AN ORDINANCE ORDERING A RUNOFF ELECTION FOR CITY COUNCIL
DISTRICT NO 6 BY THE QUALIFIED VOTERS OF THAT DISTRICT ON JUNE 11
2005 FOR THE PURPOSE OF ELECTING A CITY COUNCIL MEMBER
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS
SECTION 1.
An election. for the purpose of electing City Council members for City Council Districts
Nos. 2, 4 6, 7 & 8 was held on May 7 2005 No candidate m Council District No 6 received a
majority of the total number of votes received by all candidates for the office.
SECTION 2.
That m compliance with the Charter of the City of Fort Worth and m accordance with the
Constitution and laws of the State of Texas, a runoff election be and the same is hereby called
and ordered for June 11 2005 as authorized by Section 2.025 of the Texas Election Code, as
amended, at which election the qualified voters of the Crty Council District No 6 may vote for
the purpose of electing a councilmember from District No 6
SECTION 3.
The candidates m the runoff are the candidates who received the highest and second
highest number of votes m the main election.
SECTION 4.
(a) Robert Parten, Tarrant County Elections Admimstrator shall serve as the early
voting clerk. Mr Parten s official mailing address is.

(b) Marty Hendrix, Crty Secretary of the Crty of Fort Worth, shall serve as chief
deputy early voting clerk.
SECTION 5.
{a) Early voting by personal appearance shall be conducted beginning May 25 2005
and continuing through June 7 2005 at the following locations m the City of Fort Worth.

SECTION 6.
That the Early Voting Ballot. Board is hereby created to process early voting results, and
Jeanne Lyons is hereby appointed as Presiding Judge. The Presiding Judge shall appoint at least
two other members to the Early Voting Ballot Board.
SECTION 7
A. An electronic voting system, as defined m Chapter 121 of the Texas Election Code, shall
be used for voting at the regular polling places at said election and for counting the
ballots and the tabulation of the results. The conduct of the election and the use of the
electronic voting system shall be m accordance with the Texas Election Code.
B The Office of the Tarrant County Elections Administrator Tarrant County Courthouse,
100 Weatherford, Fort Worth, Texas, is hereby established as the Central Counting
Station for the ballots cast m said election.
C Robert Parten, having knowledge and experience m the conduct of elections with the
electronic voting system for which the Central Counting Station is established, and being
a registered voter of the Crty of Fort Worth, is hereby appointed as the Manager of the
Central Counting Station. The Manager shall be m charge of overall administration of
the Central Counting Station and the general supervision of the personnel working at the
Station.

D Christopher Walker and Gayle Hamilton, being trained in the operation of the automatic
tabulating equipment installed at the Central Counting Station, are hereby appointed
Tabulation Supervisors. The Tabulation Supervisors shall be m charge of the operation
of the automatic tabulating equipment.
E. The appointment of Leo Angell as Assistant to the Tabulation Supervisors is hereby
approved. He shall assist the Tabulation Supervisors m the operation of the automatic
,tabulating equipment as directed by the Tabulation Supervisors.
F Jeanne Lyons is hereby appointed as Presiding Judge of the Central Counting Station.
She shall maintain order at the Central Counting Station and shall have such authority as
may be prescribed by the Texas Election Code.
SECTION 8.
The City Council shall appoint a Presiding Judge and an Alternate Presiding Judge for
each precinct or portion of a precinct within the District. Each Presiding Judge shall appoint not
less than two nor more than eight qualified election clerks to serve and assist m conducting said
election, provided that rt the Presiding Judge actually serves as expected, the Alternate Presiding
Judge shall be one of the clerks.
SECTION 9
That the City Secretary shall prepare and issue the ballots for said election. Said ballots
shall be marked `Official Ballot" and shall contain the names of the candidates to be voted
upon. The ballots shall be printed m English and in Spanish for use m said election.
SECTION 10.
That the Crty Secretary of the City of Fort Worth shall be responsible for conducting the
election, and shall furnish the election officials said ballots and voting equipment, together with

any other forms, blanks or instruction m accordance with the laws of the State of Texas, insofar
as same are applicable, and with the provisions of this resolution.
SECTION 11.
The polling places shall be kept open on June 11 2005 from 7 00 a.m. to 7.00 p.m, and
that due return shall be made to the Crty Council showing the number of votes cast for each
candidate for the City Council Distract No 6
SECTION 12.
The locations of the polling places for the election of Crty Council. District. No 6 except
insofar as they may be changed by the Crty Council, are set forth on Exhibit A attached hereto
and made a part hereof.
SECTION 13.
Any candidate receiving a ma~oraty of all the votes cast for the office for which he or she
is a candidate shall be elected to such office.
SECTION 14
This ordinance shall constitute the proclamation, call, notice and ordinance calling and
orderang said elections.
SECTION 15.
That notice of said elections shall be given by• (1) publishing a copy of this ordinance, m
English and m Spanish, at least once, not earlier than the 30t" day or later than the 10`" day before

