AN ORDINANCE MAKING CERTAIN FINDINGS; PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY CON- SISTING OF 1.189 SQUARE MILES OF LAND, WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS; AND NAMING AN EFFECTIVE DATE. WHEREAS, a public hearing before the City Council of the City of Fort Worth, Texas, wherein all interested persons were provided with an opportunity to be heard on the pro- posed annexation of the territory hereinafter described, was held at the City Council Chamber in the City Hall of Fort Worth, Texas on the 14th day of March, 1966; and WHEREAS, notice of such public hearing was published in a newspaper having general circulation in the City and in the territory proposed to be annexed on the 2nd day of March, 1966, and WHEREAS, on the 4th day of March, 1966 the City of Fort Worth was restrained from proceeding further with the proposed annexation; and WHEREAS, in recognition of the restraining order the public hearing was continued from day to day and from time to time, and WHEREAS, on the 20th day of June, 1966, a judgment favorable to the City of Fort Worth was rendered by the District Court, and was recorded on the 22nd day of June, 1966, at Volume 4231, Page 205 of the Deed Records of Tarrant County, Texas; and WHEREAS, all prerequisites to consideration of the proposed annexation having been met the continued public hearing was closed on the 27th day of June, 1966, which date is not more than twenty (20) nor less than ten (10) days prior to the institution of annexation proceedings, and WHEREAS, the J and J Development Corporation has petitioned for annexation of a portion of the area hereinafter described, the area in said petition being more fully described as follows: A part of the J. C. Donaldson Survey, Abstract No. 1786, and a part of the A. Van Nordstrand Survey, Abstract No. 1584, situated about 5 3/4 miles north 55 degrees west from the court- house in Tarrant County, Texas, and embracing a portion of Tract No. 3 and a portion of Tract No. 2 conveyed to the Amon G. Carter Foundation by an instrument recorded in Volume 1910 Page 229 of the deed records of Tarrant County, Texas. Beginning at the southeast corner of said Tract 3, described in said conveyance to Amon G. Carter Foundation by said deed, and from said corner a one inch iron rod bears south 89 degrees, 37 minutes west 54-feet; Thence south 89 degrees, 37 minutes west, along the south line of said tract, 1,519.7 feet to a one inch iron rod set :128.3 feet from a concrete monument, the southwest corner of said Tract No. 3. Thence north 2,600.64 feet to a point and from said point a one inch iron rod bears north 267.66 feet, said iron rod being in the southwest line of the right of way for the Fort Worth-Jacksboro Highway described in the easement to Tarrant County recorded in Volume 1106, Page 206 of the deed records of Tarrant County, Texas; Thence south 48 degrees, 21 minutes east 2,030.9 feet, parallel to and 200.0 feet south- west of said Highway right of way line to a point in the east line of said Tract No. 3 in Roberts Cut-Off Road; Thence south no degrees, 10 minutes east, along said line, in said road, 1,242.17 feet to the Place of Beginning, and containing 66.3 acres, exclusive of the 0.71 acres in Roberts Cut-Off Road, and of said 66.3 acres there are 29.48 acres in the J. C. Donaldson Survey and 36.82 acres in the A. Van Nordstrand Survey; and WHEREAS, the population of the City of Fort Worth, Texas, is in excess of 391,000 inhabitants; and WHEREAS, the corporate area of the City of Fort Worth, Texas was 179.860 square miles on January 1 , 1966; and WHEREAS, the hereinafter described territory lies within the extraterritorial jurisdiction of the City of Fort Worth, Texas; and WHEREAS, the territory hereinafter described lies adjacent to and adjoins the City of Fort Worth, Texas; and WHEREAS, the territory hereinafter described contains 1.189 square miles; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. The following described land and territory lying adjacent to and adjoining the City of Fort Worth, Texas, is hereby added to and annexed to the City of Fort Worth,,.Texas and said territory hereinafter described shall hereafter be included within the boundary limits of the City of Fort Worth, Texas, and the present boundary limits of said City, at the various points contiguous to the area hereinafter described, are altered and amended so as to include said area within the corporate limits of the City of Fort Worth, Texas, to-wit: Being a portion of the J. C. Donaldson Survey, Abstract No. 1786, a portion of the A. Van Nordstrand Survey, Abstract No. 1584, a