HomeMy WebLinkAboutOrdinance 16623-09-2005 ORDINANCE NO 1~z3-oy- AN ORDINANCE AMENDING SECTIONS 35 56(g) and 35 56(h) OF CHAPTER 35 OF THE CODE OF THE CITY OF FORT WORTH (1986), AS AMENDED BY REVISING AND ADDING CERTAIN RATES AND CHARGES MAKING THIS ORDINANCE CUMU LATIVE OF PRIOR ORDINANCES REPEALING ALL ORDINANCES AND PROVISIONS OF THE FORT WORTH CITY CODE IN CONFLICT HEREWITH, PROVIDING A SAVINGS CLAUSE, PROVIDING A SEVERABILITY CLAUSE, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH SECTION 1 That Section 35-56(g) of Chapter 35 of the Code of the City of Fort Worth (1986), as amended, is hereby amended to be and read as follows (g) The following schedule of rates per month, or fraction thereof, shall be the charges to all wholesale customers for furnishing water to such customers RATE FOR WHOLESALE WATER SERVICE Volume ($/1 000 gallons)* $ 0 6829 Maximum Day ($/MGD excess) 104,348 00 Maximum Hour ($/MGD excess) 27 043 00 Customer ($/Meter/Month) 25 00 *plus raw water cost RAW WATER SERVICE All use per month $0 6321 per 1 000 gallons inside Tarrant Regional Water Distnct All use per month $0 6775 per 1 000 gallons outside Tarrant Regional Water Distract SECTION Z That Section 35-56(h) of Chapter 35 of the Code of the City of Fort Worth (1986) as amended, is hereby amended to be and read as follows. (h) The following schedule of rates per month, or fraction thereof, shall be the charges to all wholesale customers for furnishing wastewater services to such customers RATE FOR WHOLESALE WASTEWATER SERVICE Volume ($/1 000 gallons) $ 0 8296 BOD ($/pound) 0.2906 TSS ($/pound) 0 1871 Customer ($/month) 75 00 SECTION 3 This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986) as amended, except where the provisions of this ordinance are m direct conflict with the provisions of such ordinance and such Code, m which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 4 It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent ~unsdiction, such unconstitutionality shall not affect any reinaming phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation m this ordinance of any such unconstitutional phrase; clause, sentence, paragraph or section. SECTION 5. This ordinance shall take effect on October 1 2005 APPROVED AS TO FORM AND LEGALITY Assistant Attorney ADOPTED J~PO~P~»~~u' 0~-7 a~r_° EFFECTIVE. ~r,~o~~- I, City of Fort Wor#h, Texas Mayor and Council Communication COUNCIL ACTION Approved on 9/27/2005 Ordinance No 16623-09-2005 DATE Tuesday September 27 2005 LOG NAME 602006 RATES REFERENCE NO G-14936 SUBJECT Adopt Ordinance Revising Wholesale Water Wastewater and Raw Water Service Rates RECOMMENDATION It is recommended that the City Council adopt the attached ordinance which revises wholesale water wastewater and raw water service rates and provides an effective date of billing on or after November 1 2005 for usage of flows from and after October 1 2005 DISCUSSION Each year a wholesale wastewater rate study is prepared in accordance with the terms of the uniform wholesale customer contracts. For fiscal year 2006 the wholesale water cost of service study was completed by Red Oak Consulting (a division of Malcolm Pirnie) The wholesale wastewater cost of service study was performed by Water Department staff based on the wholesale wastewater cost of service study completed by Black & Veatch for fiscal year 2005 The result of these studies indicated the rates, as proposed below will recover the cost of providing wholesale water and wastewater service A joint meeting of the Wholesale Water Advisory Committee and the Wholesale Wastewater Advisory Committee was held July 28 2005 to present the study and the rate requirements. Adjusted for street rental and system loss, the raw water charge to customers is $0 6321 inside the district and $0 6775 outside the district and is a direct `pass through to wholesale water customers.
