HomeMy WebLinkAboutOrdinance 5903 ORDINANCE N0, J 7a AN ORDINANCE PROVIDING THAT THE NORTH-SOUTH ALLEY IN BLOCK 107, ORIGINAL TOWN ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, BE ABANDONED, VACATEII AND CLOSED; PROVIDING FOR THE REVERSION OF THE INTEREST OF THE CITY OF FORT WORTS IN SAID LANDf REPEALING ALL ORDINANCES IN CONFLICT HZRE•- WITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXASs SECTION 1. That the North-South alley in Block 107, Original Town Addition to the City of Fort Worth. Tarrant County, Texas, be and the same is hereby vacated, closed and permanently aban- doned as an alley or public thoroughfare of any kind or char- acter whatever. SECTION 2. That the interest of the City of Fort Worth in the fee to the land in said portion of the alley is hereby released and shall revert to the adjacent owner of the fee as provided by law, save and except that an easement is reserved for exist- ing utilities. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage. This alley is open on the ground. Abandonment of the alley will allow replatting the alley with the adjoining property to permit additional development. The City Departments and private utility companies which have reviewed the request have voiced no objection to the proposed vacation, however, the Water Department has requested that the alley be retained as an easement for existing utility installations. The City Plan Commission has reviewed the subject request and recommends adoption of an ordinance vacating the alley as requested, subject to retaining the alley as an easement for existing utilities and replatting the alley with the adjoining properties. The applicant has submitted a replat of the alley and the adjoining properties as requested. City Council action on the Plan Commis.sion's recommendation is requested.