portion of the J. M. Basques Survey, Abstract No. 85, a portion of the M. Townsend Survey, Abstract No. 1552, and a portion of the J. Wilcox Survey, Abstract No. 1741, situated about six miles northwesterly from the courthouse of Tarrant County, Texas and being more fully described as follows: Beginning at a point in the present City of Fort Worth City Limit Line, 50 feet east from the Southeast Corner of Lot 5 in Block 38, Indian Oaks Addition, and 50 feet east fm a City of Fort Worth City Limit Line established by Ordinance No. 3717 of the City of Fort Worth, which ordinance and the municipal boundary lines therein set forth were held to be valid and existing by order rendered by the District Court of Tarrant County, Texas, 17th Judicial District, on June 20, 1966 in Cause No. 43626-C, City of Fort Worth, Texas, vs. City of Lake Worth, Texas, which judgment is recorded in Volume 4231, at Page 205, Deed Records of Tarrant County, Texas. Thence North, 50 feet east from the City of Fort Worth City Limit line established by Ordinance No. 3717, a distance of 3900 feet, more or less, to a point 50 feet south of the City Limit Line established by-Ordinance No, 3717, which line is. 200 feet south of the South right-of-way line of Charbonneau Road. Thence in an easterly direction along a line 250 feet south. and parallel to the south right- of-way line of Charbonneau Road and the south right-of-way line of Jacksboro Highway, and 50 feet south of and parallel to the Fort Worth City Limit Line established by Ordinance No. 3717, a distance of 9300 feet, more or less, to a point 50 feet west of the City of Fort Worth City Limit Line established by Ordinance No. 3717 in the east right-of-way line of Roberts Cut-Off Road. Thence South, 50 feet west from the east line of Roberts Cut-Off Road and the City of Fort Worth City Limit Line established by Ordinance No. 3717 a distance of 1220 feet, more or less, to a point in the present City of Fort Worth City Limit Line established by City of Fort Worth Ordinance No. 513. Thence along the present City of Fort Worth City Limit Line established by Ordinance No. 513 the following courses and distances: South 89032' West 1601.3 feet, and South 0°11' East 417.8 feet, to the Southeast corner of the J. M. Basques Survey, and South 89058' West along the south line of the J. M. Basques Survey 2909 feet and South 45°05' West 799 feet and South 0°18' West 634 feet and A North 890.42' West 1904.4 feet, and North 0018' East 200 feet, and North 89°42' West 803.2 feet, and North 44042".1test 848.5 feet, and North 0°18' West 397 feet to the Northeast corner of`the H. B. Smallwood Survey, and North 89034' West along the North line of the H. B. Smallwood Survey 174 feet, more or less, to the place of beginning, and containing approximately 1.189 square miles of land. SECTION 2. The above described territory and the area annexed shall be a partVof the City of Fort Worth, Texas, and the property so added hereby shall bear its pro rata part of the taxes levied 0y.the City of Fort Worth_, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions and regulations of the City of Fort Worth, Texas. SECTION 3. That this ordinance shall and does hereby amend every prior ordinance in conflict herewith, but as to all other ordinances or sections of ordinances not in direct conflict herewith this ordinance shall be and is hereby made cumulative. SECTION 4. If any section, subsection, clause, sentence, phrase, or word of this ordinance is for any reason held void or unconstitutional by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining sections, subsections, clauses, sentences, phrases, or words, except as the same are inseparable from and indispensable to the remain- ing portions of the ordinance. SECTION 5. This ordinance shall be in full force and effect from and after the date of its passage on first reading and publication and its passage on second reading as provided for in Section 40 of Chapter XXVIII of the Charter of the City of Fort Worth and it is so ordained. W. Thompson, President of J and J Development Corporation, owner of a 780 acre tract adjacent to the City of Fort Worth in the vicinity of Lake Worth, has re- quested annexation of a 60 acre tract known as Shady Oaks Manor Addition as shown on the attached map. The request has been reviewed by City Departments and their findings have been considered by the City Plan Commission, which recom- mends that the tract be annexed as requested. This communication provides infor- mation about the availability of municipal facilities and services, the distribu- tion of costs for the development and the feasibility