AN ORDINANCE DECLARING CERTAIN FINDINGS; PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS, AND THE ANNEXATION OF 120 ACRES (0.188 SQUARE MILES) OF LAND, MORE OR LESS, WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF FORT WORTH, TEXAS; PRO- VIDING THAT THE TERRITORY ANNEXED SHALL BEAR ITS PRO RATA PART OF TAXES; PROVIDING THAT THE INHABITANTS THEREOF SHALL HAVE ALL THE PRIVILEGES OF ALL THE CITIZENS OF FORT WORTH, TEXAS; PROVIDING THAT THIS ORDINANCE SHALL AMEND EVERY PRIOR ORDINANCE IN CON- FLICT HEREWITH; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES NOT IN DIRECT CONFLICT; PROVIDING FOR SEVERABILITY AND NAMING AN EFFECTIVE DATE. WHEREAS, a public hearing before the City Council of the City of Fort Worth, Texas, wherein all interested persons were provided with an opportunity to be heard on the proposed annex- ation of the territory hereinafter described, was held at the City Council Chambers in the Municipal Office Building of Fort Worth, Texas, on the 14th day of February, 1978, which date is not more than twenty (20) nor less than ten (10) days prior to the institution of annexation proceedings; and WHEREAS, notice of such public hearing was published prior thereto in a newspaper having general circulation in the City of Fort Worth, Texas, and in the hereinafter described territory on the 3rd day of February, 1978, which date was not more than twenty (20) nor less than ten (10) days prior to the date of the public hearing; and WHEREAS, the population of the City of Fort Worth, Texas was in excess of 367,000 inhabitants on January 1, 1963 and in excess of 400,000 inhabitants on January 1, 1978; and WHEREAS, the corporate area of the City of Fort Worth, Texas was 152.580 square miles on January 1, 1963 and was 241.838 square miles on January 1, 1978; and WHEREAS, the hereinafter described territory lies within the exclusive extraterritorial jurisdiction of the City of Fort Worth, Texas; and WHEREAS, the hereinafter described territory lies adjacent to and adjoins the City of Fort Worth, Texas; and -1- WHEREAS, the hereinafter described territory contains 120 acres (0.188 square miles) of land, more or less; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the following described land and territory lying adja- cent to and adjoining the City of Fort Worth, Texas, is hereby added to and annexed to the City of Fort Worth, Texas, and said territory hereinafter described shall hereafter be included within the boundary limits of the City of Fort Worth, Texas, and the present boundary limits of said City, at the various points con- tiguous to the area hereinafter described, are altered and amended so as to include said area within the corporate limits of the City of Fort Worth, Texas, to-wit: BEING 120 acres, located in Tarrant County, Texas, comprising a strip of land 500 feet in depth, adja- cent and contiguous to and South from West Cleburne Road (County Road No. 1054) and extending from McCart Street on the East to the Westerly West Line of the Isabel Flores Survey, Abstract No. 507, on the West, about 9 miles Southwesterly from the Tarrant County Courthouse, and being more particularly described by metes and bounds as follows: BEGINNING at a point for corner in the present Fort Worth City Limit Line, which point for corner is the Southeast corner of the Ellis Littlepage Survey, Abstract No. 971. THENCE North 89 Degrees-43 Minutes West, along and with a property line lying in County Road No. 1054 (West Cleburne Road) , 2,977.2 feet to a point for corner. THENCE South No Degrees-17 Minutes West 25 feet to a point for corner in the South right-of-way line of West Cleburne Road (County Road No. 1054) . THENCE Westerly, along and with the South right-of- way line of West Cleburne Road (County Road No. 1054) with its meanders, 7,250 feet, more or less, to a point for corner in the survey line between I. Flores Survey, Abstract No. 507 and the John Van Lent Sur- vey, Abstract No. 1871. THENCE South No Degrees-02 Minutes 13 Seconds East, along and with the East line of the Van Lent and the T. &. P. RR Company Survey, Abstract No. 1576, and along and with the West line of Isabel Flores and W. W. Wheat Surveys produced South, a distance of 500 feet to a pont for corner. THENCE East, North, and East, along and with a line 500 feet South, from and parallel to the present Fort Worth City Limit Line hereinbefore described. -2- THENCE North, No Degrees-44 Minutes East, along and with a property line lying in County Road No. 1054 (West Cleburne Road) produced South, to the point of beginning and containing 120 acres of land. SECTION 2. That the above described territory is shown on Exhibit Map A which is attached hereto and expressly incorporated herein by reference for the purpose of illustrating and depicting the loca- tions of the hereinabove described territory. SECTION 3. That the above described territory and the area annexed shall be part of the City of Fort Worth, Texas, and the property so added hereby shall bear its pro rata part of the taxes levied by the City of Fort Worth, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolu- tions and regulations of the City of Fort Worth, Texas. SECTION 4. That thereafter the City Limit Line of Fort Worth shall be. A part of the John M. Pickett Survey, Abstract No. 1238, Isabel Flores Survey, Abstract No. 507, and Puerta Tierra Irrig. Co. Survey, Abstract No. 1831, Tarrant County, Texas, and being more particularly described as follows: Beginning at a point for corner in the Southeast corner of the Ellis Littlepage Survey, Abstract No. 971. Thence South, No Degrees-44 Minutes West, along and with a property line lying in County Road No. 1054 (West Cleburne Road) produced South, a distance of 500 feet to a point for corner. Thence West, South, West, along and with a line 500 feet South from and parallel to a line which has the following bearings: Thence North 89 Degrees-43 Minutes West, along and with a property line lying in County Road No. 1054 (West Cleburne Road) , which line begins at the Southeast corner of the Ellis Littlepage Survey, Abstract No. 971, for a distance of 2,977.2 feet to a point for corner. Thence South No Degrees-17 Minutes West 25 feet to a point for corner in the South right-of-way line of West Cleburne Road (County Road No. 1054). -3- Thence Westerly, along and with the South right-of-way line of West Cleburne Road (County Road No. 1054) with its meanders, 7,250 feet, more or less, to a point for corner in the survey line between I. Flores Survey, Abstract No. 507, and the John Van Lent Survey, Abstract No. 1871. Thence North No Degrees-02 Minutes 13 Seconds West, along and with the East line of the Van Lent and the T. & P. SECTION 5. That this ordinance shall and does amend every prior ordi- nance in conflict herewith, but as to all other ordinances or sections of ordinances not in direct conflict, this ordinance shall be, and the same is hereby made cumulative. SECTION 6. That it is hereby declared to be the intent of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be de- clared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any unconstitutional phrase, clause, sen- tence, paragraph or section. Current State law requires that any area annexed to the City, whether publicly or privately owned, be at least 500 feet in width at its narrowest point. The Plan Commission held a public hearing on this proposal on Thursday, May 5, 1977. The four affected property owners were notified by mail of the Plan Commission hearing. One telephone call of inquiry resulted, but there were no objections registered at the public hearing. Development is sparse south of West Cleburne Road, the major land use being agricultural and grazing. Of the three major residences in the area, none are within the 500 foot strip proposed to be annexed. In consideration of the necessity of the City of Fort Worth to have full control over both sides of West Cleburne Road during and after the street reconstruction, the Plan Commission unanimously voted to recommend that the City Council annex the area as proposed. A copy of an exhibit map and a copy of a proposed annexation timetable are attached. Recommendation: It is recommended that the City Council initiate annexation proceedings and authorize and direct the necessary publication and notices for a public hearing to be held on February 14, 1978.