election day m a newspaper published m said Crty and (2) not later than the 15th day before
election day posting a copy of this ordinance, m English and m Spanish, on the City's board
used for posting notices of the meeting of the Fort Worth City Council.
SECTION 16.
That the way and manner of holding said elections, the notice to be given therefore, the
polling places, the personnel and the officers who are to hold same, and all details connected
wrth the holding of the elections shall. be provided for and arranged by the Crty Secretary that
the proper notice and publication of this notice, proclamation and ordinance shall be only
cumulative of and m addition to the statutory notice of said elections as herein provided, and that
any omission or irregularity m this notice or m the publication or posting of this nonce,
proclamation and ordinance, or m the signing of same, shall not in any way affect or invalidate
such .election.
SECTION 17
That in all respects, said elections shall be conducted in accordance wrth the Texas
Election Code and the Crty Charter of the Crty of Fort Worth.
SECTION 18.
That rt is hereby officially found and determined that the meeting at which this ordinance
was adopted and said elections were called was open to the public and public notice of the time,
place and purpose of said meeting was given, all as required by Chapter 551 of the Texas
Government Code.

SECTION 19
That this ordinance, election order proclamation and notice shall take effect upon
adoption.

UNA ORDENANZA QUE ORDENA ELECCIONES DE SEGUNDA VUELTA PARR EL
DISTRITO CONCEJAL N° 6 POR LOS VOTANTES DE ESE DISTRITO QUE REUNEN
LOS REQUISITOS PARA QUE DICHAS ELECCIONES TENGAN LUGAR EL 11 DE
JUNIO DE 2005 CON EL FIN DE ELEGIR A UN CONCEJAL
EL CONCEJO MUNICIPAL DE LA CIUDAD DE FORT WORTH, TEXAS, ORDENA
LO SIGUIENTE.
PRIMERA SECCION
Las elecciones que tuvieron el proposrto de elegir a los Conce~ales para los Distritos
Conce~ales N° 2, 4 6, 7 y 8 tuvieron Lugar el 7 de mayo de 2005 Ningun candidato del Distrito
Conceal N° 6 obtuvo la mayoria de Los votos deposrtados por todos Los candidatos para el cargo
SEGUNDA SECCION
Que por medio de la presente y en cumphmiento con is Carta de la Ciudad de Fort Worth
y de acuerdo a la Constitution y Las leyes del estado de Texas, sean convocadas y ordenadas
elecciones de segunda. vuelta para el 11 de sumo de 2005 tal y Como Las autoriza la Section
2.025 del Codigo Electoral de Texas, Como fue enmendado, en cuya. fecha Los votantes del
Distrito Conceal N° 6 que reunen Los requisrtos podran votar con la finahdad de elegir a un
Conceal del Distrito N° 6
TERCERA SECCION
Los candidatos de Las elecciones de segunda vuelta son Los dos que obtuvieron el mayor
numero de votos en Las elecciones prmcipales.
CUARTA SECCION
(a) Robert Parten, Admmistrador Electoral del Condado de Tarrant, desempenara el

Por medio de la presente, se crea la Junta Electoral de la Votacion Temprana Para que
procese los resultados de la votacion temprana y tambien se nombra a Jeanne Lyons Como Juez

que Preside. Como tal, ella nombrara por to menos a otros dos miembros mas para que formen
pane de la Junta Electoral de la Notation Temprana.
SEPTIMA SECCIUN
A. Un sistema de votacion electromca, como to define el Capitulo 121 del Codigo Electoral
de Texas, debera utihzarse pars votar en las mesas electorales normales en dachas
elecciones para el Conte de las boletas y la tabulation de los resultados. Las elecciones se
admmistraran y el sistema de votacion electromca se utihzara conforme al Codigo
Electoral de Texas.
B Por medio de la presente, se crea la oficina del Admimstrador Electoral del Condado de
Tarrant, ubicada en el Palacio de Justicia del Condado de Tarrant en 100 Weatherford,
Fort Worth, Texas, para que sea la Estacion Central de Escrutimo para las boletas
electorales depositadas en dachas elecciones.
C Por medio de la presente, Robert Parten es nombrado Admmistrador de la Estacion
Central de Escrutimo por sus conocimientos y expenencia en llevar a Cabo elecciones con
la ayuda del sistema de votacion electromca para el cual se creo la Estacion Central de
Escrutimo asi -como por ser un votante registrado de la Ciudad de Fort Worth. El
Admmistrador se debera encargar de la admmistracion general de la Estacion Central de
Escrutmio y de la supervision general del personal que laborara en la Estacion.
D Por medio de la presente, Christopher Walker y Gayle Hamilton son nombrados
Supervisores de Tabulation por haber recibido capacrtacion en el mane}o del equipo
automatico de tabulation mstalado en la Estacion Central de Escrutimo Los Supervisores
de Tabulation deberan encargarse del mane~o del equipo automatico de tabulation.
E. Por medio de la presente, se aprueba el nombramiento de Leo Angell como Asistente de
los Supervisores de Tabulation. El debera. ayudar a los Supervisores de Tabulation a

