HomeMy WebLinkAboutOrdinance 5805 ORDINANCE NO. - AN ORDINANCE APPROVING AND ADOPTING ESTIMATES OF THE COST OF IMPROVE- MENTS AND OF AMOUNTS TO BE ASSESSED FOR IMPROVEMENTS ON A PORTION OF AYERS STREET AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; FIXING TIME AND PLACE FOR HEARING TO THE OWNERS OF ABUTTING PROPERTY AND TO ALL OTHERS INTERESTED; DIRECTING THE CITY SECRETARY TO GIVE NOTICE OF SUCH HEARING; AND DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL AND BY FILLING THE COMPLETE ORDINANCE IN THE APPROPRIATE ORDINANCE RECORDS OF TIRE CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Fort Worth,Texas, has heretofore ordered that each of the hereinafter described portions of streets, avenues and public places in the City of Fort Worth, Texas, be im- proved by raising, grading and filling same and by constructing thereon the following, to-wit: 1. AYERS STREET: From the North line of Avenue "G" to the North line of . Mount Vernon Street to the west, known and designated. as Unit 1, Project No. 104-22000-126, a 6-inch hot-mix asphaltic concrete pavement on a 36' roadway. together with combined concrete curbs and gutters on proper grade and line where same are not already so constructed, together with storm sewers and drains and other necessary incidentals and appurtenances; all of said improvements to be constructed as and where shown on the Plans and in strict accordance with the Plans and Specifications therefor; and contract therefor has been made and entered into with Austin Road Co.- 6lorth Construction Co. _- and WHEREAS, the City Council of the City of Fort Worth, Texas, has caused the Public Works Director to prepare and file estimates of the cost of such improvements and estimates of the amounts per front foot proposed to be assessed against abutting property and the owners thereof, and such estimates have been ex- amined. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: I. Such estimates be, and they are hereby adopted and approved. II. It is hereby found and determined that the cost of improvements on each portion of street,avenue and public place hereinafter described, with the amount or amounts per front foot proposed to be assessed for such improvements against abutting property and the owners thereof, are as follows, to-wit: AYERS STREET: From the North line of Avenue "G" to the North line of Mount Vernon Street to the west, known and designated as Unit 1, Project No. 104-22000-126. The estimated cost of improvements is $_10GJ78,,07 the estimated amount per front foot to be asiewd against abutting property and the owners thereof for combined concrete curb and gutter is $ ; the estimated amount per front foot to be assessed against abutting property and the owners thereof for improvements exclusive of curb and utter is $— the total estimated amount per front foot to be assessed against abutting property and the owners thereof is $ 7.11 The estimated cost of improvements is the estimated amount per front foot to be assessed against abutting property and the owners thereof for combined concrete curb and gutter is $ ; the estimated amount per front foot to be assessed against abutting property and the owners thereof for improvements exclusive of curb and gutter is $ ; the total estimated amount per front foot to be assessed against abutting property and the owners thereof is III. A hearing be given and held by and before the City Council of the City of Fort Worth,Texas,to all own- ing or claiming any property abutting upon said portions of streets,avenues and public places,as well as to all owning or claiming any interest in any such property.Such hearing shall be given and held on the 7th. day of August , 19 67 , at 9:30 A.M. in the Council Chamber in the City Hall in the City of Fort Worth, Texas, and the City Secretary is hereby directed to give notice of the time and place of such hearing and of other matters and facts in accordance with the terms and provisions of an Act passed at the First Called Session of the Fortieth Legislature of the State of Texas, and known as Chapter 106 of the Acts of said Ses- sion, now benig shown as Article 1105b of Vernon's Texas Civil Statutes.Such notice shall be by advertisement at least three times in a newspaper published in the City of Fort Worth,Texas,the first publication to be made at least ten days before the date of said hearing.Said notice shall comply with and be in accordance with the terms and provisions of said Act. The City Secretary is further directed to'give personal notice of the time and place of such hearing to all owning or claiming any property abutting on said portions of streets,avenues and public places, as well as to all owning or claiming any interest in any such property. Such personal notice shall be given by the City Secretary mailing said notice postage prepaid, to the respective owners of record of the properties to be assessed, and to any person owning or claiming any interest in said properties,to the last known address of said owner or persons. It shall not be necessary for the City Secretary to mail said notices to any owner or other person claiming an interest in the property to be assessed when the addess of such owner or other person claiming an interest in the property to be assessed is unknown to the City Secretary and cannot be determined by the City Secretary after reasonable investigation. In this connection the City Secretary shall prepare and file with these proceedings a list of the properties to be assessed, the names of those persons own- ing or claiming any interest in said properties