HomeMy WebLinkAboutOrdinance 7506 ORDINANCE NO. -75C)6:, AN ORDINANCE AMENDING ORDINANCE NO. 7478 PASSED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, AUTHORIZING THE ISSUANCE OF CITY OF FORT WORTH REFUNDING BONDS, SERIES 1977C, I14 THE PRI14CIPAL MIOUI4T OF $3,400,000 WHEREAS, on January 12, 1977, the Citv Council of the City of Fort Worth, Texas, passed an ordinance authorizing the issuance of City of Fort Worth Refunding Bonds, Series 1977C, in the principal amount of $3,400,000, being ordinance number 7478, and WHEREAS, said City Council deems it advisable to amend said ordinance to change the redemption date of the Warrants being refunded by the proposed bonds; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: 1. That SECTION 1 of ordinance number 7478, passed by said City Council on January 12, 1977 is hereby amended to read as follows: "SECTION 1. " (a) That the Warrants described in the second 'WHEREAS' of the preamble hereof are hereby called for redemp- tion, and shall be redeemed, prior to maturity, on March 8, 1977, at The Fort Worth National Bank, Fort Worth, Texas, the paying agent for said Warrants. " (b) That an appropriate written Notice of Redemption of said Warrants shall be delivered to The Fort Worth National Bank, Fort Worth, Texas, at least ten days prior to the date fixed for redemption. " (c) That the par amount of the bonds herein authorized shall be deposited with the State Treasurer in accordance with Vernon's Article 717K. "It is hereby officially found and determined that said par amount, together with other funds lawfully available to the City for such purpose, all of which will be deposited with The Fort Worth National Bank, Fort Worth, Texas, will be sufficient to pay the par value, plus accrued interest to the date of redemption, of the Warrants called for redemption herein. " 2. That all other provisions of said ordinance passed on January 12, 1977, not hereby expressly amended shall remain in full force and effect. 3. That it is officially found and determined that a case of emergency or urgent public necessity exists which requires the holding of the meeting at which this ordinance is passed, such emergency or urgent public necessity being that the issuance of the bonds which were authorized by the ordinance being amended is needed in order to refund the City's outstanding Warrant indebtedness, and it is required that it be done immediately and that said meeting was open to the public, and public notice of the time, place and purpose of said meeting was given, all as required by Vernon's An tared Civil Statutes, Article 6252-17. The City Council of said City convened in REGULAR MEETING ON THE 28TH DAY OF FEBRUARY, 1977, at the City Hall, and the roll was called of the duly constituted officers and members of said City Council, to-wit: Clif Overcash, Mayor Jack 11. Green, City Secretary Joe Bruce Cunningham Woodie W. Woods Jim Bradshaw Richard C. Newkirk John J. O'Neill Henry A. Meadows Hugh Parmer Mrs. Margret Rimmer S. G. Johndroe, Jr. , City Attorney and all of said persons were present, except the following absentees: thus constituting a quorum. Whereupon, among other business, the following was transacted at said Meeting: a written ORDINANCE AMENDI14G ORDINANCE AUTHORIZING THE ISSUANCE OF BONDS was duly introduced for the consideration of said City Council and read in full. It was then duly moved and seconded that said Ordinance be passed; and, after due discussion, said motion, carrying with it the passage of said Ordinance, prevailed and carried by the following vote: AYES: All members of said City Council shown present above voted "Aye". NOES: None. 2. That a true, full, and correct copy of the aforesaid Ordinance passed at the Meeting described in the above and fore- going paragraph is attached to and follows this Certificate; that said Ordinance has been duly recorded in said City Council's minutes of said Meeting; that the above and foregoing paragraph is a true, full, and correct excerpt from said City Council's minutes of said Meeting pertaining to the passage of said Ordi- nance; that the persons named in the above and foregoing para- graph are the duly chosen, qualified, and acting officers and members of said City Council as indicated therein; that each of the officers and members of said City Council was duly and suffi- ciently notified officially and personally, in advance, of the time, place, and purpose of the aforesaid Meeting, and that said Ordinance would be introduced and considered for passage at said Meeting, and each of said officers and members consented, in ad- vance, to the holding of said Meeting for such purpose; and that said Meeting was open to the public, and public notice of the time, place, and purpose of said meeting was given, all as re- quired by Vernon's Ann. Civ. St. Article 6252-17. 3. That the Mayor of said City has approved, and hereby approves, the aforesaid Ordinance; that the Mayor and the City Secretary of said City have duly signed said Ordinance; and that the Mayor and the City Secretary of said City hereby declare that their signing of this Certificate shall constitute the signing of the attached and following copy of said Ordinance for all pur- poses.
