D. 1926, on the Question of the issuance of said bonds hereinbefore mentioned, there was a majority of rotes in favor of the issuance of said bonds; and WSFRRAS, by virtue of said a loot im, said Council is vested with power ind authority by and from the people to issue said bonds for the purposes aforementioned, and to make same valid and binding obligations of the corporate government of the City of Fort Worth; and 'THMMS, it is deemed wise and expedient by the City Council of the City of Fort Worths in the exercise of the dis- cretion relpsed in it by law, that only One Hundred Fifty Thou- sand ($150,000.00) Dollars worth of the authorized issue of Three Hundred Fifty Thousand ($350,000.W) Dollars be issued in bonds at this time; said bonds to be issued being part of Series No. 55 and designated as "Labe ;Orth Bridge Bonds". NOW, THERBFORE, BE IT ORDAINED BY THE CITY COUNCIL OF TSE CITY OF FORT WORM SECTION I. That pursuant to Section 19 of Chapter $KV of the Charter of the City of Fort 17orth, adopted by the qualified voters within the corporate limits of said City on the 11th day of December, A. D. 1924, and the laws and c metitut ion of the State of Texas, and pursuant to a Tote of the resident property taxpaying voters of the City of Fort Worth, at an election held in said City for such purposes an the 10th day of January, A. D. 1928, that the municipal goverment of the City of Fort Worth issue its corporate negotiable coupon bonds in the principal sum of One Hundred Fifty Thousand ($1500000.00) Dollars, out of an authorized issue at said election of Three Hundred Fifty Thousand (PBO.000.00) Dollars, and which author- ized issue is known as Series No. 55 and designated as"Lake Worth Bridge Bonds", and the bonds so to be issued shall be in the denomination of One Thousand ( 11,000,00) Dollars each, dated lky 1, 19283, bearing interest at the rate of four and one-fourth (4*%) per cent per amam, payable semi-annually on the lot day of November and May of each year respectively, both principal and interest of said bonds being payable at the Hanover National Bank in the City of New York, State of New York, the semi-annual int ere st being evidenced by interest coupons attached thereto, all of said bonds to be executed for and on behalf of the City of Fort North by the '.la yor thereof, attested by its City Secretary-Treasurer, with the seal of the City thereon duly impressed, but the interest coupons to be exe- outed with the lithographed facsimile signature of the Ibayor and City Uarstary-Treasurer of the City of Fort Forth, each of said bonds and coupons shall be negotiable and payable to bearer, and said bands shall be numbered in the way and manner hereinafter net out, maturing five (5) years from the date thereof and annual- ly thereafter until the last maturing bond shall become payable within forty (40) years from the date thereof, rind the bonds them- selves, one hundred fifty (150) in number, shall be numbered con- secutively from one (l) to one hundred fifty (150) inclusive, and shall mature in the amounts and manner hereinafter set out; said bands shall be used for the purpose of maki p ti-manuuut improve- ments by constructing and building a bridge across Lake North in said City in the vi ci nit y of what is oD nmo my known as the "Nine Mile Bri dge". D. 19 , together with interest thereon at the rate of four and one-fourth (4 ) per centum per annum, payable semi=annually on the let day of November and May in each year, on presentation and surrender of the annexed interest cou- pons, as they severally fall due. Both the principal anal inter- est of this bond are payable at the office of the Hanover National Bank, in New York City, N. It is hereby '4rthe exA;:assly repreeentsd., recited, and covenanted by the gove:rm--at of the C•_ty of Fort Worth, to and with each and every holder of said oond.a or any one of them, that all acts, conditions and things required by the laws of the State of Texas, and of the Charter and OrdinLno—as of the City of Fort Worth, precedent to and in the issuance of this bond, have been done, have happened, and have been performed in pro- per and lawful time, form and manner as prescribed by law, so as to make this bond *a legal, binding and valid obligation of the City of Fort Worth, and that provision has been made for the levy and collection of a direct annual tax on all taxable property in the City of Fort Worth, and that such` tax has been levied in a sufficient amount for the payment of the principal and inter- est of this bond at the respective maturity dates thereof, and that the total indebtedness