Home My WebLink AboutOrdinance 21843-08-2015 ORDINANCE NO. 21843-08-2015 AN ORDINANCE ADOPTING A PER ACRE CHARGE FOR THE 4,962.03 ACRES SERVED BY CITY AND DEVELOPER INITIATED PROJECT SKYLINE RANCH AND WALNUT CREEK; MAKING THIS ORDINANCE CUMULATIVE OF OTHER ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING A SAVINGS CLAUSE, AND PROVIDING AN EFFECTIVE DATE. WHEREAS, on May 14, 2002, the City Council adopted City of Fort Worth Ordinance No. 15095 providing for the adoption of per acre charges when certain criteria are met; and WHEREAS, on May 20, 2014 the City Council adopted City of Fort Worth Ordinance No. 21251 amending the Ordinance No. 15095 by removing the restrictions of the pipe length or pipe size. WHEREAS, the City of Fort Worth constructed City and developer initiated sewer main under Skyline Ranch Addition, Walnut Creek and such City initiated sewer main are 36-inches, 33-inches, 30-inches in diameter. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. The City Council finds, in accordance with City of Fort Worth Ordinances No. 15095 and No. 21251, the City constructed City initiated sewer main to provide wastewater service to Skyline Ranch and the surrounding area and that such City initiated sewer main are 36-inches, 33-inches, 30-inches in diameter. Further, the City Council finds that these sewer mains will serve a calculated sewer basin area of 4,962.03 acres, Skyline Ranch, Walnut Creek Per Acre Charge Ordinance No. 21843-08-2015 Page 1 of 3 such sewer basin being shown in the attached exhibit. These sewer main are located west of Old Benbrook Rd south of Z Boaz Park continuing west crossing IH 820, running south parallel to Aledo ending at Longvue in Council District Number 3. SECTION 2. The City Council finds that $3,522,019.00 is the Development Cost for the Main, and that $710.00 is the per acre charge to be assessed within the calculated sewer basin. The City Council further finds that per acre charge has been calculated in accordance with the requirements of City of Fort Worth Ordinances No. 15095 and No. 21251. SECTION 3. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (2015) as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 4. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the Skyline Ranch, Walnut Creek Per Acre Charge Ordinance No. 21843-08-2015 Page 2 of 3 City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. The City of Beribrook entered into an Interlocal Agreement (City Secretary Contract No. 27704) with City of Fort Worth to cost participate engineering, construction and related fees on the construction of the 36- L.,mine: 60SKYJANE, t�ANCH SE',WER.PER ACRE CHARGE 11age I of 2 inch Walnut Creek Sanitary Sewer Interceptor along Walnut Creek to service 491 acres in Ben rook. Benbrook's cost participation has been excluded from the per acre charge calculation. These Benbrook properties will not be assessed this per acre charge. These sewer main improvements will serve the Skyline Ranch Addition, Walnut Creek, some properties in Benbrook and other surrounding areas in the basin. The total acres applied for this charge is 4,962.03 acres. The sewer per acre charge is $710.00 per acre in accordance with City Code Section 35-84. This amount will be reimbursed to the Water Department. This sewer main meets the criteria established under the per acre charge policy. The adoption of this charge is in accordance with the City Code and Water Department policies. The sewer main is located in COUNCIL DISTRICT 3, Mapsco 811 H, 72Y, 72Z, 73W, 8 , 8513, 85C, 85D, 85E, 85F, 85G, 85H, 85J, 85K, 85L, 85M, 85P, 85Q, 85R, 86A, 86B, 86C, 86D, 86E, 86F, 86G, 86H, 86J, 6 86M, 86N, 86P, 86Q, 86R, 87A, 7 87J, 87K. FISCAL INFORMATION / CERTIFICATION: The Financial Management Services Director certifies that the establishment of this per acre fee will allow the Water Department to recapture costs associated with the capital investment of sewer lines.
