HomeMy WebLinkAboutOrdinance 18880-10-2009Ordinance Nv.18880-10-2009 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT 4F $168,338.OO, UPON RECEIPT 4F THE FISCAL YEAR 2010 RECOVERY ACT STATE JUSTICE GRANT FROM THE QFFICE 4F THE G4VERN~R'S CRIMINAL JUSTICE DIVISION FOR THE PURPQSE 4F PURCHASING EQUIPMENT T4 ASSIST IN TARGETING VIOLENT SERIAL OFFENDERS; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIER ORDINANCES AND REPEALING ALL PRIDR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FART IN~RTH, TEXAS: SECTION 1. That in addition to those amounts allocated tv the various City departments for Fiscal Year 2009-2414 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of $168,338.00, upon receipts of the Fiscal Year 2010 Recovery Act State Justice Grant from the Office of the Governor's Criminal Justice Division, for the purpose of purchasing equipment to assist in targeting violent serial offenders. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of ordinance No.18809 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Ratify the application for and authorize the acceptance of, if awarded, the Fiscal Year 2010 Recovery Act: State Justice Assistance Grant for $168,338.00 in funding from the Office of the Governor's Criminal Justice Division; 2. Adopt a resolution authorizing the application for and acceptance of $168,338.00 in grant funds from the Fiscal Year 2010 State Justice Assistance Grant and the making of assurances required by the Criminal Justice Division of the Governor's Office; and 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund in the amount of $168,338.00 upon receipt of the grant. DISCUSSION: The Office of the Governor, Criminal Justice Division, publishes funding opportunities to help support law enforcement agencies, prevent and control crime and make improvements in the Criminal Justice System. These grants are awarded under the federal Edward Byrne Memorial Justice Assistance Grant JAG}Program and distributed on a state level through the Gffice of the Governor, Criminal Justice Division ~CJD}. The Police Department is requesting $168,338.00 to purchase equipment to assist in targeting violent serial offenders. The funding will be used to support the department's initiative in identifying violent serial offenders committing rapes and aggravated robberies within the City. The Police Department will use $12,500.00 of the grant funds to purchase geographical profiling software and licensing for seven crime analysts including one year's maintenance and training. An additional $45,338.00 will be used to purchase sex offender electronic palm and fingerprint technology that includes scannin and hoto ra h e ui ment and 50 500.00 will be used to urchase GPS trackin s stems for five police units, interior video cameras, remote control ignition equipment and two laptops for the purpose of monitoring auto theft incidents. This grant funding will enhance Police Department technology in the areas of geographical profiling, sex offender registration and auto theft investigations. The grant requires that the City adopt a resolution which provides assurances that funds will be returned to the Criminal Justice Division, in full, in the event of loss or misuse of Criminal Justice Division grant Logname: 35STATEJAG 10 Page 1 of 2 funds and designates the official authorized to accept, reject, or after the grant after it is awarded.
