AN ORDINANCE APPROVING AND ADOPTING ESTIMATES OF THE COST OF IMPROVE-
MENTS AND OF AMOUNTS TO BE ASSESSED FOR IMPROVEMENTS ON A PORTION OF
CHENAULT AVENUE
AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE
CITY OF FORT WORTH, TEXAS; FIXING TIME AND PLACE FOR HEARING TO THE
OWNERS OF ABUTTING PROPERTY AND TO ALL OTHERS INTERESTED; DIRECTING
THE CITY SECRETARY TO GIVE NOTICE OF SUCH HEARING; AND DIRECTING THE
CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE
CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL AND BY FILLING
THE COMPLETE ORDINANCE IN THE APPROPRIATE ORDINANCE RECORDS OF THE
CITY; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Fort Worth, Texas, has heretofore ordered that each of the
hereinafter described portions of streets, avenues and public places in the City of Fort Worth, Texas, be im-
proved by raising, grading and filling same and by constructing thereon the following, to-wit:
UNIT 1: : CHENAULT AVENUE From Paradise Street to Baurline Street,
known and designated as Unit 1, Project
No. 104-24000-207, to be improved by con-
structing a six-inch thick hot-mix asphaltic
concrete pavement on a six-inch thick cement
stabilized subgrade, seven-inch high concrete
curb and eighteen-inch concrete gutter, so
that the finished roadway will be thirty feet
wide and by constructing six-inch thick
concrete driveways and four-foot wide concrete
sidewalk where specified.
UNIT 2: VAN HORN STREET From Riverside Drive to 200' East, known
and designated as Unit 2, Project No. 104-
24000-207, to be improved by constructing
a six-inch thick hot-mix asphaltic concrete
pavement on a six-inch thick cement stabilized
subgrade, seven-inch high concrete curb and
eighteen-inch wide concrete gutter, so that
the finished roadway will be thirty feet wide
and by constructing six-inch thick concrete
driveways where specified.
UNIT 3: CHENAULT AVENUE From De Costa Street to Beach Street, known
and designated as Unit 3, Project No, 104-
24000-207, to be improved by constructing
a six-inch thick hot-mix asphaltic concrete
pavement on a six-inch thick cement stabilized
subgrade, seven-inch high concrete curb and
eighteen-inch wide concrete gutter, so that
the finished roadway will be thirty feet wide
and by constructing six-inch thick concrete
driveways where specified.
together with concrete curbs, gutters, driveways and incidentals to such improvements
on proper grade and line where same are not already so constructed, together with storm
sewers and drains and other necessary incidentals and appurtenances; all of said im-
provements to be constructed as and where shown on the Plans and in strict accordance
with the Plans and Specifications therefor; contract therefore has been made and
entered into with Austin Road Company
and
WHEREAS, the City Council of the City of Fort Worth, Texas, has caused the Public
Works Director to prepare and file estimates of the cost of such improvements and
estimates of the amount per front foot proposed to be assessed against abutting property
and the owners thereof, and such estimates have been examined, NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT:
I.
Such estimates be, and they are hereby adopted and approved.
II.
It is hereby found and determined that the cost of improvements on each portion of
streets, avenues, and public places hereinafter described, with the amount or amounts
per front foot proposed to be assessed for such improvements against abutting pro-
perty and the owners thereof, are as follows, to-wit:
Unit 1: Chenault Avenue From Paradise Street to Baurline Street,
known and designated as Unit 1, Project
No. 104-24000-207.
The estimated cost of improvements is the estimated amount
per front foot to be assessed against abutting property and the owners thereof for
concrete curb and gutter is $ 2.65 ; the estimated amount per front foot to
be assessed against abutting property and the owners thereof for pavement is $ 5.73
the estimated amount per front foot to be assessed against abutting property and the
owners thereof for _. 4 foot wide concrete sidewalk is $ 2.71 ; the estimated
amount per square foot to be assessed against abutting property and the owners thereof for
six-inch thick concrete driveway is $ .77 per square foot; the total
estimated amount per front foot to be assessed against abutting property and the owners
thereof is $ 11.09 plus the cost incurred for concrete driveway construction
where specified.