of said City, including this bond, and the issue of which it is a component -oast, does not exceed any constitutional or statutory limitation. SECTION III. That the said bonds are hereby authorized to be sold to the best advantage, but in no event shall same be sold for less than par, and the accrued interest to the time of de- livery and the proceeds thereof, to be planed in the Treasury of the City of Fort North and utilized for the special purposes for which they are created. SECTION I9. That for the purpose of creating a sinking fund for the payment and complete extinguiskment of the foregoing bonded debt, prim ipa 1 and interest, and all and every part of same, there is hereby levied and there shall be assessed and collected as provided by law, not apart and appropriated for the said pur- pose, an annual, direct special ad valorem tax for the year 1928, and every successive year thereafter sharing the life of said ba aed. debt, or any part thereof,of .54 cents (or such an amount as may be necessary and adequate, be it more or less) on every One Hund- rod ($100.00) Dollars of property valuation, real, personal ; nd mined, subject to taxation and not exempt therefrom under the Constitution and laws of the State of Texas, situated and owned in the City of Fort North on the 1st day of January 1928, and on the lot day of January of each year thereafter until said debt represented by said bands and oaupon interest notes shall have been fully paid, and if, at any time, such tax should be insuf- fioient, then it shall be the ',itl., of the City Codi], of any other governing body of the City of Fort 'oo rt h, to set apart and appropriate such additional amount of money out of the general revenues of tho said Cit•r, as may be requisite to supply the de- ficienoy until all interest shall have been rid and the sink- ing fund established as required by the Constitution of the State of Texas and the Charter of the City of Fort Worthe SMT ION T. That it shall be the Baty of the City Council of the City of Fort "Vorth and its successors, and of the government of the City of Fort 1or4h, by levying taxes for general purposes for the said City of Fort Worth for the year 1928, and for every successive year during the life of said banded debt or any part thereof, to include in such levy the special tax of .54 cents on the One Hundred ($100.00) Dollars property valuation ( or so much thereof as may be requisite and necessary) provided for in the nest pModing section of t-,is ordinance, and such special tax shall on no accouht whatsoever be displaced therefrom. SMTION VI. That the special tax hereinbefore provided for, when collected, shall be placed and kept i4separat a fund and shall be devoted to the payment of the interest and the extinguiebment of the principal of all rind singular the bonds hereinabove men- tioned as same matures from time to tiry �%nd shall not be use4, applied or diverted to any other purpose or object whatsoever; and the funds derived from said tax shall be held and listed as a separate account on the books of said Cit°. , and the proceeds held and kept by the City Secretary-Treasurer of said City as a separate and distinct account e.nd so specified as such on his books. SROT ION VII. That as soon as convenient after said bonds aball have bden prepared nnd signed in the manner prescribed by the ordinance, they shall be submitted to the Attorney General of the State of Texas, together with a certified copy of this ordinance and a statement of the total bonded indebtedness of the City of Fort Worths, including the bands herein and hereby authorised and the assessed value of the taxable property in said City, for his ap- proval, and none of said bonds shall be negotiated, sold or trans- ferred until the same shall have received the official sanction of the maid Attorney General as prescribed by law, and thereafter said buds shall be placed with the State Comptroller of Public Accounts for' registration. That the City Secretary-Treasurer of the City of Fort Porth, or other lawful custodian of such finds, during the months of October and April of each and every year during the life of said bonds or part thereof, and not later than the 20th day of each of said months, shall transmit sufficient money out of the interest funds hereinbefore created, for the payment of the semi-annual interest accruing on said bads, to the Han- over National Bank of the City of Net York, State of New York, and likewise remittance shall be made in due course to provide for the payment of the principal of any of said bonds in ad- vance of the maturity of same.
