AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN
THE WATER CAPITAL PROJECT FUND IN THE AMOUNT OF $26 018 AND THE
SEWER CAPITAL PROJECT FUND IN THE AMOUNT OF $17 432 60 FROM AVAILABLE
FUNDS FOR THE PURPOSE OF FUNDING AN ENGINEERING AGREEMENT WITH
FREESE AND NICHOLS INC FOR PAVEMENT RECONSTRUCTION AND WATER AND
SANITARY SEWER MAIN REPLACMENT ON NORMANDY ROAD (EDERVILLE ROAD
TO NORTH EDGEWOOD TERRACE AND NORTH EDGEWOOD TERRACE TO QUEEN
STREET); MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS
SECTION 1
That in addition to those amounts allocated to the various City departments for Fiscal Year 2004-2005 in the
Budget of the City Manager there shall also be increased estimated receipts and appropriations in the
Water Capital Project Fund in the amount of $26;018 and the Sewer Capital Project Fund in the amount of
$17 432..60 from available funds for the purpose of funding an Engineering Agreement with Freese and
Nichols, Inc. for pavement reconstruction and water and sanitary sewer main replacement on Normandy
Road (Ederville Road to North Edgewood Terrace and North Terrace to Queen Street)
SECTION 2
That should any portion section or part of a section of this ordinance be declared invalid inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance which said remaining
provisions shall be and remain in full force and effect.
SECTION 3
That this ordinance shall be cumulative of Ordinance No 16061 and all other ordinances and appropriations
amending the same except in those instances where the provisions of this ordinance are in direct conflict
with such other ordinances and appropriations, in which instance said conflicting provisions of said prior
ordinances and appropriations are hereby expressly repealed.
SECTION 4
This ordinance shall take effect upon adoption

Project Fund in the amount of $26 018 00 and Sewer Capita! Project Fund in the amount of $17 432 60-
2. Adopt the appropriation ordinance increasing estimated receipts and appropriation in the Water Capital
Project Fund in the amount of $26 018 00 and the Sewer Capital Project Fund in the amount of $17 432 60
from available funds and
3 Authorize the City Manager to execute an Engineering Agreement with Freese and Nichols Inc. in the
amount of $106 330 00 for pavement reconstruction and water and sanitary sewer main replacement on
Normandy Road (Ederville Road to North Edgewood Terrace and North Edgewood Terrace to Queen
Street)
DISCUSSION
The 2004 Capital Improvement Program (CIP) includes funds for pavement reconstruction and the Water
and Sewer Operating Fund includes funds for water and sanitary sewer replacement on Normandy Road
(Ederville Road to North Edgewood Terrace and North Edgewood Terrace to Queen Street)
This project consists of the preparation of plans and specifications for pavement reconstruction and water
and sanitary sewer main replacement on the above identified streets.
Freese and Nichols, Inc. proposes to perform the necessary design work for a lump sum fee of $106 330
City staff considers this fee to be fair and reasonable for the scope of services proposed
In addition to the contract amount, $18 587 89 (water $4 158 00' sewer $2 678 60' and streets
$11 751.29) is required for project management by the Engineering Department.
Freese and Nichols, Inc. is in compliance with the City's MMBE Ordinance by committing to 27% MMBE
participation The City's goal on the project is 19%

The Finance Director certifies that upon approval and completion of recommendation 1 and the adoption of
the appropriation ordinance funds will be available in the current capital budget, as appropriated of the
Water Capital Projects Fund the Sewer Capital Projects Fun and the Street Improvement Fund