A hearing be given and held by and before the City Council of the City
of Fort Worth, Texas, to all awning or claiming any property abutting upon said
portions of highways, streets, avenues and public places, as well as to all
owning or claiming any interest in any such property. Such hearing shall be
given and held on the 22nd day of June 19 70 at 9:30 A.M.
in the Council Chamber intheCity Hall inthe City of Fort Worth, Texas, and
the City Secretary is hereby directed to give or cause to be given notice of the
time and place of such hearing and of other matters and facts in accordance with
the to and provisions of an Act passed at the First Called Session of the
Fortieth Legislature of the State of Texas, and known as Chapter 106 of the Acts
of said Session, now being known as Article 1105b of Vernon's' Texas Civil Statutes
as amended by Acts 1967, 60th Legislature, Page 365, Chapter. 176, Section 1,
emergency effective May 12, 1967. Such notice shall be by advertisement inserted
at least three (3) times in a newspaper published in the City of Fort Worth,
Texas, the first publication to be made at least twenty-one (21) days before
the date of said hearing. Said notice shall comply with and be in accordance with
the terms and provisions of said Act as amended. The City Secretary is further
directed to give or cause to be given personal notice of the time and place of
such hearing to all owning or claiming any property abutting on said portions of
highways, streets, avenues and public places , as well as to all owning or claiming
any interest in any such property. Such personal notice shall be in writing and
shall be given or caused to be given by the City Secretary by depositing such
written notice in the United States it at least fourteen (14) days before the
date of the hearing, postage prepaid, in envelopes addressed to all persons
owning or claiming any interest in the respective properties abutting the high-
ways, streets, avenues and public places or portions thereof to be improved, as
the names of such persons are shown on the current rendered tax rolls of the City
of Fort Worth and at the addresses so shown, or if the name of such respective
owners do not appear on such rendered tax rolls, then address to such owners as
their names are shown on the current unrendered tax rolls of the City of Fort Worth
at the addresses shown thereon. In those cases in which an owner of property
abutting a highway, street, avenue or public place or portion or portions there-
of which is to be improved is listed as "unknown" on the then current City of
Fort Worth tax rolls, or the name of an owner is shown on the City of Fort Worth
tax rolls but no address for such owner is shown, no notice need be mailed. In
those cases where the owner is shown to be an estate, the mailed notice may be
addressed to such estate. In this connection, the City Secretary shall prepare
and file or cause to be prepared and filed with these proceedings a list of the
properties to be assessed, the names of those persons owning or claiming any
interest in said properties to whom the notice was mailed, together with the last
known addresses determined as aforesaid of the respective owners and those per.-
sons owning or claiming any interest in said property.
The City Secretary shall certify that each of the parties in said list whose
address is shown on the then current rendered or unrendered tax rolls of the City
of Fort Worth was mailed a copy of the notice of hearing and shall further certify
the date or dates on which said notice was mailed. A copy of each notice shall be
attached to such certificate. The certificate of the City Secretary will be con-,
clusive evidence of the facts therein recited,
IV.
The City Secretary is hereby directed to engross and enroll this ordinance
by copying the caption of same in the Minute Book of the City Council and by
filing the complete ordinance in the appropriate Ordinance Records of this City.
V.
This ordinance shall take effect and be in full force and effect from and
after the date of its passage.

per front foot to be assessed against abutting property and the owners thereof for
concrete curb and gutter is $ 2.65 ; the estimated amount per front foot to be
assessed against abutting property and the owners thereof for pavement is $ 5.77 ;
the estimated amount per front foot to be assessed against abutting property and
the owners thereof for -0- wide concrete sidewalk is $ -0- ; the estimated
amount per square foot to be assessed against abutting property and the owners
thereof for 6-inch thick concrete driveway is $ .77 per square foot; the total
estimated amount per front foot to be assessed against abutting property and the
owners thereof is $ 8.42 plus the cost incurred for concrete driveway con-
struction where specified.
Unit 4: Baurline Street From Ennis Street to CRI & P Railroad,
known and designated as Unit 4, Project
No. 104-24000-207.
The estimated cost of improvements is $ 8,195.61 the estimated amount
per front foot to be assessed against abutting property and the owners thereof for
concrete curb and gutter is $ 2.65 ; the estimated amount per front foot to be
assessed against abutting property and the owners thereof for pavement is $ 5.73;
the estimated amount per front foot to be assessed against abutting property and
the owners thereof for -0- wide concrete sidewalk is $ -0- ; the estimated
amount per square foot to be assessed against abutting property and the owners
thereof for 6-inch thick concrete driveway is $ .77 per square foot; the total
estimated amount per front foot to be assessed against abutting property and the

