HomeMy WebLinkAboutOrdinance 7800 ORDINANCE N0, i;sUCQ AN ORDINANCE EXEMPTING FROM THE TAXES IMPOSED UNDER THE PROVISIONS OF THE LOCAL SALES AND USE TAX ACT (ARTICLE 1066c, TEXAS REVISED CIVIL STATUTES) THE RECEIPTS FROM THE SALE, PRODUCTION, DISTRIBUTION, LEASE OR RENTAL OF, AND THE USE, STORAGE OR OTHER CONSUMPTION WITHIN THE CITY OF FORT WORTH OF GAS AND ELECTRICITY FOR RESIDENTIAL USE; DIRECTING THE CITY SECRETARY TO FORWARD A COPY OF THIS ORDINANCE TO THE COMPTROLLER OF THE STATE OF TEXAS; AND NAMING AN EFFECTIVE DATE. WHEREAS, the Legislature of the State of Texas has, by amending the Local Sales and Use Tax Act (Article 1066c, Texas Revised Civil Statutes) , authorized the governing bodies of cities, which had adopted a local sales and use tax, to exempt from such local taxes the receipts from the sale, production, distribution, lease or rental of, and the use, storage or other consumption within the City, of gas and electricity for resi- dential use; and WHEREAS, the electorate of the City of Fort Worth has previously adopted such a local sales and use tax but the City Council now deems it expedient to eliminate the same to the extent authorized by the Legislature; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH: SECTION 1. That all receipts from the sale, production, distribution, lease or rental of, and the use, storage or other consumption within the City of Fort Worth of gas and electricity for residential use as the same is defined in Article 1066c, Texas Revised Civil Statutes, as amended, are hereby exempt from the City's local sales and use tax. SECTION 2. That the City Secretary is hereby directed to forward a copy of this ordinance to the Comptroller of the State of Texas by United States registered or certified mail immediately upon its passage, and in no event later than September 10, 1978. SECTION 3. That this ordinance shall be in full force and effect from and after October 1, 1978, except that the exemption does not apply to the sales of gas and electricity for residential use made during a retailer's regular monthly billing period for a consumer if the regular monthly billing period for the consumer begins before October 1, 1978, but shall apply to each regular monthly billing period beginning of or after October 1, 1978, and it is so ordained.
