AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS
IN THE WATER CAPITAL PROJECT FUND IN THE AMOUNT OF $39 440 FROM
AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING CHANGE ORDER NO 2 TO
CITY SECRETARY CONTRACT NO 31836 FOR 2004 CIP MINOR DRAINAGE
CONTRACT H MEADOWBROOK HILLS IMPROVEMENTS WITH MCCLENDON
CONSTRUCTION COMPANY INC MAKING THIS ORDINANCE CUMULATIVE OF
PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT
HEREWITH AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH TEXAS'
SECTION 1
That in addition to those amounts allocated to the various City departments for Fiscal Year 2004-2005 and
in the Budget of the City Manager there shall also be increased estimated receipts and appropriations in
the Water Capital Project Fund in the amount of $39 440 from available funds for the purpose of funding
Change Order No 2 to City Secretary Contract No 31836 for 2004 CIP Minor Drainage Contract H
Meadowbrook Hills Improvements with McClendon Construction Company Inc.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid inoperative or void
for any reason by a court of competent jurisdiction, such decision opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3
That this ordinance shall be cumulative of Ordinance No 16061 and all other ordinances and appropriations
amending the same except in those instances where the provisions of this ordinance are in direct conflict
with such other ordinances and appropriations, in which instance said conflicting provisions of said prior
ordinances and appropriations are hereby expressly repealed
SECTION 4
This ordinance shall take effect upon adoption

RECOMMENDATION
It is recommended that the City Council
1 Authorize the transfer of $39 440 00 from the Water and Sewer Operating Fund to the Water Capital
Project Fund
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Water Capital Project Fund in the amount of $39 440 00 from available funds; and
3 Authorize Change Order No 2 to City Secretary Contract No 31836 with McClendon Construction
Company Inc. in the amount of $36 350 00 revising the total cost to $372,966 45
DISCUSSION
On April 19 2005 (M&C C-20661) City Council authorized the award of contract to McClendon
Construction Company Inc. for the subject project.
The construction of storm drain facilities in Monterrey Drive from Oak Hill Road to Danciger Road was
included in 2004 CIP Minor Drainage Contract H Meadowbrook Hills Drainage Improvements along with
the work in two other streets in the neighborhood Prior to the start of the drainage project, the Water
Department replaced the sewer main in Monterrey Drive under a separate contract. The water main
existing at this location was not scheduled for replacement.
The contract includes the rehabilitation of the street pavement by base pulverization and surface overlay
with H M.A.C (hot mix asphalt concrete) following the installation of the underground utilities During the
construction of the pavement base it was discovered that the existing water service lines to the residences
are very shallow and will be damaged by the street work. Consequently the water services existing within
the street pavement limits need to be lowered to avoid possible damage. The Water Department has
agreed to fund this work in order to protect these facilities during the street construction
