HomeMy WebLinkAboutOrdinance 7006 ORDINANCE NO. tl 119 y(G AN ORDINANCE DECLARING CERTAIN FINDINGS; PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY CONSIS- TING OF 11 SQUARE MILES OF LAND, WHICH TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS; PROVIDING THAT THE TERRITORY ANNEXED SHALL BEAR ITS PRO RATA PART OF TAXES; PROVIDING THAT THE INHABITANTS THEREOF SHALL HAVE ALL THE PRIVILEGES OF ALL CITIZENS OF FORT WORTH, TEXAS; PROVIDING THAT THIS ORDINANCE SHALL AMEND EVERY PRIOR ORDINANCE IN CONFLICT HEREWITH; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES NOT IN DIRECT CONFLICT; PROVIDING A SEVERABILITY CLAUSE AND NAMING AN EFFECTIVE DATE. WHEREAS, a public hearing before the City Council of Fort Worth, Texas, wherein all interested persons were provided with an opportunity to be heard on the proposed annexation of the territory hereinafter described, was held at the City Council Chamber in the Municipal Office Building of Fort Worth, Texas, on the 6th day of May, 1974, which date is not more than twenty (20) days nor less than ten (10) days prior to the institution of annexation proceedings; and WHEREAS, the population of the City of Fort Worth, Texas, is in excess of 400,000 inhabitants; and WHEREAS, the corporate area of the City of Fort Worth, Texas, was 235.9 square miles on January 1, 1974; and WHEREAS, the hereinafter described territory lies within the exclusive extraterritorial jurisdiction of the City of Fort Worth, Texas; and WHEREAS, the hereinafter described territory lies adjacent to and ad- joins the City of Fort Worth, Texas; and WHEREAS, the territory hereinafter described contains approximately 11 square miles of land; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTIO14 1. THAT the following described land and territory, lying adjacent to and adjoining the City of Fort Worth, Texas, is hereby added to and annexed to the City of Fort Worth, Texas, and said territory hereinafter described shall here- after be included within the boundary limits of the City of Fort Worth, Texas, and the boundary limits of said City, at the various points contiguous to the areas hereinafter described, are altered and amended so as to include said area within the corporate limits of the City of Fort Worth, Texas, to wit: -1- BEING all, or a portion of, the Spencer Townsen Survey, Abstract No. 1554, J. THAT the foregoing-described territory and the area annexed shall be a part of the City of Fort Worth, Texas, and the property so added hereby shall bear its pro rata share of the taxes levied by the City of Fort Worth, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions and regula- tions of the City of Fort Worth, Texas. SECTION 3. THAT this ordinance shall and does hereby amend every prior ordinance in conflict herewith, but as to all other ordinances or sections of ordinances not in direct conflict herewith this ordinance shall be and is hereby made cumu- lative. SECTION 4. THAT if any section, subsection, clause, sentence, phrase, or word of this ordinance is for any reason held void or unconstitutional, by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining sections, subsections, clauses, sentences, phrases, or words except as the same are inseparable from and indispensable to the remaining portions of the ordinance. SECTION 5. THAT this ordinance shall be in full force and effect from and after the date of its passage on first reading and publication and its passage on second reading as provided for in Section 40 of Chapter XXVIII of the Charter of the City of Fort Worth and it is so ordained. BATEMAN City Secretary City of Fort Worth, Texas -4 up" City of Fort Worth, Texas BAILIFF Mayor and Council Communication ORAHAP !1~N DATE REFERENCE SUBJECT: Annexation of 11 Square Miles - PAGE NUMBER Northwest (quadrant of Tarrant 2 OVARDI 3/25/74 PZ-605y Count 'Since May of 1972 the City Plan Commission has had under study the question of annexation in the northwest quadrant of Tarrant County, including the area in which Lake Country Estates is located. Subsequently, in connection with the adoption of the District E Plan and the denial on January 15, 1973, of a petitioned Municipal Utility District, the Council requested that the Plan Commission submit a specific recommendation on annexation. The Plan Commission vgted on January 30, 1974, to recommend to the City Council that 11 square miles of land in the northwest quadrant of Tarrant County, including approximately 2.8 square miles within the Lake Country Estates development, be annexed to Fort Worth. The Plan Commission's annexation recommendation is based on the City Council's "Policy for Review of Annexation and Deannexation Requests" and "Resolution on Planning for Growth", copies of which were supplied with Informal Report No. 2299. Following the guidelines outlined in these documents, the Plan Commission determined that the recommended area should be annexed in order to: 1) Prevent the spread of undesirable and low quality development and proliforation of incompatible land uses, 2) Guide the future development of the area in an orderly manner, 3) Provide Fort Worth services to developed and developing areas, 4) Forestall possible excessive expenditure of public funds to bring the area up to City standards when it was eventually annexed. Attached is a copy of a letter dated January 12, 1973, from Baker-Crow Company requesting that the Jenkins Ranch area not be annexed prior to its development. The Plan Commission took this request into consideration, but reasoned that the request should not be approved since the property has been owned by this company since 1968 and no development has been forthcoming to date. State law and the City Charter authorize annexation proceedings after giving notification by legal advertisement, without individual notification of pro- perty owners within the area proposed for annexation. This practice was followed until approximately two years ago, when the Council instructed that individual notices be sent. During the past two years, few and relatively small annexations have been made, and it was possible to follow this procedure without creating undue expense and delay. In view of the large area involved in the proposed annexation and the intensive news coverage that has been given to this issue, it is proposed that individual notification not be made. In this regard, we wish to assure you and the City Council that our company has no interest in the resolution of this question and has no plans to apply for a municipal utility district for its development of the Jenkins Ranch property; however, we are concerned with any decision the City makes as to the annexation of the property located in this general area. As you know, in 1968, our company acquired the Jenkins Ranch property which consists of 2 ,400 acres in the Lake Worth area. Although as of this date no definitive plan has been