of development within the City of Fort Worth. Nature of Development The area requested for annexation is located in the eastern portion of the larger ownership bounded by Jacksboro Highway on the north, Roberts Cut-Off Road on the east, Fort Worth city park and Lake Worth on the south and the Vil- lage of Lake Worth on the west. The Village of Lake Worth has established a 200 foot wide corridor south of Jacksboro Highway, but the remainder of the tract is reserved for annexation to the City of Fort Worth. Although no final plat has been approved for the tract, preliminary plans indicate the development will be subdivided into about 180 residential lots with an average developed sale price of $25,000 per unit. Preliminary Plat Review Detailed preliminary plats of the 60 acre tract have been submitted and reviewed by the City Plan Commission. Final approval will be granted by the Commission upon annexation by the City of Fort Wbrth and zoning in accordance with the pro- posed plat. A zoning hearing will be scheduled by the Zoning Commission after annexation. Water and Sewer Existing water and sewer mains in the general area are adequate to serve the area requested for annexation. There is an 18 inch sanitary sewer line in the Jacksboro Highway and a 16 inch water main in Nine Mile Bridge Road. A 16 inch approach water main will be built to serve the area south of Jacksboro Highway. Sewage will drain southward in the development to a lift station which will pump the sewage to the existing main Jacksboro Highway. Under existing contractual arrangements with Lake: rWc� h .'Villa�e„ Fort Worth can connect with the main existing in Jacksboro Highway, provided payment is made in proportion to capacity being used in the line. The cost of service to the 60 acre tract requested for annexation is estimated at $1,500. No cash payments would be made to Lake Worth, but the existing main connection cost would be subtracted from the amount Lake Worth owes Fort Worth for sanitary sewer services and facilities, in accord- ance with terms of the contract between the cities. It appears that one collector street will be required on a 60 foot right-of-way, but most of the streets will be built to residential standards on 50 foot right-of-way. Although the area is rolling, preliminary review does not indicate the need for major storm drainage facilities in which the City would participate extensively. Standard street, curb and gutter is estimated to cost $135,520 which will be the full responsibility of the developer. Because the developer has expressed interest in underground conduits, esti- mates have been provided for conventional and buried cable with metal poles, as follows : Item Developer City Total Overhead with $ 9,240 $ 1,155 $ 102395 Wood Pole Underground with °12,705 1,155 13,860 Metal Pole The City will participate in one-half the cost of conventional lighting on Roberts Cut-Off Road, a border street. Because Lake Worth Village has a corridor along the South side of Jacksboro Highway, the City of Fort Worth cannot require lighting of the highway in connection with this development. _Waste Disposal, Fire and Police Services Existing routes for waste collection can be extended to serve the area pro- posed for annexation. Primary fire response service will be provided from Station No. 15 at Robinson and Azle Avenue scheduled for construction in 1966, augmented by the existing Fire Station No. 12 at 2410 Prospect. By 1970, an additional new station is planned for location in the northwestern part .of the city. Other existing stations can provide secondary response. Police protection can be provided by extension of radio patrol districts into the area. As this and other large scale developments proceed in Fort Worth, it will be necessary to expand City work forces to meet rec ervice demands. pffIC0A1 REEpRD CITY SECRETARY t, NWRRIy. TAX. Adjoining property will also be protected from the blighting influences of erratic expansion. The area proposed for annexation is continuous to existing city limits and would be an orderly extension of the city's boundaries. Summary Because of the availability and feasibility of extending municipal services to this area, and based upon the request of the property owner and recom- mendation of the City Plan Commission for annexation, it is recommended: 1) That a hearing be set on the requested annexation; and, 2) That the administrative staff be instructed to prepare necessary descriptions and annexation ordinances for final City Council action after the hearing and other necessary legal steps have been taken. :GA attach °AR's kCURD clry SECREFVr IT.
