AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF
$69,000.00, SUBJECT To RECEIPT OF A GRANT FROM THE TEXAS
SCHOOL SAFETY CENTER AT TEXAS STATE UNIVERSITY-SAN
MARCOS, FOR THE PURPOSE OF CONDUCTING CONTROLLED
BUYS/STING OPERATIONS OF TOBACCO PERMITTED RETAIL OUTLETS
IN ORDER TO DISCOURAGE THE SALE OF TOBACCO PRODUCTS TO
MINORS; PROVIDING FOR A SEVERABILITY CLAUSE; KING THIS
ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2014-
2015 in the Budget of the City Manager, there shall also be increased estimated receipts and
appropriations in the Grants Fund in the amount of$69,000.00, subject to receipt of a grant from
the Texas School Safety Center at Texas State University-San Marcos, for the purpose of
conducting controlled buys/sting operations of tobacco permitted retail outlets in order to
discourage the sale of tobacco products to minors.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid,
inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or
judgment shall in no way impair the remaining portions, sections, or parts of sections of this
ordinance, which said remaining provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 21457-09-2014 and all other ordinances
and appropriations amending the same except in those instances where the provisions of this
ordinance are in direct conflict with such other ordinances and appropriations, in which instance
said conflicting provisions of said prior ordinances and appropriations are hereby expressly
repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

Ratify Application for and Authorize Acceptance of Grant, if Awarded„ from the Texas School Safety

Execution of Interlocal Agreement with Texas State University-San Marcos to Participate in the Tobacco
Enforcement Program and Adopt Appropriation Ordinance (ALL COUNCIL DISTRICTS)
RECOMMENDATION:
It is recommended that the City Council:
1. Ratify the application for and authorize acceptance of a grant, if awarded, from the Texas School
Safety Center at Texas State niversity.-San Marcos in an arnount not to exceed $699000.00;
2„ Authorize the execution of n Interlocal Agreement with 1 ex as State University-San Marcos to
participate in the Tobacco Enforcement Program„ and
. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Grants Fund in the amount of$69,000.00, upon receipt oft the grant.
DISCUSSION:
The Texas School Safety Center at Texas State University-San Marcos coordinates the Tobacco
Enforcement Program (Prograni The Program awards grants to local law enforcement agencies to
conduct controlled buys and sting operations at tobacco permitted retail outlets. The controlled buys and
sting operations are conducted in order to discourage retailers from selling tobacco products to minors. I
the grant application is approved, Texas State University-San Marcos will grant the City of Fort Worth
(City) an amount up to $69,000.00 to perform the sting operations.
Participation in the Program provides a significant benefit to the community. The Program provides the
Fort Worth Police Department with additional opportunities to enforce laws regarding youth access to
tobacco products. The City will receive an amount of$75.00 per sting operation. The amount received
will offset a portion of the overtime and associated fringe benefits for the officers participating in the
Program.. The City will be responsible for costs associated with vehicle mileage„ fuel, buy money and
stipend for minors participating in the Program. The City's expenses will be covered by various funding
sources, including but not limited to„ Crime Control and Prevention District, asset forfeiture and general
funds. Due to the amount received for each completed sting operation, indurect costs will not be covered
under the grant.
Chapter 791 of the Texas Government Code provides authority for local government units to enter into
Interlocal Agreements fort the performance of governmental functions.

The Financial Management Services Director certifies that upon approval of the above recommendations,
receipt of the grant and adoption of the attached appropriation ordinance, funds will be available in the
current operating budget, as appropriated, of the Grants Fund.
