HomeMy WebLinkAboutOrdinance 5906 ORDINANCE NO. y� AN ORDINANCE PROVIDING THAT THE TWENTY FOOT ALLEY ALONG LOTS 9 AND 17, BLOCK 10, WEISENBERGER ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, BE ABANDONED, VACATED AND CLOSEDF PROVIDING FOR THE RE- VERSION OF THE INTEREST OF THE CITY OF FORT WORTH IN SAID LAND) REPEALING ALL ORDINANCES IN CONFLICT HERE- WITHi AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXASs SECTION 1. That the twenty foot alley along Lots 9 and 17, Block 10, Weisenberger Addition to the City of Fort Worth, Tarrant County, Texas, be and the same is hereby vacated, closed and permanently abandoned as an alley or public thoroughfare of any kind or character whatever. SECTION 2. That the interest of the City of Fort Worth in the fee to the land in said portion of the alley is hereby released and shall revert to the adjacent owner of the fee as provided by law, save and except that an easement is reserved for existing Utilities. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage. S. Goold, owner of adjoining property, has requested the vacation of the 20 foot alley, not open on the ground, along Lots 9 and 17, Block 10, Weisenberger Addition, as shown on the attached plat. Abandonment of the alley will permit its replatting with adjoining property and permit the applicant to expand building area. Adjacent property owners were notified of the proposed closing, and none has voiced an objection to it. City Departments and private utility companies have reviewed the request and have voiced no objection to the proposed vacation; however, the Water Department has requested that the alley be retained as an eastment for existing facilities. The City Plan Commission has reviewed the proposed closing and recommends adopting of an ordinance, that has been prepared, vacating the alley as requested, subject to retaining the alley as an easement for existing utilities. The Applicant has submitted a replat of the alley and the adjoining properties as requested. City Council action on the Plan Commission recommendation is requested. HDM:fk Attach.
