HomeMy WebLinkAboutOrdinance 6574 ORDINANCE NO. 5 ` An Ordinance adopted by the City Council of the City of Fort Worth, Texas, pursuant to Article 46d-14, Revised Civil Statutes of Texas, approving Resolution No. 71-170 of the Dallas-Fort Worth Regional Airport Board which adopts the Airport Building Code, 1971 Edition [and thereby regulates the erection, construction, enlargement, alteration, repair, moving, removal, demolition, conversion, occupancy, equipment, use, height, area and maintenance of buildings and structures within the boundaries of the Dallas-Fort Worth Regional Airport; provides for the issuance of permits; provides minimum standards for plumbing and elec- trical installations within the Airport; and provides for a fine of not to exceed Two Hundred Dollars ($200.00) for any violation thereof]; and providing that said Resolution No. 71-170 of the Dallas-Fort Worth Regional Airport Board shall have the same force and effect within the boundaries of the Dallas-Fort Worth Regional Airport as an ordinance by the City Council of the City of Fort Worth would have in the City of Fort Worth; declaring an emergency and providing an effective date. WHEREAS, Section B.F. of the Contract and Agreement Between the City of Dallas , Texas , and the City of Fort Worth, Texas , provides that the Dallas-Fort Worth Regional Airport Board shall have the power, by a duly adopted order, to adopt and enforce rules and regulations for the orderly, safe, efficient and sanitary operation of the Airport, and to prescribe reasonable penalties for the breach of any rule or regulation not exceeding more than Two Hundred Dollars ($200 .00) fine; and WHEREAS, Article 46d-14, Revised Civil Statutes of Texas, and Section 8 .F. of the Contract and Agreement provide that such orders by said Airport Board shall become effective only upon approval of the 4 governing bodies of the Cities of Dallas and Fort Worth and publication as therein provided; and WHEREAS, pursuant to the foregoing, the Dallas-Fort Worth Regional Airport Board on October 5th , 1971, passed, approved and ordered Resolution No. 71-170 which adopts the Airport Building Code, 1971 Edition, and thereby regulates the erection, construction, enlargement, alteration, repair, moving, removal, demo- lition, conversion, occupancy, equipment, use, height, area and main- tenance of buildings and structures within the boundaries of the Dallas- Fort Worth Regional Airport; provides for the issuance of permits; provides minimum standards for plumbing and electrical installations within the Airport; and provides for a fine of not to exceed Two Hundred Dollars ($200 .00) for any violation thereof; and WHEREAS, the Airport Board has requested that the City Councils of the Cities of Dallas and Fort Worth approve its said Resolution No. 71-170 in order that it may become effective as aforesaid; and WHEREAS, the subject matter of this Ordinance and of said Resolution No. 71-170 is of imperative public need and necessity in the protection of the health, safety and morals of the inhabitants, users and visitors of the Dallas-Fort Worth Regional Airport, and is deemed necessary by the Fort Worth City Council for the operation, reg- ulation, protection and policing, and the management, government and use thereof, and this Ordinance is an emergency measure and shall be effective upon its adoption; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH: SECTION 1. That all of the declarations and findings contained in the preambles of this Ordinance are made a part hereof and shall be -2- fully effective as a part of the ordained subject matter of this Ordinance. SECTION 2. That Resolution No. 71-170 of the Dallas-Fort Worth Regional Airport Board, a duly certified copy of which is attached hereto and made a part of this Ordinance by reference, is hereby approved. SECTION 3. That after publication of a substantive statement relative to the Airport Building Code, 1971 Edition, and the penalty for the violation thereof, in a newspaper of general circulation in each of the Counties of Dallas and Tarrant, stating that a breach of any pro- vision of the said Airport Building Code, 1971 Edition, will subject the violator to the infliction of a penalty, and stating that the full text of said Airport Building Code, 1971 Edition, is on file in the principal office of the Board where the same may be read by any interested party, the said Resolution No. 71-170 shall thereafter have the same force and effect within the boundaries of the Dallas-Fort Worth Regional Airport as an ordinance by the City Council of the City of Fort Worth would have in the City of Fort Worth, and said penalty shall be enforced in the same manner in which penalties prescribed by other ordinances of the City of Fort Worth are enforced. SECTION 4. That this Ordinance shall take effect immediately from and after its passage in accordance with the provisions of the Charter of the City of Fort Worth and it is accordingly so ordained. WHEREAS, Articles 46d-7 and 46d-14, Revised Civil Statutes of Texas , and Paragraph 8.F of the Contract and Agreement Between the City of Dallas , Texas , and the City of Fort Worth, Texas , dated and effective as of April 15 , 1968 , authorize and empower the Board of Directors of the Dallas-Fort Worth Regional Airport, by a duly adopted Order, to adopt and enforce rules and regulations for the orderly, safe, efficient and sanitary operation of the Airport, and to prescribe reasonable penalties for the breach of