AN ORDINANCE FINDING THAT CONDITIONS HAVE MATERIALLY CHANGED
IN THE CITY'S REQUIRED PARTICIPATION IN THE BRIDGE REPLACEMENT
PROJECT AT PRECINCT LINE-WALKERS BRANCH SO THAT A PORTION OF
THE FUNDING FOR THIS PROJECT AS ORIGINALLY PROPOSED IN THE 2004
CAPITAL IMPROVEMENT PROGRAM IS UNNECCESARY (BOND ALLOCATION
$1,650,000), AUTHORIZING THE TRANSFER OF $775,000 AVAILABLE FROM THE
PRECINCT LINE-WALKERS BRANCH BRIDGE PROJECT TO THE SOUTH
PIPELINE ROAD BRIDGE PROJECT IN THE AMOUNT OF $125,000, AND THE
CHAPIN ROAD BRIDGE PROJECT IN THE AMOUNT OF $650,000• PROVIDING
THAT THIS ORDINANCE IS CUMULATIVE PROVIDING A SEVERABILITY
CLAUSE, AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, on February 7 2004 the citizens of the city of Fort Worth approved
the 2004 Capital Improvement Program, and
WHEREAS, the 2004 Capital Improvement Program included $1 650 000 for the
replacement of the Precinct Line Walkers Branch Bridge and
WHEREAS, the city's required participation m this bridge replacement project
has been reduced, and
WHEREAS, staff recommends using $775 000 in 2004 Capital Improvement
Program funds that were designated for the Precinct Line-Walkers Branch Bridge Project
for a) the South Pipeline Road Bridge Project in the amount of $125 000 and b) the Chapin
Road Bridge Project in the amount of $650 000
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF FORT WORTH.
SECTION 1
That the City Council finds that conditions have materially changed so that a portion of
funding for the Precinct Line Walkers Branch Bridge Project as included in the 2004 Capital
Improvement Program is no longer necessary
SECTION 2
Therefore, the City Council authorizes the transfer of 2004 Capital Improvement Program
funds in the amount of $775 000 available from the Precinct Lme-Walkers Branch Bridge
Project to the a) South Pipeline Road Bridge Project m the amount of $125 000 and b) the
Chapin Road Bridge Project m the amount of $650 000
SECTION 3
This ordinance shall be cumulative of all provisions of ordinances and of the Code of the
City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are
in direct conflict with the provisions of such ordinances and such Code, m which event
conflicting provisions of such ordinances and such Code are hereby repealed.
.SECTION 4
It is hereby declared to be the intention of the City Council that the sections, paragraphs,
sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause,
sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid
judgment or decree of any court of competent~urisdiction, such unconstitutionality shall not
affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this
ordinance, since the same would have been enacted by the City Council without the
incorporation m this ordinance of any such unconstitutional phrase, clause, sentence, paragraph
or section
SECTION 5
This ordinance shall be in full force and effect upon adoption.

Adopt an Ordinance and Authorize Execution of an Advance Funding Agreement with the Texas
Department of Transportation for the Construction of a New Bridge to Replace the Precinct Line
Road Bridge
RECOMMENDATION
It is recommended that City Council
1 Adopt an ordinance finding that a material change in the City's required participation has occurred with
the bridge replacement project at Precinct Line-Walkers Branch so that a portion of the funding for this
project, as originally proposed in the 2004 Capital Improvement Program is unnecessary (bond
allocation $1 650 000)
2. Authorize the City Manager to utilize funds in the amount of $775 000 available from the Precinct Line-
Walkers Branch Bridge project for the reconstruction of a) the South Pipeline Road Bridge project in the
amount of $125 000 b) the Chapin Road Bridge project in the amount of $650 000' and
3 Authorize the City Manager to execute an Advance Funding Agreement with the Texas Department of
Transportation (TxDOT) for the construction of a new bridge to replace the Precinct Line Road Bridge over
Walkers Branch for an estimated City participation of $1 384 000 00
DISCUSSION
The 2004 Capital Improvement Program (CIP) included funding for the Precinct Line-Walkers Branch
Bridge reconstruction project in the amount of $1 650 000 which was to be used for City participation with
TxDOT on this project.The existing two-lane bridge will be replaced by a five-lane bridge that is 294 feet
long and approximately four feet higher in elevation than the current structure This project will also include
roadway improvements 150 feet north and south of the bridge and the widening and raising of Trinity
Boulevard in the vicinity of the bridge
Bond Funding Of the $1 650 000 bond allocation $5'09 000 was included as 10% match for the City's
participation and an estimate in the amount of $1 141 000 for other eligible and .ineligible costs. However
based on TxDOT's Equivalent Match Program TxDOT will waive the City's 10% match ($509 000) for the
Precinct Line Road Bridge Project if these match funds are used for the replacement of other minor
deficient bridges. By utilizing this option from TxDOT to fund other bridges the City will only be responsible
on the Precinct Line Road-Walkers Branch Bridge project for 100% of all other costs that are deemed
ineligible work. Specifically some of these ineligible costs estimated at $875 000 include channelization
right-of-way acquisition and utility relocation and were also included in the 2004 CIP budget allocation
Thus it is anticipated that $775 000 of the initial $1 650 000 funding allocated in the bond program for
Precinct Line Bridge .project is available for other deficient bridge projects
In the 2004 Capital Improvement Program s Statement of Commitment, the City Council shall have the

right to abandon or modify a project if in the City Council's opinion conditions materially change so that the
project as originally proposed is unwise or unnecessary In that event, the City Council may direct that the
bond proceeds be expended for other projects within the voted purposes of the bonds.
Other Deficient Bridge Projects
On October 22 2002 Council approved an Advance Funding Agreement with TxDOT whereby the state
agreed to construct a new East First Street Bridge (M&C C-19303) Also under the terms of the agreement,
TxDOT waived the City's standard 10% cost participation in the East First Street Bridge project, in lieu of
the City's agreement to replace at our sole expense two minor load-restricted bridges Accordingly
Council approved utilizing the 10% match funding from the East First Street Bridge to supplement previous
bond funding available for two minor bridge projects
Specifically when the agreement was executed the City agreed to reconstruct South Pipeline Road Bridge
over a tributary of the West Fork of the Trinity River at an estimated cost of $ 500 000 and also reconstruct
Chapin Road Bridge over Santa Clara Channel at an estimated cost of $354 000 Subsequently the
estimated costs of these structures have increased South Pipeline Road has increased from $500 000 to
$625 000 and Chapin Road Bridge from $354 000 to $1 004 000 Most of the cost increases are associated
with increased structure size as determined by hydraulic studies unavailable at the time of the original
estimates
Therefore in keeping within the guidelines of the TxDOT's Equivalent Match program City staff
recommends directing the remaining funds in the amount of $775 000 from the Precinct Line Road-Walkers
Branch Bridge project to two additional minor bridge projects, the South Pipeline Road Bridge project
{$125 000) and the Chapin Road Bridge project, ($650 000)
If approved by Council City staff will subsequently present for Council consideration an amendment to the
agreement with TxDOT for minor bridge replacements:
This project is located in Council Districts 3 4 and 5