concrete curb and gutter is $ 2.65 ; the estimated amount per front foot to be
assessed against abutting property and the owners thereof for pavement is $ 5.73 ;
the estimated amount per front foot to be assessed against abutting property and
the owners thereof for 4 foot wide concrete sidewalk is $ 2.71 ; the estimated
amount per square foot to be assessed against abutting property and the owners
thereof for 6-inch thick concrete driveway is $ .77 per square foot; the total
estimated amount per front foot to be assessed against abutting property and the
owners thereof is $ 11.09 , plus the cost incurred for concrete driveway con-

known and designated as Unit 6, Project

The estimated cost of improvements is $ 21,145.36 ; the estimated amount
per front foot to be assessed against abutting property and the owners thereof for
concrete curb and gutter is $ 2.65 ; the estimated amount per front foot to be
assessed against abutting property and the owners thereof for pavement is $4.87 ;
the estimated amount per front foot to be assessed against abutting property and
the owners thereof for -0- wide concrete sidewalk is $ -0- ; the estimated
amount per square foot to be assessed against abutting property and the owners
thereof for 6-inch thick concrete driveway is $ .77 per square foot; the total
estimated amount per front foot to be assessed against abutting property and the
owners thereof is $ 7.52 plus the cost incurred for concrete driveway con-
struction where specified.

Sidewalks
Sidewalks are included on Units 1 (Chenault Avenue) and 5 (La Salle Street)
of this project for the following reasons:

Side
Unit 1, Chenault Avenue: Sidewalks are included on the north side
of the street only to serve the Paradise Baptist Church and parsonage.
Unit 5, La Salle Street: Sidewalks are included to tie in with exist-
ing sidewalks and to serve the Versia L. Williams Elementary School,
located within (southwest corner) this block. Sidewalks on this unit
will be constructed adjacent to the curb , due to the street only
having a five foot parkway.
Project Cost and Financing
Based on the low bid, approximately $35,876.24 will be assessed against the
abutting property owners. The cost to the City-at-large will be approximately
$68,005.97, including engineering expense. Funds in the amount of approxi-
mately $2,000 remain in the project account from preliminary design engineering
funds to help finance the City's cost.
Recommendations
It is recommended that:

ASSESSMENT PAVING b LOCATIONS AT THE NORTHEAST SIDE

A Neighborhood Hearing was conducted by the Engineering Division of the Public Works Depart-
ment at the Ver,sia Lo Williams Elementary School on May 11, 1970, for the Assessment Paving
of 6 Locations at the Northeast Side.
Procedures concerning owner participation in the cost, method and policies determining
assessments,) street construction standards 9 and methods of payment were explained by Mr.
Odell Ho Schmidt to the 23 persons attending.
'The meeting was then opened for a question and answer period
Unit i, Ohenaullt Avenue. No questions
Unit 2, Vann Horn Street., Mara Edgar Wo Hopkins, 3200 Van Horn, owner of ]dot 36, carver's
Place, said he thought his assessment was too high. Mr. Schmidt, told him that his property
was zoned 'Dight industrial and that he had been given owner occupied credit.
Unit 39 0henauult -Avenue, No questions
Unit 49 Eauarlli,ne Street, Mr. Thomas M. Evans, Euless, 'Texas, owner of Lot 11,29 & 3, Block
829 riverside Addition, list Filling said he thought his assessment was rather high. Mro
Schmidt told him that; his property was also zoned Might industrial and as he didn't hive on
the property he would not be entitled to owner occupied credit.
Unit. 59 La Salle Street. Mr. Ola Mace Davis, 709 Eau rlin,e9 owner of Lot 29 Block O, Adams
Heirs Subdivision asked why her assessment was so high, She was told that she had been
given side lot credit and was only being assessed for 1100' of her 1125° of abutting property.
Mr. Frazier G uydeun, 2813 La Sallie„ owner of Lot 1, Block C, Adams Heirs Subdivision stated
that when he signi.ed the petition, sidewalks were not included. Mr. Schmidt explained to
him about. the City's :Sidewalk Policy,
Unit 6, Pinney Street: Mr. A. Eo Brown, owner of Wo 1187011° of Lot 58, asked Mr. Schmidt
if the six-inch HMAC pavement would hold up under commercial use. He was told that the
matter would be checked. Mr. Schmidt questioned the Engianeering, Sections and was told due
to the soil structure the proposed pavement would be strong enough for commercial traffic,
He cashed Mr. Brown and relayed the message.
Mr. Joe A. Weisberg, 26271 Finney asked about driveways. He was told he wound have to
consult Traffic Engineering for more driveways because his property is zoned Might industrial.
After a short general discussion, the meeting was adjourned.
