therein shall be and appear and will be fully heard concerning said
improvements, the cost thereof, the amounts to be assessed therefor, the benefits
to the respective parcels of abutting property by means of the improvements on
the portions of street and avenues upon which the property abuts and concerning
the regularity, validity and sufficiency of the contract for, and all proceedings
relating to such improvements and proposed assessments therefor, and concerning
any matter as to which they are entitled to hearing under the law in force in the
City of Fort Worth, Texas, and under which these proceedings are taken and had
and under the proceedings of the City with reference to said matters. Following
such hearing, assessments will be levied against abutting properties and the
owners thereof and such assessments, when levied, shall be a personal liability
of the owners of such property and a first and prior lien upon the property as
provided by the law under which these proceedings are taken and had, being the
Act passed at the First Called Session of the Fortieth Legislature of the State
of Texas, known as Chapter 106 of the Acts of said Session, now shown as Article
1105b of Vernons Texas Civil Statutes, which Act has been adopted as an amendment
to and made a part of the Charter of the City of Fort Worth, Texas.
The improvements on each said portion of street and avenue constitute
an entirely separate and distinct unit of improvement, all to the same extent as
if entirely separate and distinct proceedings had been taken with reference to
the improvements and assessments therefor in connection with improvements on each
such portion of street and avenue, and the assessments against the property
abutting upon any one unit shall be and are in nowise affected by any fact or
circumstance relating to or connected with the improvements in any of the other
units.
Of all said matters and things, all owning or claiming any such
property or any interest therein, as well as all others in anywise interested
or affected, will take notice.
