AN ORDINANCE APPROVING AND ADOPTING ESTIMATES OF THE COST OF IMPROVE-
MENTS AND OF AMOUNTS TO BE ASSESSED FOR IMPROVEMENTS ON A PORTION OF

AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE
CITY OF FORT WORTH, TEXAS; FIXING TIME AND PLACE FOR HEARING TO THE
OWNERS OF ABUTTING PROPERTY AND TO ALL OTHERS INTERESTED; DIRECTING
THE CITY SECRETARY TO GIVE NOTICE OF SUCH HEARING; AND DIRECTING TIIE
CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE
CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL AND BY FILLING
THE COMPLETE ORDINANCE IN THE APPROPRIATE ORDINANCE RECORDS OF THE
C Y; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Fort Worth, Texas,has heretofore ordered that each of the
hereinafter described portions of streets, avenues and public places in the City of Fort Worth, Texas, be im-
proved by raising, grading and filling same and by constructing thereon the following, to-wit:
1. Si=ZLIIVis DRIVE: Froa a line 132.7 feet south of South Brook Drive to
the south line of Jacksuoro rTiEhway, knor.n and designated
as Unit 1, Project 11o. 104-22000-103, a o—inch hot=iiix
asphaltic concrete pavement on a 40 foot
together with combined concrete curbs and gutters on proper grade and line whiere same are not already so
constructed, together with storm sewerg and drains and other necessary incidentals and appurtenances; all of
said improvements to be coilstructed as and where abown on then Plans and in strict accordance Mrith.the:Plans

WHEREAS, the City Council a°d the City of Fort VVorth, Texas, has caused the Public Works Director
to prepare and file eatiniates of the cost of such improvements and estimates of the amounts per front :foot

ing or Chdaling any property abutting upon said portions of streets, avenues and public places,as well as to all
owning or claftning any interest in any such property,Such hearing shall be given and held on the '10. .-day of
jul,y 19 67 at 9139 4- in the C ouncil Churnber in the City Hall in tb e City of Fort
Worth, 7'exas, and the City Secretary is hereby directed to give notice of the tirne and place of' such. hearing
and of other matters and facts in accardance with tire terms and provisions of an Act passed at the First Called
Session of the Fortieth Legislature of the State of Texas, and known as Cliapter 106 of the Acts of said Ses-
sion,now benig shown as Article 11.05b of Vernon's Texas Civil Statutes.Such notice shall be by advertisement
at least throe times in a newspa,per published in the Cit1v of Fort Worth,Texas, the first;publiNktion to be made
at least ten days before the date of said heating,Said notice shall comply with and be in accordance with the
terms and provisions of said Act.. The City Secretary is further directed 'to give personal notice of the time
and place of such hearing to all owning or clahning any, property abutting,on said portions of streets,avenues
and public places, as well as to all owning or didmhq any interest, in any iiije-h propefty, Such personal notice
shall be given by the City Secretary mailing said notice postage, prepaid, to the respective owners of record of
the properties to be amessed, and to any, person owning or elairning any interest in said properties,to-the last
known address of said owner or persons. It shall not be necessary for the City,Secmtary to mail said notices to
any owner or other person claiming an interest in.the propefty to be assessed when the addess of such owner
or other person claiming an interest in the property to be assessed is unknown to the City Secretary and cannot
be determined by'the City Secretary after reasonable inve!sUgation, In this, connection the City Secretary shall
prepare and file with these proceedings a list of the properties to be assessed, the narnes of those twrsons own-
ing or claiming any, intend in said properties to whoin the notice °was mailed, together with the last known
address 6f the rcspoAive owners and those persons owning or dafining any interest in said fro, rt;y.
The City, Secretary shall certify that each of the parties narned in said list.whose address was known to
him,was mailed a copy of the notice of hearing and shall further certify the date or dates on which said notice
was mailed. A copy of the notice shall be at(ached to such certificate, The certificate of the City Secretary, will
be conclusive evidence of the facts there,in recited. Failure of the City Secretary to give notice of' hearing by
mail as herein provided for, or failure of the owners or other persons interested to receive said notice, shall in
nowise invalidate said bearing or any assessynents levied pursuant to said hearing, but notice of hearing shall
be sufficient, valid and buiding upon all oixminp,,or clafining,such abuttingr property or any in temst therein when
same shall have been given by newspaper advertisement as first hereinabove provided.
IV.
The City Secretary is hereby directed to engross and enroll this ordinance by copybig the caption of
same in the Minute Rook of the City Council and by,filing Um complete ordinance in the approlulate Ordinance
Records of this C 1ty.
V.

Council action, on the project described below is requested :
Nature of work: Skyline Drive from Sotithbrook :Drive to the Jacksboro Bighway
is now a rural-type road witli penetration asplialt surface! approximatelLy 24
feet in width and with drainage ditches on either-- side. A 40-foot roadway on
a 60-foot right-of-way is proposed, consisting of a 6-irlilch hot mix asphaltic
concrete pavement with 7-inch curbs axid 2 foot gutters, and necessary storm,
sewers and appurtenances. '1he widening and paving of Skyline Drive from
Southbrook to Jacksboro, Highway is scheduled in the 1967 Capital Improvement
Program (CIF A-13).
Two parcels of property abutting the west side of Skyline Drive and extending
11,065 feet southward from the Jacksboro Highway are within the corporate limits
of the City of Sansom Park. The assessments for these two parcels of land to-
tal $7,774.50® In accordance with State law and contingent: on the results of
the benefit hearing, the City of Fort Worth will forward an ordinance to the
City of Sansom Park requesting the ratification and approval of assessments
levied against the owners of these properties. The project has been described
and the assessments have been explained to the City Council of Sansom Park,
and the Council has consented by motion to the proposed improvements. The
owner of 905 feet of the land in Sansom Park fronting on Skyline Drive has also
agreed to the project and his proposed assessment. A parcel of land owned by
the City of Sansom Park but wit1iin the limits of the City of Fort Worth, located
at the southwest corner of Skyline Drive and Boicourt Street, is being assessed
$601.98 for 79 linear feet abutting Skyline Drive, and the City Council of San-
som Park consents to the assessment.

Based on the law bid, approximately $40,034.69 will be paid by abutting property
owners. The cost to the City-at-large will be approximately $57,788.15, in-
cluding engineering and miscellaneous expenses. The City's portion of construe-
tion and engineering costs is available in Bond Fund Accounts 097-22000-103 and
104-22000-103(CIP A-13).

Recommendation
It is recommended:
1) That the following bond fund transfer be approved:

e) Making appropriations to cover the indebtedness thereby incurred
for improvements to the project named above,
