C AN ORDINANCE CLOSING AND VACATING THE TEN FOOT UTILITY EASEPUM ADJACENT TO LOTS 1 THROUGH 7, BLOCK 41, RIDGLEA ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TMCAS, AND VACATING, ABANDONING AND CLOSING THE UNNAMED EAST-40ST STRU= LOCATED JUST NORTH OF BLOCK 41 OF SAID RIDGLUA ADDITION, BETWEEN WESTRIDGE AVENUE AND WAVERLY WAYi PRDVIDING FOR THE REVERSION OF THE INTEREST OF THE CITY OF FLIRT WORTH IN SAID LANDr REPEALING ALL, ORDINANCES IN CONFLICT HEREWITHr AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CI'T'Y COUNCIL OF THE CITY OF FORT MORTH, TEXASs SECTION 1. That the ten foot wide utility easement adjacent to Lots 1 through 7, Block 41, Ridglea Addition to the City of Fort North, Tarrant County, Texas, be and the same is hereby extinguished, vacated, closed and Permanently abandoned as an easement for public utilities. SECTMN 2. That the unnamed east-west street located just north of said Block 41, Ridglea Addition, between Westridge Avenue and Waverly may, as hereinafter more Particularly described, be and the same is hereby closed, abandoned and permanently vacated as a street or public thoroughfare of any kind or character whatever, save and except that easements are reserved for any and all existing utilities: Commence at the west corner of Lot 1 in said Block 41 and then run north 51 degrees 06 minutes east, along the northwesterly line of said Lot 1, 58-7/10 feet to a point for the southwesterly and beginning corner of the tract being described, and being in the southeasterly line of Waverly Way: Thence along a line for the southeasterly line of Waverly Way, along a curve to the left with a radius of 1198 feet for a distance of approxi- mately 187 feet to the face of the northerly curb of said street being closedr Thence easterly, along said curb line, about 106 feet to a point in a line for the westerly lime of Westridge Avenues Thence southerly along said line for the westerly line of Wostridge Avenue approximately 117 feet to the point of curve for the northerly line of said Block 41 with a radius of 85 feett Thence northwesterly along said northerly line of Block 41 and along said curve to the left a distance of 213-1/10 feet to the end of said curve in the southeasterly line of Waverly Way and the northvesterly line of said Block 411 Thence south 51 degrees 06 minutes west along said block and street line 80-6/10 feet to the place of beginning, and containing ap- proximately 8220 square feet. SECTION 3. That the interest of the City of Fort Worth in the fee to the land in said easement and street above described is hereby released and shall revert to the adjacent owner of the fee as provided by law. SECTION 4. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5. That this ordinance shall take effect and be in full force and effect from and after the date of its passage. T. Juther, Jr. , has requested that the City vacate the '10 feet wide utility easements adjacent to Lots 1 through 7, Block 41, Ridglea Addition, and street right-o£-way at the intersection of Waverly Way and Westridge Avenue, located north of said Block 41, Ridglea Addition, as shown on the attached map. The street right-of-way is open and paved, and the easements contain existing utilities. Both the street right-of-way and the easements were acquired by dedication. The Applicant proposes to construct a multi-story office and banking complex on adjoining land and the granting of this request will permit more advan- tageous land utilization. The Applicant plans to re-construct the intersection of Waverly Way and Westridge Avenue which will greatly improve the traffic conditions of the intersection. City departments and private utility companies have reviewed this request and have no objections, provided the Applicant replats and makes satisfactory relocation arrangements for all existing utili- ties. The City Plan Commission has reviewed this request and recommends adoption of an ordinance vacating the public right-of-way and easements as requested. The Applicant has submitted .a replat and has made satisfactory relocation arrangements for all existing utilities. Recommendation It is recommended that an ordinance be adopted vacating subject right-of-way and easements as recommended by the City Plan Commission.