mane~ar el equipo automatico de tabulation como se to ordenan los Supervisores de
Tabulation.
F Por medio de la presente, Jeanne Lyons es nombrada como Juez que preside la Estacion
Central de Escrutmio. Ella debera mantener el Orden en la Estacion Central de Escrutmio
y debera tener tat autoridad como puede ordenarle el Codigo Electoral de Texas.
OCTAVA SECCIUN
El Conce~o Municipal debera nombrar a un/una Juez que preside y a un/una Juez
alterno/a que preside para. cads precmto electoral o parte de el situado dentro del Distrito Cada
Juez que preside debera nombrar por to menos a dos (pero no mas de ocho) secretarios
electorales competentes pars que desempenen sus funciones y ayuden a organizar dachas
elecciones, siempre y cuando ellla Juez que preside realmente ocupe su cargo como se espera de
el/ella y el/la Juez alterno/a que preside sea uno/a de los/las secretanos/secretanas.
NOVENA SECCION
El Secretano Municipal debera preparar y distribuir las boletas electorales para dachas
elecciones. Estas boletas deberan it marcadas como `Boletas Electorates Oficiales" y contener
los Hombres de los candidatos su~etos a votacion. Para ser utilizadas en dachas elecciones, las
boletas deberan it impresas en mgles y espaiiol.
DECIMA SECCION
El Secretario Municipal de la Ciudad de Fort Worth debera ser el responsable de
organizar las elecciones y proporcionarles a los funcionarios electorales dachas boletas
electorales asi como el equipo de votacion, junto con cualquier otro formulario o documento

modelo para llenarse o mstructivos conforme a las leyes del Estado de Texas, hasty donde los
mismos sean pertmentes y de acuerdo a las disposiciones de esta resolution.
UNDECIMA SECCION
Las mesas electorales estaran abiertas el 11 de sumo del 2005 de 7 00 a.m. a 7 00 p.m y
los resultados que muestran el numero de votos depositados para cada candidato Para el Distrito
Conceal N° 6 deberan ser entregadas al Conce~o Municipal.
DUODECIMA SECCION
Las ubicaciones de las mesas electorales pars las elecciones del Distrito Conceal N° 6
excepto hasty donde estas pudieran ser cambiadas por el Conce~o Municipal, las estipula el
Documento de Prueba A anexado a este documento y que forma parte mtegrante de el.
DECIMOTERCERA SECCION
Cualquier candidato que obtenga la mayoria de todos los votos depositados para el cargo
por el cual el/ells se postulo como candidato sera elegido para tal puesto
DECIMOCUARTA SECCION
Esta Ordenanza debera constituir la proclamation, la convocation, e1 aviso y la
ordenanza que convoca y ordena dachas elecciones
DECIMOQUINTA SECCION
Que el aviso sobre dachas elecciones sea dado mediante. (1) la pubhcacion de una copra
de esta Ordenanza en mgles y en espanol por to menos una vez y no antes del tngesimo dia o
despues del decimo dia antes del dia de las elecciones, en el diario que pubhca dacha Ciudad, y

(2) la colocacion de una copra de esta Ordenanza en mgles y en espanol en el tablon que utihza
la Ciudad para colocar avisos sobre juntas del Conce~o Municipal de Fort Worth no despues del
vigesimopnmer dia antes de la fecha de Las elecciones.
DECIMOSEXTA SECCION
Que el Secretario Municipal sea queen planee y se encargue de a manera como se
organicen dachas elecciones, del aviso sobre ellas, de Las mesas electorates, del personal y Los
funcionanos que deberan ocupar sus puestos en ellos y de todos Los detalles relacionados con la
organizacion de Las elecciones, que el aviso debido y pubhcacion de este aviso, proclamacion y
ordenanza deberan ser solo acumulativos y suplementar al aviso reglamentano de dachas
elecciones tat y como se proporcionen aqua, y que cualquier omision o ~rregulandad en este aviso
o en la pubhcacion o colocacion en Lugar visible de este aviso, proclamacion y ordenanza, o en
firmar la misma, de ninguna manera pods afectar o mvahdar tales elecciones.
DECIMOSEPTIMA SECCION
Que en todo momento dachas elecciones deberan orgamzarse de acuerdo al Codigo
Electoral de Texas y a la Carta Municipal de la Ciudad de Fort Worth.
DECIMOCTAVA SECCION
Que por medio de la presente, se establece y decide que la reunion en la cual esta
Ordenanza fue adoptada y dachas elecciones fueron convocadas estuvo abierta al pi-bhco y se dio
a conocer un aviso pubhco con la Nora, ubicacion y finahdad de dacha reunion, todo como to
estipula el Capitulo 5.51 del Codigo Gubernarnental de Texas.
DECIMONOVENA SECCION

Que esta Ordenanza, Orden electoral, proclamation y aviso entraran en vigor al momento
de su adoption.