to whom the notice was mailed, together with the last known address of the respective owners and those persons owning or claiming any interest in said property. The.City Secretary shall certify that each of the parties named in said list whose address was known to him, was mailed a copy of the notice of hearing and shallfurther certify the date or dates on which said notice was mailed. A copy of the notice shall be attached to such certificate. The certificate of the City Secretary will be conclusive evidence of the facts therein recited. Failure of the City Secretary to give notice of hearing by mail as herein provided for, or failure of the owners or other persons interested to receive said notice,shall in nowise invalidate said hearing or any assessments levied pursuant to said hearing, but notice of hearing shall be sufficient, valid and binding upon all owning or claiming such abutting property or any interest therein when same shall have been given by newspaper advertisement as first hereinabove provided. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council and by filing the complete ordinance in the appropriate Ordinance Records of this City. DATE REFERENCE SUBJECT: Award of Contract - Ayers Street AGE NUMBER Improvements (CIP A-31) 7/3/67 C-1003 i °' On June 26, 1967, a petition regarding Ayers Street paving was submitted to Council Members (copy attached). Consideration of the contract award was originally scheduled for July 10, 1967, but because of utility adjustments in progress, interest of citizens in the project, and right-of-way acquisi- tions being submitted for consideration this week, the award of contract has been advanced one week. The accelerated schedule makes it necessary to sub- mit the hand-written engineers' roll instead of the typewritten alphabetical roll which is normally prepared. Project Mgcrip,.tion Nature of work: Paving improvements on Ayers Street, as follows: ROADWAY UNIT STREET LIMITS WIDTH R.O.W., 1 Ayers Street Avenue %" to Meadowbrook 36 feet 50 feet The improvement and widening of Ayers Street, a penetration asphalt type road- way now 30 feet wide, was first approved by voters in the bond election of November 18, 1958, and additional funds for the City's share of the cost were authorized by voters in the bond election of October 19, 1965 (CIP A-31). Ayers Street was included in the bond program because it is the only through collector street connecting Rosedale and Meadowbrook Drive between Beach Street and Oakland Boulevard, a distance of approximately two miles. Both Beach and Oakland have been improved in previous bond programs. Improvement of Ayers would furnish a high quality collector between these two streets. Traffic counts on Ayers made in 1965 indicated 2,784 vehicles used the street daily, compared with 8,000 vehicles on Beach and 8,100 vehicles on Oakland at the same time. Widening of Ayers from 30 to 36 feet is proposed in order to permit curb park- ing and allow two lanes of traffic to pass safely in opposite directions. Ad- ditional right-of-way is required for the widening and the City Council has already acquired ten parcels at a cost of $7;930.51. Two additional parcels costing $13,269 are proposed for purchase at the meeting of July 3, 1967 (M&C's L-1897 and L-1898). A total of 15 parcels are required at an estimated cost of $32,200. Assessments are proposed on Ayers Street against properties that have never paid for permanent paving, and commercial properties for the cost of widen- ing, in accordance with standard policies. There is no evidence that property owners participated in the cost of existing penetration asphalt type paving on Ayers. Residential property owners will be given credit for existing curb and gutter, and for the existing paving if evidence is submitted showing prior par- ticipation in the cost of paving Ayers Street. In all sections of the City, residential property owners are responsible for the initial cost o paving, and maintenance is the responsibility of the City. *tit f DATE REFERENCE SUBJECT: Award of Contract - Ayers Street PAGE NUMBER 7/3/67 UMBER Improvements (CIP A-31) 2 2 of Attached is a copy of a petition submitted by Mr. Ralph P. Ridgway bearing thirteen signatures of property owners on Ayers Street, many of whom are widowed, retired or elderly persons. In accordance with standard City Council policies, a payment plan is available to persons showing a finan- cial hardship by extending payments for more than four years with interest accruing for only four years. The cost to the City-at-large will be approximately $67,350.03 (61 per cent) for assessment paving, including en- gineering and miscellaneous expenses. Right-of-way purchases will make total City costs approximately $99,550. Funds are available in the 097 and 104 bend funds for the City share. Recommendations It is recommended: 1) That the following bond fund transfer be approved: Amount From To Purpose $ -17 Revolving Fund Ayers Street Property owners' portion of 104-22000-126 construction 2) That an ordinance be adopted: a) Declaring the necessity for and ordering the improvements; b) Making provisions for levying of assessments; c) Ordering the Public Works Department to prepare estimates of costs and amounts proposed to be assessed; d) Awarding the contract to Austin Road Company - Worth Construction Co. on its low bid of $100,702.00; and e) Making appropriations to cover the indebtedness thereby incurred for improvements to the project named above; and, 3) That a resolution be adopted setting August 7, 1967 as the date of the Benefit Hearing.
