AN ORDINANCE VACATING, ABANDONING AND CLOSING
A PORTION OF THE NORTH RIGHT OF WAY OF BYERS
AVENUE IN THE 5300 BLOCK ABUTTING BLOCKS F, G,
AND H OF CHAMBERLIN ARLINGTON HEIGHTS, A WIDTH
OF 10' AND A LENGTH OF 349.66' EXTENDING EAST-
WARD FROM THE WEST LINE OF LOT 14, BLOCK F,
ARLINGTON HEIGHTS 1ST FILING; PROVIDING FOR THE
REVERSION OF THE FEE IN SAID LAND; REPEALING
ALL ORDINANCES IN CONFLICT HEREWITH AND PRO-
VIDING THAT THIS ORDINANCE SHALL BECOME EFFECTIVE
IMMEDIATELY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That a portion of the north right-of-way of Byers Avenue
in the 5300 Block abutting Blocks F, G, and H of Chamberlin
Arlington Heights, a width of 10' and a length of 349.66'
extending eastward from the west line of Lot 14, Block F,
Arlington Heights 1st Filing, and being more particularly
described as follows:
Beginning at an axle in place at the southwest
corner of that certain tract of land conveyed to
Highland Park, Inc., by deed recorded in Volume
1936, Page 77, of the Deed Records of Tarrant
County, Texas, said point being in the present
north line of Byers Avenue, and being also the
southeast corner of Lot 3, Fort Worth Country
Club Addition to the City of Fort Worth, and the
southwest corner of Lot 14, Block F, Chamberlin
Arlington Heights, First Filing;
Thence South 89 degrees, 25 minutes, 08 seconds
East with said north line of Byers Avenue, and the
south lines of said Block F, Chamberlin Arlington
Heights and said Highland Park, Inc, tract, 349.41

and parallel with said north line of Byers Avenue
and south line of Block F, Chamberlin Arlington

Thence North 0 degrees, 34 minutes, 52 seconds
East, 10.0 feet to the Place of Beginning, and
containing 3495 square feet, more or less.
be and the same is hereby vacated, abandoned and permanently
closed as a right-of-way for street purposes.
SECTION 2.
That the fee to the land in the above described street
right-of-way is hereby released and will revert to the adjacent
owners as provided by law, SAVE AND EXCEPT THAT easements are
reserved therein for any and all existing utilities.
SECTION 3.
That all ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION 4.
That this ordinance shall take effect and be in full
force and effect from and after the date of its passage and
it is so ordained.

Morgan Capital Corporation, owner of all abutting private property, has
requested that the City vacate extra right of way on the north side of
Byers Avenue in the 5300 block abutting Blocks F, G, and H of Chamberlain
Arlington Heights, a width of 10' and a length of 349,66' extending eastward
from the west line of Lot 14, Block F, Arlington Heights 1st Filing, as
shown on the attached map.
The subject right-of-way consists of surplus parkway on the north side
of Byers Avenue. The City Plan Commission has reviewed this request and
recommends its approval.
Recommendation
It is recommended that an ordinance be adopted vacating the subject
right-of-way as requested.
