HomeMy WebLinkAboutOrdinance 7500 ORDINANCE NO. -7,500 AN ORDINANCE VACATING, ABANDONING AND CLOSING A PORTION OF BUFORD STREET IN THE 1000-1100 BLOCKS, A WIDTH OF 50' AND A LENGTH OF APPROX- IMATELY 190' FROM THE SOUTH LINE OF TRACT 2, MONTGOMERY SURVEY; AND A PORTION OF BERTROSE AVENUE IN THE 3600-3650 BLOCKS A WIDTH OF 50' AND A LENGTH OF APPROXIMATELY 500' ADJACENT TO TRACTS 4 AND 8, MONTGOMERY SURVEY, AND LOTS 13-16, BLOCK 4, ROSE HILL ADDITION, FROM BUNTING AVENUE SOUTHEAST TO THE CLARKE AVENUE-MONTGOMERY STREET-CAMP BOWIE BOULEVARD INTERSECTION; AND VACATE, ABANDON AND CLOSE THE EAST PORTION OF THE ALLEY IN BLOCK 4, ROSE HILL ADDITION, A WIDTH OF 121 AND A LENGTH OF APPROXIMATELY 180' ADJACENT TO LOTS 13-19, BLOCK 4, ROSE HILL ADDITION, FROM THE WEST LINE OF LOTS 13 AND 19, BLOCK 4, EAST TO BERTROSE AVENUE; PROVIDING FOR THE REVERSION OF THE FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING THAT THIS ORDINANCE SHALL BECOME EFFECTIVE IMMED- IATELY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That a portion of Buford Street in the 1000-1100 Blocks, a width of 50' and a length of approximately 190' from the south line of Tract 2, Montgomery Survey; and a portion of Bertrose Avenue in the 3600-3650 Blocks a width of 50' and a length of approximately 500' adjacent to Tracts 4 and 8, Montgomery Survey, and Lots 13-16, Block 4, Rose Hill Addition, from Bunting Avenue southeast to the Clarke Avenue-Montgomery Street-Camp Bowie Boulevard intersection; and the east portion of the alley in Block 4, Rose Hill Addition, a width of 12' and a length of approximately 180' adjacent to Lots 13-19, Block 4, Rose Hill Addition, from the west line of Lots 13 and 19, Block 4, east to Bertrose Avenue be and the same are hereby vacated, abandoned and permanently closed as a street or public thoroughfare and as an alley of any kind or character whatever. SECTION 2. That the fee to the land in the hereinabove described street right-of-way in the 1000-1100 Blocks of Buford Street, the 3600-3650 Blocks of Bertrose Avenue and the alley in Block 4, Rose Hill Addition are hereby released and will revert to the adjacent owners as provided by law, SAVE AND EXCEPT that easements are reserved for any and all existing utilities in- cluding water, sewer, electric, telephone and gas facilities. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage and it is so ordained. Cranz, owner of Lots 15-19, Block 4, Rose Hill Addition, and the Fort Worth Osteopathic Hospital, owner of Lots 13 & 14, Block 4, Rose Hill Addition, and Tracts 4, 6 and 8 of Montgomery Survey, which proposes to vacate Buford Street in the 1000-1100 blocks, a width of 50 feet for a length of approximately 190 feet from the south line of Tract 2, Montgomery Survey, and that portion of Buford Street formerly recommended to be vacated adjacent to Tracts 4, 6 and 8, Montgomery Survey, south to Bertrose Avenue; to vacate Bertrose Avenue in the 3600-3650 blocks a width of 50 feet and a length of approximately 500 feet adjacent to Tracts 4 and 8, Montgomery Survey, and Lots 13-16, Block 4, Rose Hill Addition, from Bunting Avenue southeast to the Clarke Avenue-Montgomery Street-Camp Bowie Boulevard inter- section; and to vacate the east portion of the alley in Block 4, Rose Hill Addition, a width of 12 feet and a length of approximately 180 feet adjacent to Lots 13-19, Block 4, Rose Hill Addition, from west line of Lots 13 & 19 Block 4, east to Bertrose Avenue. The subject rights-of-way are both open and paved. They contain numerous utility lines, including water, sewer, electric distribution, gas mains, and telephone facilities. The City departments and private utility companies responsible for these facilities request that easements be retained for these facilities. This vacation request is proposed in order to implement the plans to revise the Camp Bowie Boulevard-Montgomery Street intersection previously approved by the City Council on November 15, 1976. The City Plan Commission concurs with this plan and recommends that the vacation request be approved subject to the following: 1. Letters are received from representatives of the Alice P. Cranz Estate and the Fort Worth Osteopathic Hospital stating their intention to rezone according to proposed land uses (Z-76-146 should be referenced) and to plat in the near future according to desired exchange of ownership and proposed development plans. The letters should also specify required rights-of-way to be dedicated. 2. The ordinance vacating the subject rights-of-way retains these same rights-of-way as utility easements, unless other arrange- ments are made. 3. Bertrose Avenue is closed to traffic, but only after completion of the Haskell Avenue extension south to Clarke Avenue. 4 � DATE, REFERENCE SUBJECT: Vacation of 1000-1100 Blocks PAGE NUMBER PZ-775 Buford Streets; 3600 -3650-Blocks 2 or 2 2/14/77 (V-77-2) 4. Closure of Bertrose Avenue is by means of curb and gutter at both ends. 5. Additional right-of-way is dedicated through platting for widening Haskell Avenue (20') and Montgomery Street (17') -- include in letter. 6. Easements retained for utilities along former streets are requested for vacation as deemed necessary when abutting property is •replatted. 7. Other easements are provided as required. The City Plan Commission also recommends that the standard replatting requirement be postponed in order that the Council may consider this vacation request concurrently with a rezoning request (Z-76-146) for property located on Clarke Avenue and owned by the Alice P. Cranz Estate. The required letters (Plan Commission condition of approval No. 1) have been received by City Staff and commit the affected property owners to compliance with all seven of the above conditions of approval, as recommended by the Plan Commission. Recommendation It is recommended that an ordinance be adopted as recommended by the City Plan Commission vacating the subject rights-of-way and retaining such rights- of-way as utility easements, with the added stipulation that the subject rights-of-way are not phycially closed until necessary improvements are com- pleted on Haskell Street and Clarke Avenue.
