HomeMy WebLinkAboutOrdinance 16423-05-2005ORDINANCE NO. ~~~~3-OS d~0-S' AN ORDINANCE VACATING AND EXTINGUISHING AN ALLEY BETWEEN LOTS 1-6 AND 7 12, BLOCK 5, SMITH-JONES & DAGGETT ADDITION FROM THE EAST RIGHT-OF WAY LINE OF GALVESTON AVENUE TO THE WEST RIGHT-OF WAY LINE OF HOUSTON STREET BEING APPROXIMATELY 308 FT LONG AND 20 FT WIDE, AND CONTAINING 6,160 SQUARE FEET MORE OR LESS, PROVIDING FOR REVERSION OF FEE IN SAID LAND, PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING UTILITIES, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1. That an approxunately 308 foot and 20 ft wide long alley between Lots 1-6 and 7 12, Block 5 Snuth-Jones & Daggett Addition an addition to the City of Fort Worth, Tarrant County Texas, and as recorded to the Plat Recorded in ARB No 333 13 from the east nght-of--way lure of Galveston Avenue to the west nght-of way line of Houston Street and contauung 6 160 square feet, more or less, and as more specifically described in Attachment A attached hereto and incorporated herein by reference be and the same ~ vacated and extinguished. SECTION 2. That the fee to the land in the above-described vacated alley is hereby released and shall revert to the adjacent owner as provided by law SECTION 3. A twenty foot utility easement will be dedicated on the replat at the location of the alley and said easement shall be retained by the City until such tune all utilities located in that easement are relocated at the owner's expense. SECTION 4. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5. That this ordinance shall take effect upon recording of a replat of lots 1 12, Block 5 Sriuth-Jones and Daggett Addition. DISCUSSION Adoption of the ordinance would vacate the alley between Lots 1-6 and 7 12 Block 5 Smith-Jones 8~ Daggett Addition an addition to the City of Fork Worth Tarrant County Texas as recorded in ARB No 333- 13 from the East Right-of Way line of Galveston Avenue to the west right-of-way line of Houston Street being approximately 308 feet long and 20 feet wide and containing approximately 6 160 square feet, more or less (See attachment A, 1 of 2) and waive the purchase fee of $1 022 56 Mize{I Land Surveying Inc. acting on behalf of John Kenneth Cockrell of Cockrell Printing Company has requested vacation of the above referenced alley in order to create a building lot out of the land as shown on the attached replat of Lot 1 Block 5R, Smith-Jones & Daggett Addition (See Attachment A, page 2 of 2) The Engineering Department has determined that the purchase fee for this a11ey vacation is $1 022 56 The expansion project conforms to the comprehensive master redevelopment in place for the area, a plan that meets the specifications of the ordinance Additionally Fort Worth South. the nonprofit entity whose mission is to revitalize the area, supports the project and the waiver of financial consideration for the alley vacation Reviewing City departments and public utility companies have raised no objections to this request. The City Plan Commission recommended approval of this vacation request at its meeting on March 23 2003 An acceptable replat has been received (See attached) The west 115 feet will be retained as a utility easement as shown on the attachment.
