HomeMy WebLinkAboutIR 2331 INFORMAL REPORT TO CITY COUNCIL MEMBERS No. 2331 ��aTtAco IO�J}R(�TTo the Mayor and Members of the City Council May 29, 1974 Subject: SCHEDULE FOR ANNEXATION OF ELEVEN SQUARE MILE AREA IN NORTHWEST to 7 3 QUADRANT On May 20, 1974, the City Council adopted Ordinance No. 7006 annexing the Eleven Square Mile Area in the Northwest Quadrant on first reading and directed the staff to delay its publication for twenty days. A history of the actions taken to date on the annexation of the Eleven Square Mile Area and a possible schedule for future actions by the City Council are shown as follows: On March 28, 1974, the notice of a public hearing on the con- templated annexation of the Eleven Square Mile Area was published in the Fort Worth Star-Telegram. On April 15, 1974, the public hearing on annexation was conducted by the City Council. No action was taken and the hearing was not closed. On May 6, 1974, the continued public hearing was resumed, the public hearing was closed and the staff was directed to proceed with the annexation. In addition, on May 6, 1974, the staff was directed to provide information to the City Council by June 3, 1974, with respect to the cost of the Lake Country Estates water and sewage systems, source of funding for the possible purchase of the systems and a timetable for the furnishing of City water and sanitary sewer service to the area. Also, tips City Council directed that M&C G-2347 dated February 11, 1974, "Petition for Creation of Municipal Utility District" be placed on the agenda for June 10, 1974, for reconsidera- tion. On May 20, 1974, the annexation proceedings of the Eleven Square Mile Area was instituted by the adoption of Ordinance No. 7006, annexing the area on first reading and the staff was instructed to delay publication of the ordinance for 20 days. Statutory Requirements The State Statute governing annexation by cities requires that the annexation proceedings must be brought to completion within 90 days after the date on which the City Council institutes annexation proceedings or the annexation will be null and void. (Annexation proceedings were instituted on May 20, 1974, by the adoption of the annexation ordinance on first reading.) The Charter of the City of Fort Worth requires that an annexation ordinance be adopted on first reading, published one time, and not adopted on second and final reading, until 30 days have elapsed after publication. However, the annexation ordinance cannot be adopted on second and final read- ing because 30 days will not have elapsed since the publication of the annexation Ordinance No. 7006. On June 10, 1974, the annexation ordinance may be published as previously directed by the City Council. On July 15, 1974, the City Council may adopt the annexation Ordi- nance No. 7006 on second and final reading and complete the annexa- tion procedure. This is the earliest possible date to comply with the 30 day requirement following publication of the annexation ordinance. If the action is not taken on annexation Ordinance No. 7006 on July 15, 1974, it may be acted on at a later date provided that favorable action must be taken at the City Council meeting on or before August 12, 1974, or the 90 day statutory requirement will be exceeded. Annexation can be accomplished after August 12, 1974, only by initiating a new annexation proceeding by publishing a notice of a public hearing, conduct- ing the public hearing and adopting an ordinance on first reading, then publishing it and adopting it on second reading. In summary, by publishing the annexation Ordinance No. 7006 on June 10, 1974, as directed by the City Council, the earliest date for adoption of the annexa- tion Ordinance No. 7006 on second and final reading is July 15, 1974, and the latest date is August 12, 1974.
