HomeMy WebLinkAboutOrdinance 106 ORDINANCE N0._ 0 A%- ordinance providing for the licensing and regulation of carts, wagons, drays and other vehicles engaged in carrying baggage for hirq to or from common carriers in the City##of Fort North, pre- scribing the mode and manner of handling such baggage, and providing penalties for the violation of the terms, conditions and i-equirements ofordinance. a BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF F tT NORTH: Section 1: That hereafter every person, association of persons, firm or corporation who operates uses or conducts for public hire, any cart, wagon, dray or other vehicle within the corporate limits of the City of Fort Worth for the carrying or traftportation of baggage to or from any common carrier, sha.11,before so operating, conducting or using same, p�roftre and obtain a license for such vehicle from the assessor and collector of taxes of said City, and shall pay the sum of 1�� (�,Q1Q,�'��- therefor, and such license shall authori�e the owner thereof to engage in such business for a period of one year from the date of said license. Section 2: The asiYessor and collector 6f taxes shall keep a sufficient number of such license on hand to supply all demand, and upon the issuance of any license, he shall keep and retail 9 , stub which shall contain the number of the license issued, the date thereof, and the name `€+rid residence of the person to whom same is issued. Section 3: Such person, association of persons, firm or corporation shall permanently affix or cause to be affixed upon the bed or body of any such vehicle and over the right front whee , and near the front end of such vehicle, the words "Dense Nn." and thereafter place the number of the license given to such vehicle. -1- �1 -A 7 Such number shall be in figures not less than four Inches in height and proportionately broad. ►� Section 4: The person operating any such vehicle herein named, or the pen in charge of same, shall wear upon the front of his cap or hat, or upon the lapel of his coat, the follDwiz>g label, to-wit: "Licensed." Section 5: The person operating any such vehicle or the person in charge of same, shall supply himself with a sufficient number of duplicate baggage checks, one of which shall be labelled "Strap Check," and the other "Duplicate Claim Check," and each shall bear a corresponding number, and upon receiving baggage for , transportation, he shall attach the strap check to each separate pi-bee of baggage, and shall deliver to the owner of such baggage or the person in charge of same, the duplicate claim check, but in case no such owner or person in charge can be Found, then it shall be sufficient to leave both checks attached to the baggage. Upon the delivery of such articles of baggage to any common carrier, its agents, or employees, such person shall demand a receipt for each article of baggage, and shall not deliver same, without first obtaining a receipt therefor. Section 6: The license dues collected under this ordinance shall be used to pay the expenses of issuing such license, and keeping a record thereof, and the remainder, if any, sh aYl be paid into the City Treasury, to be used for the improvement of the d- streets, avenues and alleys of the City of Fort Worth. .� Section 7: Any person who shall use, operate or con- duct any cart, wagon, dray or other vehicle within the corporate i r limits of the City of Fort Worth, for the carrying and transporta- tion of baggage to or from any common carrier contrary to this ordinance or any of the provisions thereof, or without complying, with all of the regulations, conditions and requirements thereof, ' C shall be guilty of a misdemeanor, and upon conviction,shall be fined in any sum not less than Il.00 nor more than A100..00. , Section 8: Any person, firm or corporation wihv owns any cart, wagon, dray or other vehicle, or who has the care and con- trol of same, and who shall direct, causeM or permit_-tb2 1x$e-or operation of any such vehicle contrary to any of the terms or provisions of this ordinance, or without complying with each and all of the conditions and requirements of same, shall be guilty of a misdemeanor, and upon conviction, shall be fined in any sum not less then $l.00 nor more than ' 100.00. Sectiond9: Upon final conviction of any person, firm or corporation for the second violation of this ordinance or any provision thereof, the license of such person, firm or corporation shall be deemed forfeited, and such license shall become null and void and of to effect, and no other or fit thar proceedings shall be necessary on the part of the City to forfeit same. I hereby certify that the above and foregoing Ordinance was duly preented and unanimously passed by the -Board of Com- miesioners of the 01%y of Fart Worth at a.,#session :hsk*x of said Hoard held duly 6th91909. ` Cit Secretary. .I TO THE HONORABLE MAYOR AIM CITY COM1ISSIOY OF THE CITY OF FORT WORTH, TEXAS: The undersigned Railroad and Railway Companies , entering the city of Porti Worth, by and through their General Passenger Agents, which, for brevity, are hereinafter referred to as petitioners, respectfully represent than there are now engated in the transportation of baggage to and from the Railway stations in the City of Ford Worth, various irresponstble parties, and through the negligence and carelessness of these irrespons1ble parties, the traveling public and railroads are suFrjectLed to a great deal of annoyance and expense. Your petitioners further represent that if all persons engaged in. the handling of baggage to and from the Railway stations in the City of Fort Worth, were under the supervision of the city officials and by proper ordinance required to give the ownerof each piece of baggage received by them for transporta- tion_ a claim check, the same to be in two parts, one part to be given the passengerin the nature of a receipt , and the other portion to be attached to the baggage, as, under this arrangement, the passenger, upon arriving at the Railway station to check the baggage would present the claim check to the Baggage Master, and the piece of baggage could then be easily located and checked out, whereas, under the conditions as they now exist, with but one or two exceptions , baggage is left at the Railway station without any claim check and it is necessary for the Baggage Master to take the passenger to the baggage room and have him identify his own baggage. If it be at night, on account of the similarity of trunks, suit cases, ete. , quite often the passenger identifies the wrong piece of baggage, thus causing considerable delay, annoyance and possible claims. Your petitioners further represent that the Railroads entering this City have for years been handling baggage, endeavor- ing to give satisfaction, and have gone to considerable e;epense and trouble in locating baWa.ge which has been mis-sent, which would have been ubviated if expressmen handling baggage to and from the Railway station were regulated and controlled as hereinbefore: set out. Your petitioners further represent that if such an ordinance as above indicated is passed, the depot officials will supply the various licensed expressmen, free of charge, a supply of claim checks,a proper record beim kept of numbers given each expressman engaged in the handling of baggage, thereby making such expressman or handler responsible for all baggage handled unde=r such checks. WEBREFORE:, your pettitivners pray that your horrorable body, by proper ordinance, provide for the handling of baggage as hereinbefore set forth, and for the imposing of proper penalty, for failure to comply with such ordinance.
