AN ORDINANCE PROVIDING THAT WEST TENTH STREET
FROM THROCKMORTON STREET TO HOUSTON STREET BE
VACATED, ABANDONED AND CLOSED! PROVIDING FOR
THE REVERSION OF THE INTEREST OF THE CITY OF
FORT WORTH IN SAID LAND; REPEALING ALL ORDI-
NANCES IN CONFLICT HEREWITH: AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF FORT WORTH, TEXAS:
SECTION 1.
That West Tenth Street from Throckmorton Street to
Houston Street be and the same is hereby closed, abandoned
and permanently vacated as a street or public thoroughfare
of any kind or character whatever.
SECTION 2 .
That the interest of the City of Fort Worth in the
fee to the land in said street is hereby released and shall
revert to the adjacent owners of the fee as provided by law.
SECTION 3.
That all ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION 4
That this ordinance shall take effect and be in full
force and effect from and after the date of its passage.

On April 12, 1971 the City Council agreed to the closing of the 200 Block of
West Tenth Street and the creation of a pedestrian mall between Houston and
Throckmorton on the closed street. (M&C PZ-438) The Southwestern Bell
Telephone Company agreed to create a landscaped pedestrian mall and to main-
tain the mall perpetually at no cost to the City. The ordinance vacating
the street was to be adopted upon execution of a maintenance agreement
guaranteeing perpetual maintenance and the signing of dedication instruments
dedicating the replatted property.
The required maintenance agreements have been signed by officials of the Tele-
phone Company and the dedication has been signed by the Telephone Company and
the Bishop of the Episcopal Church, owner of the property on which the Down-
towner Motel is situated.
Upon vacation of the street, the Telephone Company will award a construction
contract to construct a 16 story office building using a portion of the street
and the present site of the old exchange building at the southeast corner of
Throckmorton and Tenth.
Recommendation
It is recommended that the City Council adopt the ordinance that has been
prepared vacating the subject right-of-way as recommended.