agreed upon with regard to the development of this property, it is our company' s intention to devise, in cooperation with the City of Fort Worth, a thoughtful and professional plan for the overall development of the Jenkins Ranch property which will make this development into an area in which we can all take considerable pride. Since the beginning of our involvement with this property, we have enjoyed a close working relationship with the City of Fort Worth, and particularly the Department of Planning. Over the years we have on several occasions worked with your Department and other departments of the City on street plans , land use planning, and other general planning matters with regard to this property. Our most recent work with you was in 1971 in the development of your Northwest Sector Plan. We have found that the close working relationship we have developed with the City of Fort Worth has been both helpful and beneficial to all parties and we pledge to you our continued cooperation as the plans for the Jenkins Ranch development take shape. Such a plan of gradual annexation provides the best opportunity for planned professional development of this property. The financial impact of an immediate annexation of all the Jenkins Ranch property would force our company into adopting a more rapid plan of development which would not afford the time we think is necessary for the proper planning that we wish to incorporate into this project. Therefore, we are hopeful that regardless of the City' s decision with regard to Lake Country Estates ' municipal utility district application, that the City will continue to be agreeable to a plan of annexation for the Jenkins Ranch property which will permit annexation of this property by stages based on orderly development of the property. A history of the actions taken to date on the annexation of the Eleven Square Mile Area and a possible schedule for future actions by the City Council are shown as follows: On March 28, 1974, the notice of a public hearing on the con- templated annexation of the Eleven Square Mile Area was published in the Fort Worth Star-Telegram. On April 15, 1974, the public hearing on annexation was conducted by the City Council. No action was taken and the hearing was not closed. On May 6, 1974, the continued public hearing was resumed, the public hearing was closed and the staff was directed to proceed with the annexation. In addition, on May 6, 1974, the staff was directed to provide information to the City Council by June 3, 1974, with respect to the cost of the Lake Country Estates water and sewage systems, source of funding for the possible purchase of the systems and a timetable for the furnishing of City water and sanitary sewer service to the area. Also, tips City Council directed that M&C G-2347 dated February 11, 1974, "Petition for Creation of Municipal Utility District" be placed on the agenda for June 10, 1974, for reconsidera- tion. On May 20, 1974, the annexation proceedings of the Eleven Square Mile Area was instituted by the adoption of Ordinance No. 7006, annexing the area on first reading and the staff was instructed to delay publication of the ordinance for 20 days. Statutory Requirements The State Statute governing annexation by cities requires that the annexation proceedings must be brought to completion within 90 days after the date on which the City Council institutes annexation proceedings or the annexation will be null and void. (Annexation proceedings were instituted on May 20, 1974, by the adoption of the annexation ordinance on first reading.) The Charter of the City of Fort Worth requires that an annexation ordinance be adopted on first reading, published one time, and not adopted on second and final reading, until 30 days have elapsed after publication. However, the annexation ordinance cannot be adopted on second and final read- ing because 30 days will not have elapsed since the publication of the annexation Ordinance No. 7006. On June 10, 1974, the annexation ordinance may be published as previously directed by the City Council. On July 15, 1974, the City Council may adopt the annexation Ordi- nance No. 7006 on second and final reading and complete the annexa- tion procedure. This is the earliest possible date to comply with the 30 day requirement following publication of the annexation ordinance. If the action is not taken on annexation Ordinance No. 7006 on July 15, 1974, it may be acted on at a later date provided that favorable action must be taken at the City Council meeting on or before August 12, 1974, or the 90 day statutory requirement will be exceeded. Annexation can be accomplished after August 12, 1974, only by initiating a new annexation proceeding by publishing a notice of a public hearing, conduct- ing the public hearing and adopting an ordinance on first reading, then publishing it and adopting it on second reading. In summary, by publishing the annexation Ordinance No. 7006 on June 10, 1974, as directed by the City Council, the earliest date for adoption of the annexa- tion Ordinance No. 7006 on second and final reading is July 15, 1974, and the latest date is August 12, 1974. For this reason it is proposed that the second and final reading on the annexation of the 11 square mile area will not be placed on the City Council agenda, unless instructed other- wise. Ordinance No. 7006, providing for the annexation of the entire 11 square mile area, was adopted on first reading on May 20, 1974. The annexation ordinance would have to be adopted on second and final reading before August 15, 1974, or the entire annexation proceeding would be null and void under the 90-day limitation provision of the State law. Other Development Activity Adjacent To And In The General Area Recently Considered For Annexation I. Jinkens Ranch Area - The owners have developed a land use plan for this area, have a market survey underway and have begun preliminary engineering investigations prior to determining a development sequence. They anticipate it will be four or five months before they determine which portion of their property will be developed first and for which they will then seek approval from the City prior to beginning actual development in 1975. The owners have again requested that this area not be considered for annexation until they have completed the necessary studies to determine their development sequence and that when annexation occurs, that it be handled incrementally based on their planned development sequence. II. Request for annexation of 705 acres received from Dennis Hopkins, dated June 10, 1974, and referred to the staff by the City Council on June 12, 1974, and his subsequent letter of June 16, 1974, re- affirming his request - the staff is reviewing this request as an independent annexation request and will report its findings and recommendations at the July meeting to the City Plan Commission. III.
