HomeMy WebLinkAboutOrdinance 21875-09-2015 ORDINANCE NO. 21875-09-2015 AN ORDINANCE REPEALING ORDINANCE NOS. 8911, 15477, AND 21675-03-2015 TO DISSOLVE THE FORT WORTH COMMISSION FOR WOMEN; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES AND REPEALING CONFLICTING ORDINANCES; PROVIDING FOR A SEVERABILITY CLAUSE; PROVIDING FOR A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, in 1983, the City Council of the City of Fort Worth ("City Council") established a nine-member Fort Worth Commission on the Status of Women for the purpose of serving in an advisory capacity to the City Council on matters of concern specifically referred to it for study by the City Council (Ordinance No. 8911); and WHEREAS, in 2003, the City Council revised the name of the Fort Worth Commission on the Status of Women to Fort Worth Commission for Women ("Commission"); expanded the membership of the Commission from nine to nineteen; authorized the Commission to study issues important to the community; and added the requirement of an affirmative vote of two- thirds of all members present to approve any matter(Ordinance No. 15477); and WHEREAS, on March 3, 2015, the City Council reduced the membership of the Commission to nine City Council appointees; changed the quorum to five; and changed the voting requirements to a simple majority because the Commission struggled to maintain active membership and to meet as scheduled due to quorum issues (Ordinance No. 21675-03-2015); and WHEREAS, the Commission met five times to discuss the priorities and roles of the Commission and could not establish a purpose that is not already being served by other organizations; and WHEREAS, because the Commission is unable to establish priorities and roles that would allow the Commission to exist as a viable resource for the City Council, it is advisable to dissolve the Commission; NOW, THEREFORE, BE IT ORDAINED Y THE CITY COUNCIL OF THE CITY OF FORT WORTH,TEXAS, THAT: SECTION 1. Ordinance Nos. 8911, 15477, and 21675-03-2015 are hereby repealed in their entirety, and the Fort Worth Commission for Women is hereby dissolved. SECTION 2. This ordinance shall be cumulative of all provisions of ordinances of the Code of the City of Fort Worth, Texas, (2015), as amended, except where the provisions of this ordinance are in direct Ordinance No. 21875-09-2015 Page 1 of 2 conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repeated. SECTION 3. It is hereby declared to be the intention of the City Council that the phrases, clauses, sentences, paragraphs and sections of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4. All rights and remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of the provisions of the Code of the City of Fort Worth, or any other ordinances of the City, that have accrued at the time of the effective date of this ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall not be affected by this ordinance, but may be prosecuted until final disposition by the courts. SECTION 5. All other provisions of the Code of the City of Fort Worth, as amended, shall remain in full force and effect, save and except as amended by this ordinance. SECTION 6. DISCUSSION: The Commission for Women (Commission), originally known as the Commission on the Status of Women, was established r i c o. 8911 in 1983 in order to "act in an advisory capacity to the City Council on matters of concern specifically referred o it for study by the City Council." In 2003, Ordinance . 15477 changed the name of the Commission; increased membership from fine to nineteen members to encourage more opportunity for involvement; n requirement of it i ve vote of two-thir of the members present o approve any matter before the Commission. Even after several meetings, the Commission was still unable o establish priorities and roles that ou allow the Commission to exist as a viable resource for the City Council.
