AN ORDINANCE PROVIDING APPROPRIATIONS TO PENSION AND RETIREMENT FUNDS OTHER THAN "THE EMPLOYEES' RETIREMENT FUND OF THE CITY OF FORT WORTH, TEXAS," ESTABLISHED BY ORDINANCE NO. 2266, CREATED FOR THE BENEFIT OF PARTICIPATING EMPLOYEES OF THE CITY; PROHIBITING THE PAYMENT BY THE CITY OF ANY CLAIMS FOR BENEFITS UNDER THE FUNDS; DECLARING THIS ORDINANCE TO BE CUMULATIVE OF ALL OTHER ORDINANCES RELATING TO PENSION OR RETIREMENT SYSTEMS; AND PRESCRIBING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in all instances where employees of the City of Fort Worth are members of some duly constituted pension fund other than 'The Employees' Retirement Fund of the City of Fort Worth, Texas," defined in Ordinance No. 2266, and from whose salaries deductions are regularly made by the Commissioner of Accounts for the benefit of said fund or funds, it is here- by directed that amounts equal to the deductions so made shall be appro- priated and paid by the City of Fort Worth to the treasurer and custodian of said fund or funds for the benefit of said employees, provided, however, that the appropriations shall never exceed four per cent (4%) of the salaries of the said employees, respectively. SECTION 2. The City Council hereby expressly declares that it is not intended by this ordinance to create, and it does not create, a pension or retirement fund for the benefit of any person or persons, and that the City of Fort Worth shall never be accountable to any person for any claims or asserted claims for benefits as a result of appropriations for which provision is herein made, but all claims shall be paid exclusively from the fund to which the claimant is a contributing member, as defined in Section 1 of this ordi- nance. SECTION 3. The provisions of this ordinance are hereby declared to be cuma- lative of and in addition to all other ordinances of the City of Fort Worth relating to pension or retirement systems, and shall not be con- strued to repeal said ordinances or any part of them. SECTION 4. This ordinance is hereby declared to be in full force and effect from and after the lat day of January, 1946, and all acts and appropria- tions made prior to this date, in keeping with the provisions of this ordi- nance, are in all things fully ratified and confirmed. 60
