AN ORDINANCE VACATING AND EXTINGUISHING AN ALLEY
SITUATED IN THE S.G. JENNINGS SURVEY, ABSTRACT NO. A-844,
CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, AS SHOWN IN
THE PLAT THEREOF RECORDED IN VOLUMENT 106, PAGE 6 OF
THE PLAT RECORDS OF TARRANT COUNTY, TEXAS, AND AS
AMENDED BY ORDINANCE 2826 AND CONTAINING
APPROXIMATELY 1,500 SQUARE FEET OF LAND MORE OR LESS;
PROVIDING FOR REVERSION OF FEE IN SAID LAND; PROVIDING
THAT THE CITY SHALL RETAIN ALL EXISTING UTILITIES
EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That an alley, situated the S.G. Jennings Survey, Abstract No. A-844, City of Fort Worth,
Tarrant County, Texas, as shown in the plat thereof recorded in Volume 106, Page 6 of the Plat
Records of Tarrant County, and as amended by City of Fort Worth Ordinance No. 2826 and
containing approximately 1,500 square feet more or less, and as more specifically described in
Exhibits "A" and "B" attached hereto and incorporated herein by reference be and the same is
vacated and extinguished.
SECTION 2.
That the easement to the land in the above-described vacated alley right of way is hereby
released and shall revert to the adjacent owner as provided by law.
SECTION 3.
All existing utility easement be shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.

SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

Being all of that remaining alley right-of-way located in the west half of Block 8,Jennings South Addition,
situated In the S.G.Jennings Survey,Abstract A-844,City of Fort Worth,Tarrant County,Texas,as shown
in the plat thereof recorded in Volume 106,Page 6,Plat Records of Tarrant County,Texas,and as
amended by City of Fort Worth Ordinance No.2826. Said alley right-of-way Is more particularly
described as follows:
Commencing at a found 5/8"iron rod for the northeast corner of Lot 8,Block 8,of the said Jennings
South Addition and the northwest corner of Lot 1R, Block 1,K.V.G.Addition as filed in Volume 388,Page
187,PRTCT,and on the south right-of-way line of Rio Grande Street,a variable width right-of-way;
Thence with the said south right-of-way and the north lot line of said Lot 8,North 88 degrees 24 minutes
45 seconds West a distance of 75,00 feet to the POINT OF BEGINNING,also being the northwest corner
of said Lot 8,and the northeast corner of the alley right-of way;
Thence leaving the said south right-of-way the following calls:
South 01 degree 35 minutes 15 seconds West,a distance of 100.00 feet;
North 88 degrees 24 minutes 45 seconds West,a distance of 15.00 feet;
North 01 degree 35 minutes 15 seconds East,a distance of 100.00 feet to the said south right-of-

SUBJECT:
Adopt Ordinance Vacating a Portion of an Alley in Block 8, Jennings South Addition, to be Replatted by
Ciera Bank with the Adjoining Property fora New Mixed Use Building on Summit venue (COUNCIL
DISTRICT 9)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached ordinance vacating a portion of an alley in Block 6, Jennings South Addition, to be
replatted by Ciera Bank with the adjoining property for a new ixe use building on Summit Avenue; an
2. Waive any and all purchase fee value of the vacated land in accordance with City policy.
DISCUSSION:
Boydston Designs Inc.„ on behalf of Ciera Bank, has requested the vacation of the remaining portion of
the alley in Block 8, Jennings South Addition, to be replatted with the adjoining property for a new mixed
use building. The City I Commission recommended approval of this request at its meeting on June 24,
2015. An acceptable final plat (FS-1 -109) has been received in accordance with the Subdivision
Ordinance.
The City of Fort Worth (City) originally obtained the above mentioned right-of-way through the platting
process. The City o not own any fee interest in the right-of-way or own any property adjacent o the
right-of-way and i not expend any City funds to purchase the right-of-way easement. In accordance
with the City's policy regarding street and alley vacation transactions approved by the City Council on
March 6, 2007 ( -15624), staff recommends waiving the fair market value or any portion thereof of
purchase price of the right-of-way easements for the streets and alley.
This project is located in COUNCIL DISTRICT 9, Mapsco 76H.
FISCAL INFORMATION /CERTIFICATION:
The Financial Management Services Director certifies that approval of these recommendations will have
no material effect on City funds.
