HomeMy WebLinkAboutOrdinance 7306 ORDINANCE NO. __7 50 AN ORDINANCE PROVIDING THAT THE NORTH-SOUTH ALLEY ADJACENT TO LOT 41, IN BLOCK 9, SOUTH SIDE ADDITION, BE VACATED, ABANDONED AND CLOSED; PROVIDING FOR THE REVERSION OF THE FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING THAT THIS ORDINANCE SHALL BECOME EFFECTIVE IMMEDIATELY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the north-south alley adjacent to Lot 41, in Block 9, South Side Addition, a width of 10' and a length of 95' from West Kellis Street north to the south line of the east-west alley, be and the same is hereby vacated, closed and perman- ently abandoned. SECTION 2. That the fee to the land in the above described vacated alley is hereby released and will revert to the adjacent owners as provided by law, save and except that easements are reserved therein for any and all utilities. SECTION 3. All ordinances or parts of ordinances in conflict here- with are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage and it is so ordained. APPROVED AS TO FORM AND LEGALITY S. G. City of bort Worth, Texas BAILIFF PAIGE IL ff mayor and Council Communication QRAIIAM JLccu HUMAN Rob SON DATE REFERENCESUBJECT: Alley Vacation in Block 41, PAGE DAMSa NUMBER South Side Addition (V-75-56) 1 x%1/76 PZ-722 I of M�LKEB WOOD Jim Bridges, owner of Lot 41, Block 9, South Side Addition, with consent of M-K-T Railroad, has requested that the City vacate that portion of the WALLS north-south alley in Block 41, South Side Addition, a width of 10 feet LUKE and a length of 95 feet from West Kellis Street north to the south line of the east/west alley, as shown on the attached map. The subject right-of-way, acquired by dedication, is paved and used as part of the adjoining parking lot, and contains storm drain and sanitary sewer facilities. The agencies responsible for these facilities request the vacated right-of-way be reserved as a utility easement. Reviewing City departments and private utility companies have no objections to this request provided a satisfactory replat of the vacated right-of-way is provided incorporating the vacated right-of-way and designating it as a utility easement. The City Plan Commission has reviewed this request and recommends that an ordinance be adopted vacating subject alley right-of-way as requested. A satisfactory replat has been submitted to the City staff. Recommendation It is recommended that an ordinance be adopted vacating alley right-of-way as recommended by the City Plan Commission.
