OFFICIAL :RECORDORDINANCE N0. D3 CITY SERRYAPT ORDINANCE PERMITTING MRS. MEDORA M. WALKER, A FENIE SOLE, FT. `10 TEX. HER HEIRS AND ASSIGNS, TO LEAVE TSE EXISTING BUILDING FOR A MAXIMUM DISTANCE OF 2.5 FEEL' AS IT IS NOW LOCATED IN WEST BROADWAY AVENUE ALONG THE NORTH LINE OF LOT 1, BLOCK 32, JENNINGS SOUTH ADDITION TO THE CITY OF FORT WORTH, TARRAIVT COUNTY, TEXAS; AND PROVIDING THAT THIS ORDINANCE SHALL BE- COME EFFECTIVE I*MDIATELY. WHEREAS, Mrs. Medora M. Walker, a feme sole, is the owner of Lot 1, Block 32, Jennings South Addition to the City of Fort Worth, Tarrant County, Texas, along the north line of which a property encroachment exists in West Broadway Avenue; NOW, THFREPFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Mrs. Medora M. Walker, a feme sole, the owner of said land above described and the improvements situated thereon, and her heirs and assigns, be permitted to leave the existing building for a maximum distance of 2.5 feet as said building now exists in West Broadway Avenue along the north line of said Lot 1; and that said improvements on said above described real property be allowed to stand during the life of said building as the same is now constructed, provided, however, that in the event such building be demolished or major alterations and repairs be made to said building in the future, said building shall be reconstructed or repaired so as not to en- croach upon West Broadway Avenue and so as to be in compliance with the then existing ordinances, rules and regulations of the City of Fort Worth, Texas. It is not the intention of the City Council to adversely affect or diminish the rights of the public in and to the property encroached upon by the ex- isting building in the event the City Council may determine to widen West Broadway Avenue. SECTION 2. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. Cookingham Re: Encroachment on West Broadway Avenue, City Manager Lot 1, Block 32, Jennings South Addition Building Dear Sir: The City of Fort Worth has received a survey indicating that the existing brick apartment building at the southwest corner of West Broadway Avenue and South Adams Street has an encroachment of 2j feet on Broadway. The owner has requested the City grant this encroachment for the remaining life of the building. The Public Works Department has investigated this request and kWe found that the existing encroachment does not conflict with the present improvements on Broadway Avenue and that there are no current plans for future widening of Broadway Avenue at this location. It is recommended that the necessary ordinance be adopted granting a 2.5 foot encroachment of the existing two-story brick apartment building located on Lot 1, Block 32, Jennings South Addition, in the City of Fort Worth for the remaining life of the building, with the provision that it is not the intention of the City Council to adversely affect or diminish the rights of the public in and to the property encroach- ed upon by the existing building in the event the City Council may determine to widen West Broadway Avenue in the future.
