ORDINANCE NO. CITY SECRETARY
FT. WORTH, TEX.
AN ORDINANCE PROHIBITING THE SETTING UP OR OPERATION
OF CARNIVALS, CIRCUSES OR TENT SHOWS WITHIN THE COR-
PORATE LIMITS OF THE CITY OF FORT WORTH WITHOUT SE-
CURING A PERMIT AND PAYING A PERMIT FEE; EXEMPTING
ACTIVITIES SPONSORED SOLELY BY ANY CHURCH, SCHOOL,
SCHOOL ORGANIZATION OR HOSPITAL; PROVIDING A PENALTY;
PROVIDING A SAVINGS CLAUSE; MAKING THIS ORDINANCE
CUMULATIVE OF OTHER ORDINANCES NOT IN CONFLICT HERE-
WITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION 1.
PERMIT FEE
No person, firm or corporation shall set up or operate any
carnival, circus or tent show within the corporate limits of
the City of Fort Worth unless and until such person, firm or
corporation has first obtained a permit and paid to the Assessor
and Collector of Taxes a permit fee in the amount of Twenty-
five Dollars ($25.00) . Any permit issued by the City for the
setting up or operating of any carnival, circus or tent show
shall expire ninety (90) days after the date of its issuance.
The permit and fee required by Chapter 18, Article XV of
the Code of the City of Fort Worth, 1950, for the operation
of carnivals, circuses and tent shows shall not be collected
as a separate or additional fee but same shall be and is hereby
expressly included in and made a part of the permit and fee
required by this ordinance.
SECTION 2.
EXEMPTION
Short-term shows or activities sponsored solely by any
church, school, school organization or hospital which are
operated on church, school or hospital grounds and all the
profits from which go to said church, school, school organiza-
tion or hospital, shall not be deemed to be carnivals, circuses
or tent shows under the provisions of this ordinance and shall
not require the fee set out herein.
SECTION 3.
PENALTY
Any person, firm or corporation, or its agents, servants
or officers, who violates or disobeys, omits, neglects or re-
fuses to comply with, or who resists the enforcement of, any
of the provisions of this ordinance shall be fined in any sum
not to exceed Two Hundred Dollars ($200.00) for each such of-
fense, and each day that a violation continues shall constitute
a separate offense.
SECTION 4.
SAVINGS CLAUSE
If any provision, section, subsection, clause or phrase
of this ordinance or the application of same to any person or
set of circumstances is for any reason held to be unconstitution-
al, void or invalid, or for any reason unenforceable, the va-
lidity of the remaining portions hereof or their application to
other persons or sets of circumstances shall not be affected
thereby, it being the intent of the City Council of the City
of Fort Worth in adopting this ordinance to provide that no
portion hereof shall become inoperative or fail by reason of
any unconstitutionality or invalidity of any other portion,
and to this end all provisions hereof are declared to be
severable.
SECTION 5.
ORDINANCE CUMULATIVE OF OTHER ORDINANCES
This ordinance shall repeal every prior ordinance that
is in direct conflict herewith, but only such portions of
such prior ordinances as are in direct conflict with the pro-
visions of this ordinance shall be so repealed, and as to all
other portions of all, prior ordinances not in direct conflict
herewith, this ordinance shall be and is hereby made cumulative.
SECTION 6.
EFFECTIVE DATE
This ordinance shall take effect and be in full force
and effect from and after its passage and publication as re-
quired by law.
