AN ORDINANCE ABOLISHING IN THE FIRE DEPARTMENT
SEVEN POSITIONS IN THE CLASSIFICATION OF FIRE
PRIVATE; CREATING IN THE FIRE DEPARTMENT SEVEN
POSITIONS IN THE CLASSIFICATION OF FIRE CAPTAIN;
PROVIDING A SEVERABILITY CLAUSE; AND NAMING AN
EFFECTIVE DATE. -
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION 1.
That seven (7) positions in the classification of Fire
Private in the Fire Department, now vacant, shall be abolished.
SECTION 2.
That seven (7) positions in the classification of Fire
Captain in the Fire Department are hereby created.
SECTION 3.
That if any section, part of a section or provision of
any section of this ordinance shall be held to be void, in-
effective or unconstitutional by a court of competent juris-
diction, the holding of such section, part of a section or
provision of any section to be void, ineffective or un-
constitutional for any cause whatsoever shall in no way
affect the validity of the remaining sections and provisions
of the ordinance, which shall remain in full force and
effect.
SECTION 4.
That this ordinance shall become effective and be in
full force and effect from and after the date of its passage
as provided by law, and it is so ordained.

Last year, during review of the 1975-76 City of Fort Worth Annual Budget
certain reorganizations within the Fire Prevention and Fire Dispatch Divisions
of the Fire Department were discussed with the City Council. To recognize
certain measures of efficiency and economy Council approved the deletion of
seven Fire Captain positions to be replaced with seven positions of lower rank.
At the time of implementation, it was the decision of the Council that the
Fire Captains be deleted by attrition so that no personnel would be adversely _
affected. As of this date, the Fire Department has absorbed three of these
positions through normal turnover. While waiting for the attrition to
materialize the Fire Department has been using the incumbent Fire Captains as
vacation relief.
Consistent with the approved reorganization plan the seven affected Fire
Captain positions were deleted from the 1975-76 annual budget and have been
carried as overages. Personnel and budget systems can accommodate the adjust-
ment of various departmental positions within the budget year; however, the
Firemen's and Policemen's Civil Service Statute, Article 1269m, Section 8,
states in part:
The Commission shall provide for the classification of all firemen
and policemen. Such classification shall be provided by ordinance
of the City Council, or legislative body. Said City Council, or
legislative body, shall prescribe by ordinance the number of posi-
tions of each classification.
Therefore, to be consistent with the provisions of Article 1269m, it will be
necessary to establish, by ordinance, positions for the four remaining Fire
Captains.
There currently exists a promotional list for Fire Captains which will expire
on August 18, 1976. This list was established by giving an examination dur-
ing the summer of 1975, prior to the decision to reorganize, which eliminated
the potential for promotion. Due to the phasing in of the reorganization by
attrition, it appears it will be another twelve months before there will be
any additional promotions to Captain.
If the reorganization had not occurred, three Lieutenants now on the promo-
tional list would have been promoted, replacing personnel that have retired.
These officers studied and took the examination in good faith that promotions
would be made. It is thus felt that three additional Captain positions should
be established to avoid any hardship on these three Lieutenants.
All of these additional Captain positions will be assigned to the Vacation
and Sick Leave Relief Pool, replacing Fire Privates. Assigning Captains to
this manpower pool in some cases will result in no additional cost due to
the elimination of the requirement to pay "acting officer pay". Additional
cost will occur when a Captain is replacing a fireman of a lower rank.
It is estimated that the tot.Ll additional cost of this staffing adjustment

will 'be approximately $11,500 until the positions are all absorbed through
attrition which is estimated to occur approximately January, 1978.
From time to time, as other retirements of senior fire officers occur it
will be necessary to amend the ordinance deleting Captain positions and
replacing them with Privates to complete phasing in this reorganization.
Recommendation
It is recommended the City Council approve an ordinance amending the
authorized personnel in the Fire Department by adding seven Fire Captain
positions and deleting seven Fire Private positions.
