HomeMy WebLinkAboutOrdinance 16715-11-2005ORDINANCE NO. ~ (y 71 S' I ~~ 2~OS AN ORDINANCE AMENDING ORDINANCE NO. 16220 BY INCREASING THE NUMBER OF DIRECTORS ON THE BOARD OF DIRECTORS OF TAX INCREMENT REINVESTMENT ZONE NUMBER ELEVEN CITY OF FORT WORTH, TEXAS. WHEREAS, as authorized by Section 311 005(a)(2) of the Texas Tax Code, the City Council created Tax Increment Reinvestment Zone Number Eleven, City of Fort Worth, Texas (the Zone"), which is generally known as the Southwest Parkway TIF pursuant to Ordinance No. 16220, adopted by the City Council on December 7 2004 and WHEREAS, Ordinance No. 16220 established a board of directors for the Zone (the `Board") consisting of eleven (11) members; and WHEREAS, pursuant to Section 311 009(a) of the Texas Tax Code and in accordance with Ordinance No. 16220 each taxing amt v~nth jurisdiction in the Zone, other than the City may appoint one (1) member of the Board and the City Council will appoint whatever number of members are necessary to fill the remaining positions on the Board, and WHEREAS, Section 311 009(a) of the Texas Tax Code provides that the board of directors of a tax increment reinvestment zone designated pursuant to Section 311 005(a)(2) of the Texas Tax Code may consist of up to fifteen (15) members, and that the governing body of the municipality that designated the reinvestment zone may appoint up to ten (10) of those members (or more than ten (10) of those members if there are fewer than five (5) members appointed by other taxing amts), and WHEREAS, -the City Council wishes to amend Ordinance No. 16220 to increase the number of members on the Board from eleven (11) to thuteen (13); Page 1 of 3 Ordinance Increasing Size of Board of Directors of T Increment Reinvestment Zone Number Eleven (Southwest Parkway TIF) NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS. Section 1. That Section 3 of Ordinance No. 16220 (Zone Board of Directors) is hereby amended to read as follows. That a board of directors for the Zone ("Board") is hereby created. The Board shall consist of thirteen (13) members who shall serve for terms of two (2) years each, provided, however that the initial terms of some members maybe less than two (2) years to allow for subsequent staggered terms. Of these thirteen (13) members, each taxing unit, other than the City that levies taxes on real property in the Zone may but is not required to, appoint one (1) member to the Board. After each such taxing unit designates to the City either the name of the member that the taxing unit wishes to appoint or the fact that the taxing unit wishes to waive its right to appoint a member the City Council shall appoint whatever number of members are necessary to fill the remaining positions on the Board. Board members appointed by the City Council may be members of the City Council. Any Board member appointed by the City Council may be removed or replaced at any time by a vote of a majority of the members of the City Council that Is conducted m an open meeting m accordance with all applicable provisions of Chapter 551 of the Texas Government Code. Section 2. That all provisions of Ordinance No. 16220 that are not expressly amended herein shall remain in full force and effect. If any portion, section or part of a section of this Ordinance is subsequently declared invalid, inoperative or void for any reason by a court of competent jurisdiction, the remaining portions, sections or parts of sections of this Ordinance shall be and remain in full force and effect and shall not in any way be impaired or affected by such decision, opinion or judgment.