any rule or regulation not exceeding more than Two Hundred Dollars ($200.00) fine; and � ' r m r WHEREAS, the following Order is deemed necessary for the en- forcement of the rules and regulations essential to the prudent manage- ment, government and use of the Dallas-Fort Worth Regional Airport; and WHEREAS, the aforesaid provisions of State Law and of the Contract and Agreement require approvals of the City Councils of the Cities of Dallas and Fort Worth in order that the following provisions shall have the same force and effect within the boundaries of the Dallas-Fort Worth Regional Airport as such Order would have in the Cities of Dallas and Fort Worth; and WHEREAS, it is the desire of the Board that this Order be forwarded to the City Councils of the Cities of Dallas and Fort Worth, and said City Councils are each hereby respectfully requested to approve same; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE DALLAS-FORT WORTH REGIONAL AIRPORT: SECTION 1 . That the Airport Building Code, 1971 Edition, is hereby adopted as the Building Code of the Dallas-Fort Worth Regional Airport, and the attached copy thereof, and one (1) additional copy thereof marked "Exhibit A" and filed in the official records of the Board for permanent record and inspection, are incorporated herein by reference. SECTION 2 . That it shall be unlawful for any person, firm, or corporation to erect, construct, enlarge, alter, repair, move, improve, -2- 1 a remove, convert or demolish, equip, use, occupy, or maintain any building or structure on the Airport, or cause the same to be done, contrary to or in violation of any of the provisions of the Airport Building Code, 1971 Edition. Any person, firm, or corporation violating any of the provisions of the Airport Building Code, 1971 Edition, shall be deemed guilty of a mis- demeanor, and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of the Airport Building Code, 1971 Edition, is committed, continued, or permitted, and upon conviction of any such violation such person shall be punishable by a fine of not more than Two Hundred Dollars ($200.00) . SECTION 3. That this Order shall become effective upon approval by the City Councils of the Cities of Dallas and Fort Worth, and after publication of a substantive statement thereof and the penalty for viola- tion thereof, in a newspaper of general circulation in each of the Counties of Dallas and Tarrant. ATTEST: Vs ce-Chairman Dallas-Fort Worth Regional Airport Board CII Secretary Dallas-Fort Worth Regional Airport Board -4- City hof Fort Worth, Texas Mayor and Council Communication DATE REFERENCE SUBJECT: Adoption of Building Code for PAGE NUMBE10/26/71 G-1850 the Regional Airport for 2 The contract between the Cities of Fort Worth and Dallas for the construction and operation of the Regional Airport provides that the Regional Airport Board shall have the power to adopt and enforce rules and regulations for the order lye safe, efficient and sanitary operation of the Airport, and to provide for a fine not to exceed $200 for any violation thereof. The contractual agree- ment between the two cities and the laws of the State of Texas provide that such orders issued by the Airport Board shall become effective only upon approval by the governing bodies of the Cities of Dallas and Fort Worth. Accordingly, the Regional Airport Board on October 5, 1971, passed and approved the Airport Building Code, 1971 Edition, and has requested that the Cities of Dallas and Fort Worth approve this Code. The code as proposed contains provisions of the Uniform Building Code, 1967 Edition, Volume I, as published by the International Conference of Building Officials, with revisions as recommended by Ross, Jensen & Associates, Inc. It is designed to achieve uniformity in the building construction standards, public health and safety requirements and the enforcement procedures applicable to the Dallas-Fort Worth Regional Airport. Generally, the Code is based upon and complies with the National Electrical Code, the National Plumbing Code, and the Uniform Building Code. It ,will regulate the erection, construction, enlargement, alteration repair, moving, removal, demolishing, conversion, occupancy, equip- ment, use, height, area and maintenance of buildings and structures within the boundaries of the Dallas-Fort Worth Regional Airport. The Code also provide'# for the issuance of permits and establishes minimum standards for plumbing and electrical installation within the airport. Section M of the proposed Code provides that a Board of Airport Building Code Appeals consisting of the building officials of the Cities of Dallas and Fort Worth and the building official of each additional city adopting the Code shall be established. The Airport Building Official will act as ex-officio member and secretary of the board. This board will determine the suitability of alternate materials and methods of construction and provide for reasonable interpretation of the provisions of the proposed Code. It will adopt reason- able rules and regulations for conducting its investigations and will render all decisions and findings in writing to the Airport Building Official with a duplicate copy to the Appellant. The Board may also recommend to the Dallas- Fort Worth Regional Airport Board and to all cities adopting this code any such new legislation which is needed, since itis anticipated that the Airport Building Code will be updated periodically in order to stay abreast of modern construction methods.
